THIRTY-SIXTH DAY

Guthrie, Oklahoma Territory,

MORNING SESSION.

February 14, 1905.

The Council was called to order by the President.

The Chaiplain being absent, prayer was dispensed with.
All members were present.

The Journal of the preceding day was read and approved.

The following bills were read the second time and referred to committees:

House Bill No. 49, by Mr. Ballinger, to Judiciary Committee; House Bill No. 128, by Mr. Ballinger, Committee on Private Corporations and Corporate Law; House Bill No. 23, by Mr. Bryan, Committee on Elections; House Bill No. 56, by Mr. Levy, Quarantine and Animal Industry Committee; House Bill No. 72, by Mr. Ferris, Committee on Private Corporations and Corporate Law; House Bill No. 216, by Mr. Speaker, Committee on Education; House Bill No. 201, by Mr. Speaker, Committee on Municipal Corporations; House Bill No. 138, by Mr. Robinson, Committee on Municipal Corporations; Council Bill No. 135, by Mr. Menefee, Committee on Municipal Corporations; Council Bill No. 136, by Mr. Menefee, Judiciary Committee; Council Bill No. 137, by Mr. Scott, Committee on Education; Council Bill No. 138, by Mr. Scott, Committee on Public Institutions; Council Bill No. 139, by Mr. Scott, Committee on County and County Affairs; Council Bill No. 140, by Mr. Sharrock, Committee on County and County Affairs.

Council Bill No. 97, by Mr. Decker, by request, was read for the third time, and placed on its final passage. Mr. Decker presented petitions in support of the Bill. The question being, "Shall the Bill pass," the roll was called and the vote resulted as follows:

Ayes: Alexander, Cralle, Decker, Francis, Hickam, Menefee, Murphy, Niblack, Scott, Sharrock, Threadgill, Woodson, Mr. President, 13. The title of the Bill was agreed to.

House Bill No. 15, by Mr. Lydick, was read the third time and placed on its final passage.

A message was received from the House transmitting House Bill No. 132.

The question being, "Shall the Bill pass," the roll was called and the vote resulted as follows:

Ayes: Cralle, Decker, Francis, Menefee, Niblack, Sharrock, Threadgill, Woodson, Mr. President, 9; nays: Alexander, Hickam, Murphy, 3.

The title of the Bill was agreed to.

Substitute House Bill No. 37, by Mr. Gayman, was read the third time, amended and placed on final passage. The question being, "Shall the Bill pass," the roll was called and the vote resulted as follows:

Ayes: Decker, Francis, Hickam, Menefee, Murphy, Scott, Sharrock, Threadgill, Woodson, Mr. President, 10; nays: Alexander, Cralle, Niblack, 3.

The title of the Bill was amended and agreed to.

The following Bills were introduced and read the first time:

Council Bill No. 141, by Mr. Alexander, "An Act empowering courts, judges and justices of the peace, to require witnesses in certain cases to enter into recognizance, giving obligation of bail, or in default thereof, to be confined in jail to secure their appearance and testimony in such cases, and for other purposes."

Council Bill No. 142, by Mr. Alexander, "An Act to provide fees to be paid witnesses in certain criminal cases."

Mr. Alexander moved that the Bill be considered read the second time and referred to a committee. The motion carried, and the Bill was referred to the Judiciary Committee.,

Council Bill No. 143, by Mr. Hickam, "An Act to authorize the construction of additional buildings for the Oklahoma Agricultural and Mechanical College at Stillwater."

Council Bill No. 144, by Mr. Hickam, “An Act amending Section 3, of Article 6, of Chapter 22, of the Statutes of Oklahoma, 1893, entitled, 'County Surveyor.""

House Joint Resolution No. 12, by Mr. Noffsinger, "An Act to call the attention of the Interstate Commerce Commission to railroad discriminations in the Territory."

House Bill No. 132, by Mr. Gandy, "An Act relating to irrigation; providing for the acquisition, regulation and use of water rights; providing for certain contingent reservations of water rights in case same are requested by the United States Government, and for other purposes."

Mr. Woodson moved to suspend the Rules and that the Bill be considered read the second time and referred to the Committee of the Whole; the motion carried.

The Committee on Municipal Corporations reported, recommending that Council Bills Nos. 10, 72, 30, 73, do pass; report was adopted.

The Committee on Enrolled and Engrossed Bills reported Council Bill No. 57 correctly enrolled; report adopted.

On motion of Mr. Decker, the Council resolved itself into the Committee of the Whole to consider House Bill No. 132, and other General Orders.

Mr. Decker was called to the Chair.

The Committee of the Whole reported progress in the consideration of House Bill No. 132; report adopted.

On motion of Mr. Sharrock. Council took a recess until 2 o'clock.

AFTERNOON SESSION.

The Council was called to order by the President.

On motion of Mr. Menefee, the Council resolved itself into the Committee of the Whole, with Mr. Decker in the Chair.

The Committee arose temporarily to receive a message from the House, transmitting Council Bill No. 57.

The Committee arose temporarily to receive a message from the House, transmitting Council Bill No. 4 and House Joint Memorial No. 4.

The Committee arose temporarily to receive a message from the House, notifying the Council that the House had concurred in the amendments of House Bill No. 37.

The Committee arose temporarily to receive a message from the House, notifying the Council that the House had passed Council Bill No. 4 over the Governor's veto.

The Committee of the Whole reported, recommending that House Bill No. 132, and Council Bill No. 95, and Substitute for Council Bill No. 44 and House Bill No. 1 do pass; report adopted.

The Rules were suspended and Council Petition No. 14, relating to an investigation of the Capitol National Bank, was read.

Mr. Scott moved that a Committee of five meet with the Comptroller of the Currency to investigate the deposits of the Territory, the Committee to be appointed by the President of the Council. The motion carried.

The Rules were suspended and the introduction of Bills was declared in order. The following Bill was introduced:

Council Bill No. 145, by Mr. Menefee, "An Act to enable the people of Oklahoma Territory and Indian Territory to form and adopt a constitution and organize a state government to be known as the State of Oklahoma, and to secure the admission of the said state into the Union."

Mr. Niblack presented Council Petition No. 12, which was read and referred to the Committee on Ways and Means.

On Motion of Mr. Cralle, the Council adjourned until tomorrow

at 10 o'clock A. M.
