For Committee, G. B. WESTON, Chairman. In the Year of our Lord, One Thousand Eight Hundred and Thirty-Three. AN ACT For the Prevention of Frauds in the Sale of Oils. 1 SEC. 1. BE it enacted by the Senate and House of 2 Representatives in General Court assembled, and by 3 the authority of the same, That from and after the 4 passing of this Act, all Oils sold under the names of 5 Sperm, Spermaceti, Lamp, Summer, Fall, Winter 6 and second Winter Oils, shall be deemed and taken 7 to be pure Spermaceti Oil. 1 SEC. 2. Be it further enacted, That all oils sold 2 under the names aforesaid, which shall be adultera3 ted from pure spermaceti oil, shall be deemed whale 4 oil, and the vender or venders shall be liable to the 6 the difference in value between pure spermaceti oil 7 and whale oil, when the quantity sold exceeds five 8 gallons, and four times the difference when said 9 quantity is less than five gallons, unless the propor10 tions of the respective oils of which the mixture con11 sists, is disclosed to the purchaser at the time of sale, 12 and in writing, if the quantity exceeds one gallon, to 13 be recovered in any court proper to try the same. 1 2 SEC. 3. Be it further enacted That any person or persons who shall sell any oil or oils commonly known 3 under the names specified in the first section of this 4 Act, which have been adulterated from pure sperma5 ceti oil by a mixture of whale or any other inferior 6 oil, and not disclosing the same at the time of sale, 7 in writing, if the quantity exceed one gallon, to the 8 purchaser, shall forfeit for every such offence fifty 9 dollars, to be recovered with costs of suit in an ac10 tion of debt, to the use of the person sueing for the 11 same, and the written disclosures aforesaid may be 12 given in evidence in such action. BE it enacted by the Senate and House 2 of Representatives, in General Court assembled, and 3 by the authority of the same, That Samuel Slater, 4 Stephen Salisbury, and Jonathan Davis, their associ5 ates, successors and assigns be, and they hereby are 6 made a body politic and corporate, under the name 7 of the "Worcester and Norwich Rail Road Compa8 ny," and by that name shall be and hereby are made 9 capable in law, to sue, and to be sued to final judge10 ment and execution, plead and be impleaded, defend 11 and be defended, in any courts of record, or in any 12 other place whatever; to make, have and use a com13 mon seal, and the same to break, renew or alter at 14 pleasure; and shall be and are hereby vested with 15 all the powers, privileges and immunities which are 16 or may be necessary to carry into effect the purposes |
