hereby fo declared; That all and every Fine and Fines, and Conveyances in the Law whatfoever, already had, made, levied, fuffered, executed or acknowledged, or at any Time hereafter to be had, &c. of the faid Meffuage, Lands and Premiffes above-mentioned, or any Part thereof, either alone by itself, or jointly with any other Lands, Tenements or Hereditaments, by and between the faid Parties to thefe Prefents, or by or between them, or either of them, and any other Perfon or Perfons whatsoever; as for and concerning all and fingular the faid Premiffes above-mentioned, with the Appurtenances, fhall be and enure, and fhall be adjudged, esteemed and taken to be, and enure, to and for the only proper Ufe and Behoof of the faid W. F. his Heirs and Affigus for ever, according to the true Intent and Meaning of thefe Prefents; and to and for none other Ufe, Intent or Purpose whatsoever. In Witnefs, &c.

A Release and Confirmation of feveral Messuages, formerly conveyed by a Man and his Wife, to divers Purpofes; first as a Security for a Sum of Money, and a Perfon was impowered to receive the Rents, to discharge the Interest; then to procure an Affignment of a Judgment to attend the Fee; and afterwards the Premifles to remain to the Ufe of fuch Perfons, and for fuch Eftates as the Wife alone, and feparate from ber Hufband, fhould by any Writing, or by her Will appoint; made by the Wife, and the Perfons to whom the Premiffes were conveyed as aforefaid, to a Purchafer.

THIS mow and Relict of HIS Indenture Tripartite made,&c. Between

Sir J.T. Knight, deceafed, and fole Sifter and Heir of E. W. late of, &c. deceased, who was formerly the Wife of P. T. late of, &c. deceafed of the firft Part; T. E. of, &c. and H. F. of, &c. of the fecond Part; and R. B. of, &c. of the third Part. Whereas in and by certain Indentures of Leafe and Releafe, the Leafe bearing Date, &c. and the Release, &c. made or mentioned to be made between the faid Sir J.T. and Dame D. his Wife of the one Part; and the faid T. E. and H. F. of the other Part; And by Fine Sur conuzance de droit, &c. thereupon duly levied; they the faid Sir J. T. and Dame D. his Wife, for and in Confideration of the Sum of 600 l. of, &c. to them therein mentioned to be paid by the faid T. E. and H. F. Did grant and convey unto the faid T. E. and H.F. their Heirs and Affigns for ever, All those three Meffuages or Tenements, with the Appurtenances, fituate, ftanding and being within the

Precincts of, &c. heretofore in the feveral Tenures or Occupations of A. B. Gent. C. D. Merchant, &c. All which faid Meffuages or Tenements were thentofore purchased of, &c. by, &c. to her and her Heirs in Fee-Farm under the yearly Rent of 40 s. and were by her granted and conveyed to the faid E. W. and her Heirs, by the Name of, &c. And also all Ways, Profits, Commodities, Advantages, Emoluments and Hereditaments whatsoever, to the faid Meffuages or Tenements belonging, or in any wife appertaining: To have and to hold unto them the faid T. E. and H. F. their Heirs and Affigns, to the only proper Ufe and Behoof of the faid T. E. and H. F. their Heirs and Affigns for ever; as in and by the faid recited Indentures may more fully appear. And whereas in and by one other Indenture, bearing Date, &c. made between the said T. E. of the firft Part; the faid H. F. of the fecond Part; and the faid Sir J. T. and Dame D. his Wife of the third Part; reciting that the fame Dame D. as well by the Will of E. W. Widow, as being her fole Sifter and Heir was feifed in Fee-fimple of the faid feveral Meffuages and Tenements above-mentioned; And reciting alfo the faid Conveyance to the faid T. E. and H. F. And reciting further, that long before the faid Conveyance to them, one Sir T. D. Knt. had obtained a Judgment against Sir J.T. for the Sum of 600l. or thereabouts, befides Cofts; And that upon an Inquifition taken up. on an Elegit grounded on the faid Judgment, had caufed the faid Houses to be extended during the Life of the faid Sir J. T. They the faid T.E. and H. F. Did thereby fignify and declare that the faid Conveyance made to them

as aforefaid was upon the Trufts, and for the Ends, Intents and Purpofes following: (that is to fay) First for the fecuring the Payment to the faid T. E. on, &c. then next the Sum of 150l, of, &c. being fo much by him the faid T. E. then lent and paid to the faid Sir J. T. and Dame D. his Wife, with Intereft therefore: Secondly, To the Intent the faid T. E. fhould and might, and he was thereby enabled and defired by the faid Sir J. T. and Dame D. his Wife to redeem and purchase from the faid Sir T.D. the aforefaid Judgment and Extent, and to procure the fame to be affigned to fuch Perfons as the faid T. E. fhould appoint, In Truft, to attend the Reverfion and Inheritance of the faid Premiffes Thirdly, That in Cafe the faid Sir J.T. and Dame D. his Wife, or either of them, or the Heirs of the faid Dame D. fhould on, &c. then next coming, pay or caufe to be paid unto the faid T. E. his Executors, Adminiftrators or Affigns, as well the faid 150l. and Intereft, by them borrowed, and received of him as aforefaid, and likewife fuch Sum and Sums of Money as he the faid T. E. fhould pay to the faid Sir T.D. for the Purpose aforefaid, and the Charges in procuring fuch Affignment, with Intereft therefore, from the Time the fame fhould be fo paid; That then they the faid T. E. and H. F. and their Heirs, fhould and would ftand feized of the faid Premiffes, To the Ufe of fuch Perfon or Perfons, and for fuch Eftate and Eftates, as fhe the faid Dame D. alone and feparate from her faid Hufband fhould by any Writing or Writings, or by her laft Will in Writing, attefted by three or more credible Witneffes appoint; and in Default of fuch Appointment, in Truft, for the faid Dame

Dame D. and her Affigns, during her Life, and after her Death, in Truft, for the right Heirs of the faid Dame D. Fourthly, It was thereby agreed, That the faid R. B. fhould be authorized and impowered to receive the Rents, becoming due from Time to Time for the faid Houses, and to let and fet the fame, as Occafion fhould require, and out of the faid Rent, fo to be received, fhould and ought to pay the faid T. E. his Executors, Adminiftrators and Affigns, as well the Intereft of the faid 150l. by him then lent, as of the Moneys by him to be advanced and paid to the faid Sir T. D. for the Purposes aforefaid, until the faid T. E. his Executors or Adminiftrators should give Notice to the faid Dame D. to pay in the principal Money; and until then the faid R.B. was to pay the Refidue of the Rents to the faid Dame D. alone, for her separate Use, fo as her Husband might not intermeddle therewith, or to fuch other Perfon or Perfons, as fhe alone fhould under her Hand appoint. And whereas the faid T. E. afterwards paid to the faid Sir T. D. the Sum of 150l. and took an Affignment of his faid Judgment and Extent, as may appear. And whereas the faid Sir J. T. foon after died. And whereas the faid T. E. afterwards lent to, and paid for the faid Dame D.T. feveral Sums of Money; and the faid R.B. out of the Rents by him received for the faid Houfes, hath paid feveral Sums of Money to the faid T. E. And whereas upon an Account now made up and ftated between the faid T. E. and the faid Dame D. T. as well of and concerning the Moneys by him lent, as aforefaid, as concerning all the Moneys, by him received of the faid R. B. there remains due to the faid
