and Substitute for Council Bill No. 39 be deferred until Monday, at 2 o'clock P. M., that the same had been adopted up to Section 13, and that it be made a Special Order.

The Committee on Education reported Council Bill No. 21 correctly engrossed.

The Committee of the Whole reported, recommending that Council Bill No. 129, Council Bill No. 139 and Council Bill No. 116 do pass.

On motion of Mr. Alexander, the Council concurred in amendments to Council Bill No. 8.

Mr. Alexander moved that a Committee of three be appointed by the President to confer with a like Committee from the House in regard to House Bill No. 1 and report back to the Council. The President appointed as such Committee, Mr. Alexander, Mr. Francis, Mr. Hickam.

The following Bills were considered read the second time and referred to Committees:

The Council was called to order by the President.

Prayer was offered by the Rev. Miles.

All members were present except Mr. Cralle, Mr. Decker, excused, Mr. Niblack, Mr. Sharrock, the latter being excused.

The Journal of the preceding day was read and approved.

The following Bills on third reading were taken up and placed on final passage.

Council Bill No. 116, by Mr. Hickam. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Francis, Hickam, Menefee, Niblack, Scott, Threadgill, Woodson, Mr. President, 8; nays: 0; absent: Alexander, Cralle, Decker, Sharrock, 4. The title of the bill agreed to.

Council Bill No. 139 by Mr. Scott. The question being, "Shall the bill pass," the roll was called the the vote resulted as follows:

Ayes: Francis, Hickam, Menefee, Murphy, Niblack, Scott, Threadgill, Woodson, Mr. President, 9; nays: 0; absent: Alexander, Cralle, Decker, Sharrock, 4.

Title of the Bill agreed to.

Council Bill No. 121, by Mr. Threadgill. The author moved to lay the Bill over until the afternoon session. Mr. Woodson objected. The motion lost. The question being, "Shall the bill pass," the roll was called and the vote resulted as follows:

Ayes: Hickam, Murphy, Scott, Threadgill, 4; nays: Alexander, Cralle, Francis, Menefee, Niblack, Woodson, Mr. President, 7; absent: Decker, Sharrock, 2.

Mr. Cralle explained his vote on Council Bill No. 21 as follows: "I vote 'No' because this bill is too complicated, and not applicable to rural districts. I am in favor of compulsory education."

Mr. Francis moved to reconsider the vote on Council Bill No. 21.
Mr. Niblack moved to table Mr. Francis' motion.

A message was received from the House transmitting House Bill No. 298, by Mr. Becker, House Bill No. 198, by Mr. Becker, and House Bill No. 311, by Mr. Speaker, which had passed the House.

The motion to table was lost. The roll was called on the original motion and resulted as follows:

Ayes: Francis, Menefee, Niblack, Woodson, Mr. President, 5; nays: Alexander, Cralle, Hickam, Murphy, Scott, Threadgill, 6; absent: Decker, Sharrock, 2.

Mr. Threadgill moved to make the Bill a Special Order for March 1, at 2 o'clock. The motion carried.

House Bill No. 59, by Mr. Ballinger, was read the third time.

Mr. Cralle asked unanimous consent to offer an amendment to the Bill which was not granted. Mr. Woodson moved to recommit the Bill to the Judiciary Committee. Motion lost.
