Where defendant is charged with possession of an imitation or substitute, the information must allege that such imitation or substitute contains as much as one-half of one per centum of alcohol, measured by volume. Wortman v. State. 9 Okla. Cr. 440, 132 P. 358. Before liquors or any receptacle can be introduced for the inspection of the jury, they must be identified and proven to have been in the possession of defendant. Sturgis v. State, 2 Okla. Intoxicating qualities may be shown by experiments, or by a witness who has had an opportunity of personal observation. Markinson v. State, 2 Okla. Cr. 324, 101 P. 353.

Permissible for state witness to fully describe and identify premises where offense was committed. Cook v. State, 4 Okla. Cr. 519.

State must show that "bitters" is intoxicating. Crawford v. State, 5 Okla. Cr. 33, 113 P. 200.

Where the State charges and relies on particular sales, evidence of other sales are not admissible. Smith v. State, 5 Okla. Cr. 67. 113 P. 204.

State cannot show consignments of liquor to defendant subsequent to filing of information. Johnson v. State. 5 Okla. Cr. 128. 113 P. 997. Defendant is entitled to show his general good reputation as a defense. Frier v. State, 6 Okla. Cr 532. 119 P. 1124.

PENAL SECTIONS NOT INCLUDED IN CODE PROPER.

The following are references to those penal provisions taken from political and general acts which, by reason of their nature, could not be incorporated in the main text of this compilation. The reader is cautioned to use these for reference purpose only and to resort to the original provisions where he may place his own construction upon the provisions cited.

Abstracting.

Failure of abstractor to file bond is misdemeanor. (3 R. L. 1910)

Violation of chapter is misdemeanor. (8 R. L. 1910) False certificate by abstractor is felony. (9 R. L. 1910) Extortion by abstractor is punishable by fine. 10 R. L. 1910)

Agricultural Statistics.

It is a misdemeanor for any person, firm or corporation to furnish to any assessor any information which is false, or to refuse to furnish any information which is required to be given under the law. (S. L. 1919, 132)

Sale of Agricultural Seed.

It is a misdemeanor to violate any of the provisions of this chapter. (S. L. 1919, 198)

Agriculture and Horticulture.

It is a misdemeanor to violate any provisions of this act or any rule or regulation promulgated hereunder. (S. L. 1915, 654)

It is the duty of the county attorney to prosecute violations of this act, when furnished satisfactory evidence thereof by state inspector. (S. L. 1915, 655)

Animals.

Failure to treat live stock under directions of inspector is misdemeanor. (32 R. L. 1910)

BREEDER'S LICENSE.

A violation of any of the provisions of this act is a misdemeanor. (S. L. 1915, 79)

HOG CHOLERA.

It is a misdemeanor to violate the provisions of this act. (S. L. 1917, 306)

BOVINE TUBERCULIN.
