And be it further enacted, That the said president, recorder and trustees, when convened for business, shall be called, "the select council of the town of Chillicothe," and they or any five of them, whereof the president or recorder shall always be one, shall have full power and authority, from time to time, and at any time, to hold a select council in the said town, at the court house aforesaid, and to make and publish such laws and ordinances in writing, and the same, from time to time, to alter or repeal, as to them shall seem necessary and proper, for the interest, comfort, safety and convenience of the said town of Chillicothe, and the inhabitants thereof; to administer all necessary oaths, to impose reasonable fines upon all persons who shall offend against the laws and ordinances made as aforesaid; to levy and cause to be collected all such fines by warrant, under the hand of the president, or in his absence, of the recorder, and the seal of the council, directed to
