SURVEY AND ALLOTMENT OF LANDS IN THE CROW INDIAN

RESERVATION IN MONTANA.

Washington, D. C. February 10, 1910.

The committee met at 10 o'clock a. m. for the purpose of the consideration of the following bill:

[S. 3373, Sixty-first Congress, second session.]

A BILL For the survey and allotment of lands now embraced within the limits of the Crow Indian Reservation, in the State of Montana, and the sale and disposal of all surplus lands after allotment.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Interior be, and he is hereby, directed to immediately cause to be surveyed all the land embraced within the limits of the Crow Indian Reservation, in the State of Montana, not heretofore surveyed.

SEC. 2. That so soon as all the lands embraced within said Crow Indian Reservation shall have been surveyed, the Commissioner of Indian Affairs shall cause allotments of the same to be made to all persons having tribal rights with said Crow Indians, who have not heretofore received allotments of land, under the provisions of the allotment laws of the United States: Provided, further, That hereafter the Secretary of the Interior shall cause allotments to be made under the provisions of this act to all children of Indians affected hereby so long as the tribe is possessed of any unallotted tribal or reservation lands.

SEC. 3. That the Secretary of the Interior may reserve such lands as he may deem necessary for agency, school, and religious purposes, to remain reserved as long as needed, and as long as agency, school, or religious institutions are maintained thereon for the benefit of said Indians: Provided, however, That the Secretary of the Interior is hereby authorized and directed to issue a patent in fee simple to the duly authorized missionary board, or other proper authority of any religious organization heretofore engaged in mission or school work on said reservation, for such lands thereon (not exceeding one hundred and sixty acres for any one of such organizations and not included in any town site herein provided for) as have been heretofore set apart to such organization for mission or school purposes: Provided further, That there is hereby granted to the bureau of Catholic Indian missions the following-described land on said reservation now and for many years reserved for and occupied by the Catholic Church for mission and school purposes: The east half of the southwest quarter and the west half of the southeast quarter of section twenty-three, township four south, range thirty-two east, containing about one hundred and sixty acres; also beginning at a point three and seventy-five hundredths chains west of the center of section one, township three south, range thirty-four east; thence north five and fiftyhundredths chains to a point; thence north three chains; thence three and thirty-three hundredths chains west; thence south three chains; thence east three and thirty-three hundredths chains to point of beginning of section one, township three south, range thirty-four east, containing one acre more or less; And provided further, That the Secretary of the Interior may reserve not to exIceed five thousand acres of timber lands for the common use of said Indians.

SEC. 4. That upon the completion of said allotments the President of the United States shall appoint a commission consisting of three persons to inspect, classify, appraise, and value all of said lands that shall not have been allotted in severalty to said Indians or granted or reserved by the terms of this act, said commission to be constituted as follows: One of said commissioners shall be a person holding tribal relations with said Indians, one representative of the Indian Bureau, and one resident citizen of the State of Montana.

SEC. 5. That within thirty days after their appointment said commissioners shall meet at some point within the Crow Indian Reservation and organize by
