The Commonwealth of Massachusetts

In the Year One Thousand Nine Hundred and Sixty-Nine.

AN ACT ESTABLISHING THE CAMS REGIONAL SOLID WASTE DISPOSAL DISTRICT.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. There is hereby established the CAMS Regional 2 Solid Waste Disposal District consisting of the following 3 cities and towns: Cambridge, Arlington, Medford and Som4 erville.

SECTION 2. The district shall be a body corporate and poli2 tic and shall have the power to establish, maintain and oper3 ate such solid waste disposal facilities it deems necessary. 4 To carry out the purposes of this act, the district shall have 5 the following powers and duties:

7 (b) to sue and be sued, but only to the same extent and 8 upon the same conditions that a city or town may be sued. 9 (c) to purchase land and buildings for the purposes of the 10 district and to hold property.

11 (d) to accept from the federal and state government or any 12 charitable foundation or organization, private corporation 13 or person, and expend for the purpose for which given, any 14 grant or gift in aid of the purposes of this act and to accede 15 to any conditions or obligations attached thereto. Until so 16 expended all amounts so received shall be deposited with 17 the state treasurer and held in an account to be known as 18 the CAMS Regional Solid Waste Disposal District Fund. 19 (e) to engage legal counsel.

(f) to engage a certified public accountant

(g) to employ an executive director and such other experts 22 and consultant services as it deems necessary to plan and 23 operate said district.

-24 (h) the executive director shall appoint, and may remove 25 as employees of the district, such employees as he may deem 26 necessary. The executive director, employees and experts 27 and consultants employed by the district shall not be sub28 ject to the provisions of chapter thirty-one, nor to section 29 nine A of chapter thirty; provided, however, that the execu30 tive director and employees of the district may be members 31 of the state contributory retirement system and shall be 32 eligible to participate in all group insurance programs un33 der chapter thirty-two A.

34 (i) to submit to the governor, the general court, and to the 35 member cities and towns of the CAMS Regional Solid Waste 36 Disposal District on or before the first Wednesday of Decem37 ber in each year, beginning in nineteen hundred and sixty38 nine, a report of the operations of the district relative to 39 solid waste disposal during the preceding fiscal year includ40 ing a detailed financial statement for each year showing the 41 method by which the annual charges assessed against each 42 city and town in the district were computed.

(j) to adopt an annual operating budget not later than 14 December thirty-first. The fiscal year of the district shall be 15 from January first to December thirty-first.

46 (k) to enter into contracts for the disposal of the solid 47 waste of non-member cities and towns as well as other bodies 48 politic, the United States of America, and other persons, for 49 the disposal of solid waste, and for such purposes to estab50 lish and collect rates and charges at least equal to the full 51 cost of service provided under such contracts.

(1) to enter into contracts for the construction, reconstruc53 tion, maintenance or operation of solid waste disposal facili54 ties.

(m) to enter into contracts for the disposal within and 56 outside of the district, of solid wastes originating in the dis57 trict.

(n) to contract for one or more of the following: 1. engi

59 neering evaluation of its existing or proposed solid waste 60 facilities and its existing or proposed methods of solid waste 61 disposal, 2. study and research respecting improvements 62 therein, and 3. expert advice concerning new methods and 63 facilities, 4. any other service appurtenant to the planning 64 construction and maintenance of solid waste disposal facili65 ties.

.66 (0) to employ in the establishment of a solid waste dis67 posal facility such buffer zones, special structural, archi68 tectural or landscape treatment or other features as may 69 be advisable for aesthetic reasons or to protect the public 70 health, comfort and convenience or property values in the 71 vicinity.

72 (p) to design and operate, insofar as feasible, solid waste 73 disposal facilities in such manner that after termination of 74 their use for such disposal the sites thereof will not be in75 compatible with foreseeable uses thereof.

(q) to keep records of the general administrative costs 77 for solid waste disposal and the costs of evaluation and re78 search.

79 (r) to keep records of the cost of establishing, maintain80 ing and operating each solid waste disposal facility of the dis81 trict.

82 (s) upon termination of a solid waste disposal facility or 83 completion of a site or a reasonable portion thereof, the 84 executive board of the district, may retain, use, and fur85 ther develop the site as a public park, open area, green 86 belt, or other recreation area or convey it to an appropriate 87 state agency, local conservation commission or city or town 88 for such purposes. If the site is inappropriate for such uses, 89 the executive board, may sell or lease it for industrial de90 velopment provided such development is compatible with local 91 zoning laws in effect at the time.

92 (t) any and all powers and duties not enumerated herein 93 but necessary to fulfill the intent of this act shall be granted 94 to the CAMS Regional Solid Waste Disposal District.

SECTION 3. The powers, duties and liabilities of the CAMS 2 Regional Solid Waste Disposal District shall be vested in and 3 exercised by an executive board consisting of the city mana
