VIII. COOPERATION IN THE ENFORCEMENT OF U.S. EXPORT RESTRICTIONS BELGIUM To the extent consistent with Belgian laws and regulations, and of the obligations assumed by the Belgian Government under CoCom, the Belgian authorities cooperate fully in the enforcement of U.S. export controls. FRANCE The French Government is cooperative within the limits permitted by French regulations and always pays prompt attention to evidence of diversions of strategic items. GERMANY (FEDERAL REPUBLIC) Federal and local authorities in the Federal Republic cooperate in the enforcement of U.S. export restrictions to the extent that they are permitted to do so under German law. When our restrictions coincide with German regulations, as in the procedures agreed between the CoCom countries, this cooperation is, of course, full. We also receive informal cooperation from Federal and local authorities in cases not covered under German law or regulation. Assistance in the execution of security trade controls on sales of U.S. excess military property in Germany, for example, has been most encouraging. No information furnished. ITALY THE NETHERLANDS Dutch authorities cooperate with the enforcement of U.S. export restrictions insofar as they coincide with those agreed to by the Dutch in CoCom. UNITED KINGDOM If the transaction involves a violation of United Kingdom export regulations as well as those of the United States, Her Majesty's Government cooperates to the full. In case of conviction, British courts are quite severe. However, if the transaction is a violation of United States but not United Kingdom regulations, British Government officials are naturally reluctant to assist the United States in taking ection against British subjects. Thus, to the extent that United States controls go beyond those accepted by CoCom (and the United Kingdom), it is difficult to obtain the cooperation of British authorities for enforcement purposes. Indeed, in one or two recent cases Her Majesty's Government has intervened with the United States Government on behalf of British firms on the grounds that they were engaging in export transactions that were perfectly legal under United Kingdom law. IX. NUMBER OF U.S. OFFICIALS OVERSEAS ENGAGED IN ENFORCING U.S. EXPORT CONTROLS BELGIUM One officer in Embassy Brussels and one in the consulate general at Antwerp are engaged in enforcement of U.S. export controls. Neither of these officers works exclusively on problems of this sort, however. FRANCE Embassy Paris has two officers who are concerned with economic relations of France with the Sino-Soviet bloc. One officer spends full time in the field and the other spends roughly a quarter to one-half time on these questions. With respect to the implementation of U.S. export controls, about one-quarter of the first officer's time is spent this way and possibly 15 percent of the other officer's activities fall in this category. Each of the six consulates has an officer to do this type of work as needed, although very few problems arise which affect the consulates. GERMANY (FEDERAL REPUBLIC AND WEST BERLIN) Embassy Bonn has two officers who devote considerable portions of their time (roughly 50 percent) to enforcing U.S. export controls, each of the six consulates general in the Federal Republic has designated an "economic defense officer," as has the U.S. mission in Berlin. While the amount of time spent on export control work varies widely from post to post, few if any of these officers are required or able to devote more than half of their workday to enforcement programs. In addition to Foreign Service posts, the U.S. Army Property Disposal Detachment in Frankfurt, the detachment's headquarters in Heidelberg, and its constituent sales outlets in Germany are also responsible for enforcing Department of Defense controls on the disposal of military excess property. The Treasury Department maintains a three-man office at Frankfurt which, while primarily occupied with other obligations, also assists in export control enforcement operations, particularly when Treasury regulations are involved. ITALY THE NETHERLANDS At the Embassy in The Hague and at the consulates general in Rotterdam and Amsterdam, one officer (designated economic defense officer) is responsible for enforcing U.S. export controls. Since these officers have other duties, a total of somewhat less than one officer's time is engaged in export control work. UNITED KINGDOM The Embassy London staffing pattern calls for two economic defense officers. Since mid-November only one officer has been assigned to this work, but a second officer has been selected and is expected to report for duty in the near future. Each of the consulates has one American officer assigned to this type of work, although in each case it is considerably less than a full-time job. APPENDIX I.
