assayed, shall, upon the said debenture so certified being produced to him, forthwith pay the drawback or allowance, (a) out of the money of the said duties on plate, or manufactures of gold and silver, then in the hands of the said receiver or collector, without fee or reward; and if the said collector or receiver shall not have money in his hands to pay any such debenture, then the receiver-general of the stamp duties for the time being is hereby required to pay, or cause to be paid, the said debenture, out of the duties arising by this act.

Rule 11. All securities and bonds, required to be taken as aforebonds in force, said, shall continue in force, until every such exporter of any wrought plate, or manufactures of gold and silver, shall produce and deliver to such collector the bill of lading thereof, and which shall have at the foot the receipt of the master of the vessel on board of which the said plate or manufactures were shipped, and also a receipt or certificate, on the back of such bill of lading, under the hand of the person to whom such wrought plate or manufactures of gold and silver were consigned, certifying or acknowledging that the same have been re ceived, and mentioning in such receipt or certificate the true kinds and quantities of plate so consigned and received, and the name of the person consigning the same; and also, if such plate shall consist of watches, the numbers or figures marked or engraved in the inside of the case or box of each such watch, then such securities and bonds shall and may be delivered up and cancelled.

How copper,

Rule 12. Where the vessel, on board of which such plate, or manufactures of gold and silver, or watches, were shipped, shall be lost, or shall not, within three years, return to any port in Great Britain; upon due proof thereof being made to the collector at the port at which the said drawback was received, and the said bonds given, the said collector shall deliver up to such exporters their securities and bonds, so given by them, in order that the same may be cancelled, if no fraud therein shall in the mean time have appeared, or no prosecution thereon shall have been commenced.

Rule 13. All copper, brass, and every other metal inferior to silver, shall be spun upon thread, yarn, or inkle only, and not spun, mixed, brass, &c. to woven, wrought, or set upon silk, and no person shall sell, or offer or expose to sale, or export, any copper, brass, or other metal inferior to silver, which shall be spun, mixed, woven, wrought, or set upon silk, upon pain that every person offending therein shall forfeit 51. for one ounce or any quantity less than one ounce, and the further sum of 51. per ounce for every quantity exceeding one ounce, which shall be so spun, &c. sold, or offered or exposed to sale, or exported; and for default of paying down the penalty upon conviction, shall be committed, by the court in which judgment shall be given thereon, to the house of correction for the county or place where such person shall be so convicted, there to remain and to be kept to hard labour, for any time not exceeding six months nor less than three months, or until payment be made of the said penalty; and also upon pain that all such articles shall be forfeited.

Rule 15. § 4.

Rule 16. Rule 17. Every action, bill, plaint, or information to be had, actions, § 7. brought, sued, commenced, or exhibited for any penalty or forfeiture incurred, for any offence committed against this act, shall be had, &c. within six calendar months next after the offence committed, or after the discovery thereof.

Companies

Rule 18. It shall be lawful for any person making or dealing in gold wares in Great Britain, to work or make, or cause or procure to be wrought or made, any gold vessel, plate, or manufacture of gold whatsoever, of the standard of 18 carats of fine gold in every lb. troy, and to sell, exchange, or expose to sale, or export out of this kingdom, any gold vessel, plate, or manufacture of gold whatsoever, of the standard of 18 carats of fine gold in every lb. troy.

Rule 19. No person whatsoever shall sell, exchange, or expose to sale, or export out of this kingdom, or cause or procure to be sold, exchanged, or exposed to sale, or exported out of this kingdom, any gold vessel, plate, or manufacture of gold, of the standard of 18 carats of fine gold in every lb. troy, until the same shall be marked with the new mark as follows; that is to say, with the mark of a crown and the figures 18, instead of the mark of the lion passant, upon pain that every such person shall, for every such offence, forfeit 10.

Rule 20. It shall be lawful for the respective companies of goldmay assay and smiths in London, Edinburgh, Birmingham, and Sheffield, and the

wardens and assayers of gold at York, Exeter, Bristol, Chester, Norwich, and Newcastle-upon-Tyne, being respectively duly authorized according to the laws in force on the passing of this act, to touch, assay, and mark, with the mark hereinbefore directed to be used, any gold vessel, gold plate, or manufacture of gold, made and wrought after the 1st October, 1798, of the standard of 18 carats of fine gold in every lb. troy, of gold brought to them respectively to be touched, assayed, or marked in like manner and under the like regulations, except as to the mark herein directed to be used, instead of the mark of the lion passant, as they respectively are authorized by the laws in force on the passing of this act, to touch, assay, or mark any gold vessel, gold plate, or manufacture of gold, of the standard of 22 carats of fine gold in every lb. troy.

Rule 21. Nothing in this act shall prohibit the making, selling, exchanging, exposing to sale, or exporting out of this kingdom, any gold vessels, plate, or manufactures of gold whatever, of the standard of 22 carats of fine gold in every lb. troy, in the manner directed by any law in force on the passing of this act.

Rule 22. Nothing herein contained shall authorize any person te

touch, assay, or mark with the mark directed to be used by the laws in 38 Geo. 3. force at the passing of this act, any gold vessel, gold plate, or manu- c. 69. ture of gold, made and wrought of a lower standard than the standard of 22 carats of fine gold in every lb. troy of gold.

Rule 23. Rule 24. All gold vessels, plate, and manufactures of gold what- Gold to be asever, of the standard of 18 carats of fine gold in every lb. troy, shall sayed, &c. be touched, assayed, and marked with the several marks directed to be used by this act, or by any act in force. on the passing of this act, in the marking of gold vessels, plate, or manufactures of gold, except the mark of the lion passant, by the like persons, at such places, and under such powers and regulations, and shall be under such conditions, and shall be subject to such penalties and forfeitures, and to the like payments and rewards, subtractions and detentions, upon touching, assaying, and marking the same, as gold vessels, plate, and manufactures of gold, of the standard of 22 carats of fine gold in every lb. troy, may be marked, &c. by the laws in force; and all the powers, penalties, forfeitures, and all other things prescribed by any act with relation to wrought gold plate, or manufactures of gold of the standard of 22 carats of fine gold in every lb. troy, and in force on the passing of this act (except where other provisions are expressly made by this act), shall be put in execution for the working, making, touching, and assaying all gold vessels, plate, and gold manufactures of the standard of 18 carats of fine gold in every lb. troy, and for the making the same according to this act, and for the selling, exchanging, exposing to sale, and exporting the same, as fully as if the same had been repeated and re-enacted in this act.

Rule 25. The drawback granted upon plate exported by way of 52 Geo. 3. merchandize shall be paid and allowed to the manufacturer or ex- c. 59. porter of all manufactured plate, whether intended as merchandize or plate as mer not, provided proof be adduced to the satisfaction of the commis- chandize or sioners of customs that such plate is new plate, and has never been not. used; and such drawbacks shall be allowed under the same regulations, penalties, and forfeitures, as are now by law provided with respect to plate made or wrought in Great Britain and exported by way of merchandize.

Rule 26. If any person shall forge, or cause to be forged, any mark (a) 55 Gen. 8. which shall have been provided in pursuance of any act relating to c. 18. § 7. any duties on gold or silver plate made in Great Britain, for the purpose of marking any such plate, in the manner directed by any such act, or shall forge, or cause to be forged, the impression of any such mark, upon any such plate, with intent to defraud His Majesty; or if any person shall mark, or cause to be marked, any such plate, or any vessel or ware of base metal, with any such forged mark, or shall transpose or remove, or cause to be transposed or removed, from one piece of

where fish, beef, and

exported.

gold or silver plate to another, or to any vessel or ware of base metal, any impression made with any mark so provided, in pursuance of any act for the purpose of marking or stamping of any such gold or silver plate; or if any person shall sell, exchange, or expose to sale, or export out of Great Britain, any such gold or silver plate, or any vessel or ware of base metal having thereupon the impression of any such forged mark, or any forged impression of any mark so provided, or any impres sion of any such mark, which shall have been transposed or removed from any other piece of plate as aforesaid, knowing the same respectively to be forged, or transposed or removed; or if any person shall wilfully and without lawful excuse (the proof whereof shall lie on the person accused) have or be possessed of any such forged mark, or shall privately and secretly use any mark so provided, with intent to defraud His Majesty, then every person so offending, and every person knowingly and wilfully abetting or assisting any person in committing any such offence, and being thereof lawfully convicted, shall be adjudged guilty of felony, and shall suffer death as a felon, without benefit of clergy.

TITLE CCXIV.—Provisions.

Rule 1. It shall be lawful for any fish curer, or any other person c. 89. 108. who shall be legally entitled to any dried or wet ling, cod, or hake, or salmon, or white herrings, or full red herrings, or clean shotten red herrings, or dried red sprats, or pilchards, or scads which shall be pork, may be British taken, to export, from any lawful quays and in lawful hours, any such fish to any parts beyond the seas, by way of merchandize, upon the terms and according to the directions hereinafter mentioned; and also for any person who shall be legally entitled to any beef or pork salted in England with salt, for which the duties shall have been paid, or who shall be legally entitled to any beef or pork salted in Scotland wholly with foreign salt, for which the duty shall have been paid, to export such beef or pork from any lawful quays in England or Scotland, to any parts beyond the seas, upon the terms and according to the directions hereinafter mentioned.

Rule 2. The person so intending to export any such fish, beef, or pork, shall give six hours' notice in writing of the time and place of shipping the same to the proper officer of excise of the place where such fish, beef, or pork, shall be intended to be shipped, who shall thereupon attend, and by tale, weight, or guage, take an account of the quantity and kind of the fish, and also of the beef or pork, so intended to be shipped, and shall see the same shipped or put on shipboard accordingly; and the exporter of such fish, beef, or pork, shall Shipping and weigh, or otherwise assist such officer in such manner as to such officer shall seem most expedient, in taking account of, and ascertaining, the quantity, quality, and species thereof, and shall ship the same in the presence of such officer; and the exporter of such fish, beef, or pork, Export bond. shall, before the shipping thereof, give sufficient bond, in treble the value of such fish, beef, or fork, that the same shall (the danger of the seas and enemies only excepted) be duly exported to parts beyond the seas, and shall not be unshipped or laid on land, or put on board any other vessel in Great Britain (shipwreck or other unavoidable accident excepted); and the exporter shall declare, upon oath, before the proper officer of excise of the said place, the quantity and kind of fish intended to be exported, and that the same, and every part thereof, is well and perfectly cured, and also well and fairly packed, and in good and mer
