TWENTY-THIRD DAY

Guthrie, Oklahoma Territory,

Wednesday, February 1, 1905.

MORNING SESSION.

The Council met pursuant to adjournment and was called to order by the President.

Prayer was offered by the Chaplain.

All members were present, except Mr. Menefee, ill and excused, and Mr. Threadgill.

The Journal of the preceding day was read and approved.

The following bills were read the second time and referred to committees:

Council Bill No. 86, by Mr. Alexander, Judiciary Committee; Council Bill No. 87, by Mr. Woodson, Judiciary Committee; Council Bill No. 88, by Mr. Woodson, Judiciary Committee; Council Bill No. 89, by Mr. Murphy, Agriculture and Highways Committee; Council Bill No. 90, by Mr. President, Ways and Means Committee; Council Bill No. 91, by Mr. Decker, Judiciary Committee; Council Bill No. 92, by Mr. Decker, Judiciary Committee; Council Bill No. 93, by Mr. Niblack, County and County Affairs Committee.

The Committee on Private Corporations and Corporate Law reported, recommending that Council Bill No. 9 do pass as amended; report adopted.

The Committee on Judiciary reported, recommending that House Bill No. 14 do not pass; report adopted.

The Committee on Judiciary reported, recommending that House Bill No. 37 do pass, that Council Bill No. 24 do not pass, that Council Bill No. 22 do pass, and that Council Bill No. 31 do not pass; report adopted.

The Committee on Education reported, recommending that Council Bills Nos. 66 and 70, and House Bill No. 7 do not pass, and that Council Bills Nos. 57, 42, 50 and 38, and House Bill No. 53 do pass; report adopted.

Mr. Niblack moved for a reconsideration of the vote adopting the report of the Committee on House Bill No. 14, which motion was lost.

A message was received from the House, transmitting House Bill No. 121.

Mr. Sharrock moved that House Joint Memorial No. 4, by Mr. Wood, be read for the third time and placed upon its passage, which motion carried.

The Resolution was adopted.

House Concurrent Resolution No. 4 was read. Mr. Alexander moved to amend, "That five members from the Council, including Mr. President, and excluding the President pro tem, and twelve members from the House, including the Speaker, and excluding the Speaker pro tem, proceed to Washington City to do all things which might tend to procure statehood at this session of Congress, and that the remaining members of both the Council and the House dispense with other business and proceed to take such action as will bring about a constitutional convention, consisting of representatives from Oklahoma and Indian Territory, to be convened at the earliest date practicable.”

Mr. Niblack moved to amend the amendment that the Committee consist of the President of the Council and the Speaker of the House, which motion was lost.

The amendment by Mr. Alexander was lost.

Mr. Alexander offered an amendment that instead of members of the Legislature, that the Chief Justice and Secretary of the Territory constitute the Committee.

Mr. Decker moved as a substitute that fourteen, part from the Council, and part from the house, constitute the Committee, which was lost.

Upon motion of Mr. Hickam, the Council took a recess until 2 o'clock, P. M.

The Committee of the Whole reported, recommending that Coun cil Bill No. 8 do pass as amended; report adopted.

On motion of Mr. Cralle, the Council adjourned until 10 o'clock A. M., tomorrow.

House Joint Resolution No. 6, by Mr. Noffsinger.

A message was received from the House, transmitting House Bills Nos. 60, 54 and 71.

The President pro tem was called to the Chair.

Mr. Cralle moved that House Joint Resolution lie on the table. Mr. President moved as a substitute that action on the Joint Resolution be deferred, which motion carried.

A message was received from the House transmitting House Joint Memorial No. 4.

Council Joint Memorial No. 5 was read the second time and referred to the Printing Committee.

Bills on third reading were passed by consent.

Council Bill No. 95, by Mr. Craile, "An Act entitled, 'An Act . authorizing the Norman and Chickasaw Bridge Company to construct and maintain a bridge across the South (or Main Canadian River, near Norman, Oklahoma." "

Council Bill No. 97, by Mr. Decker, "An Act prohibiting the sale, giving away and disposal of cigarettes, cigarette paper and substitutes therefor."
