FORTY-SECOND DAY

Guthrie, Oklahoma Territory,

Monday, February 20, 1905.

MORNING SESSION.

The Council was called to order by the President.

Prayer was offered by the Rev. W. H. Rose.

All members were present, except Mr. Alxander.

The Journal of the preceding, day was read and approved.

The following Bill was read the second time and referred to the Committee: Council Bill No. 150, by Mr. Hickam, to Judiciary Committee.

The following Bills were introduced and read for the first time:

Council Bill No. 151, by Mr. Decker, by request, "An Act creating a lien upon grain threshed, providing for enforcement of same, and providing penalty for selling or disposing of grain upon which such lien exists."

Council Bill No. 152, by Mr. Threadgill, “An Act relating to trust companies, fidelity, surety, guarantee and accident companies, providing for indemnity funds, etc."

Council Bill No. 153, by Mr. Francis, "An Act to amend Section 6, Chapter 22, Session Laws of Oklahoma, 1897, relating to the liquor traffic, and for other purposes."

Council Bill No. 154, by Mr. President, "An Act providing for parole and rebate on penalties of persons convicted of crime, and sentenced to the penitentiary therefor."

Mr. Hickam moved that Council Bill No. 154 be considered read the second time and referred to a Committee, by suspension of the Rules, which motion carried. The Bill was referred to the Judiciary Committee.

The Committee on Ways and Means reported, recommending that House Joint Resolution No. 8 and Council Bill No. 116 do pass; report adopted.

The Committee on County and County Affairs reported, recommending that Council Bill No. 147 and No. 139 and House Bill No. 121 do pass, and that Council Bill No. 144 do not pass; report adopted.

The Committee on County and County Affairs reported that House Bill No. 54 do pass. Mr. Decker moved that the report on House Bill No. 54 be laid on the table, which motion carried.

The Rules were suspended by unanimous consent and the following Bills were introduced:

Council Bill No. 155, by Mr. Niblack, "An Act relating to the shipping of coal in ́bulk.”

Mr. Niblack moved that Council Bill No. 155 be considered read the second time and referred to a Committee, by suspension of the Rules, which motion carried. The Bill was referred to the Committee on Railroads.

Council Bill No. 156, by Mr. Niblack, "An Act amending Sections 321, 322, 323, 325 and 326, of Article 25, Chapter 25, of Wilson's Revised and Annotated Statutes of Oklahoma of 1903, the same relating to libel and slander."

Mr. Niblack moved that Council Bill No. 156 be considered read the second time and referred to a Committee, by suspension of the Rules, which motion carried. The Bill was referred to the Committee on Private Corporations and Corporate Law.

A message was received from the House transmitting House Bills Nos. 2, 21, 39, 67, 127, 45, 116, 83, 27; Council Bills Nos. 23 and 1, and announcing concurrence in the amendments of House Bill No. 132 and No. 9; also, the adoption of the report of the Conference Committee on Council Bill No. 1.

The President signed House Joint Resolution No. 12 and Council Bill No. 1.

On motion by Mr. Francis the Council resolved itself into the Committee of the Whole, to consider General Orders.

Mr. Francis was called to the Chair.

The Committee of the Whole reported, recommending that Council Bill No. 115 do pass as amended; report adopted.

Mr. Hickam presented a communication which was read. Threadgill moved that the communication be spread on the minutes, and that a copy be furnished all the daily newspapers, which motion. carried.

To the Council of the Eighth Legislative Assembly:

At a mass meeting of the citizens and members of all the churches of Perkins, Oklahoma, held at the Christian Church on Monday evening, February 13, resolutions were adopted most heartily endorsing the action of the Council and House of Representatives for their actions in endorsing the amendments to the Statehood Bill as passed by the Senate of the United States.

On motion by Mr. Woodson the Council took a recess until 2 o'clock.

AFTERNOON SESSION.

The Council was called to order by the President.

On motion by Mr. Sharrock, the Council resolved itself into the Committee of the Whole. Mr. Sharrock was called to the chair.

The Committee arose temporarily and received a message from the House transmitting House Bill No. 9.

The Committee arose temporarily and received a message from the House announcing non-concurrence in amendments of House Bill No. 60.

The Committee of the Whole reported, recommending that Council Bill No. 107 do pass as amended. Report adopted.

Mr. President signed House Bill No. 9.

The Rules were suspended by unanimous consent and the Committee on Education reported, rceommending that House Bill No. 216 do pass as a Subtitute for Council Bill No. 137. Report adopted.

The Committee on Education reported, recommending that Council Bill No. 21 do not pass. Mr. Murphy moved to amend the report, that the bill do pass; motion carried.

Education reported, recommending that

House Bill No. 76 do pass; report adopted..

Mr. Decker moved to reconsider the report of the Committee on House Bill No. 76, which motion was lost.

The Committee on Education reported, recommending that Petition No. 10 be placed on file, that Council Bill No. 126 do not pass, and that House Bill No. 216 do pass; report was adopted.

On motion by Mr. Alexander, the Council adjourned.

MORNING SESSION.

The Council was called to order by the President.

Prayer was offered by the Chaplain.

All members were present, except Mr. Sharrock, who was excused.
The Journal of the preceding day was read and approved.

Mr. Threadgill presented a communication from the Central State Normal School, which was read.

Mr. Murphy presented a petition from Weatherford, which was read and filed.

The following bill was read the second time and referred to the Committee: Council Bill No. 151, by Mr. Decker, by request, to the Committee on Agriculture and Highways.

A message was received from the House, transmitting Council Bill No. 37, and House Bills Nos. 98, 50, 92, 62.

Council Bill No. 152, by Mr. Threadgill, was referred to the Committee on Private Corporations and Corporate Law.

Council Bill No. 153, by Mr. Francis, was referred to the Committee on Education.

Council Bill No. 103 was read the third time and placed on its final passage. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:
