CHAPTER 130. [Published March 29, 1867.] AN ACT to amend chapter 240 of the private and local laws of 1866, entitled "an act to revise and amend the act entitled 'an act to incorporate the village of Manitowoc, in the county of Monitowoc,' approved March 6th, 1851, and the several acts amendatory thereof." The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SECTION 1. Section five of said act is hereby Elective officers. amended, by striking out the words "and one treasurer," and the words "one treasurer," where they occur in said section, so that when so amended it will read as follows: "Section 5. The elective officers of said village shall be one president, three trustees for each ward, who shall be actual residents in the ward for which they shall be elected, to be elected by the qualified voters of said village at the annual election. therein to be held in each ward of said village, on the first Tuesday of April, in each year, and they shall hold their respective offices for one year, and = until their successors shall be chosen and qualified; and at such election the electors in their respective wards shall vote for one president and three trustees in the ward in which they may vote: provided, that required of the first election held no notice shall beh J officers. after the passage of this act." SECTION 2. Section nine of said act is hereby Appointive amended, by striking out the words "one assessor for the whole village," where they occur in said section, so that when so amended it will read as follows: "Section 9. The board of trustees shall have power to appoint and at their pleasure to remove the following officers, to-wit: One marshal, one clerk, one chiefengineer of the fire department, one harbor master, one bridge-tender for each draw-bridge, one surveyor, not to exceed two str street commissioners in each ward, to be appointed only on the recommendation of a majority of the trustees of the ward for which such com- . missioners shall be appointed, one or more fire-wardens for each ward, one sealer of weights and measures, and one or more sextons and keepers of cemeteries or Marshal and clerk. Treasurer. Levy of taxes. burial grounds, and such other officers as the good order and government of the village may require, and by ordinance or by-laws prescribe their duties and fix their compensations under the provisions of this act, and to impose and enforce in law such penalties as to the said board of trustees may seem proper for any malfeasance or improper conduct of any of said of ficers, and to require bonds for the faithful performance of the duties of such of them as may be deemed expedient and necessary, in cases where such bonds are not specially required by this act: provided, that whenever by an ordinance of the village the members of the fire department are authorized to elect their chief-engineer, the board of trustees shall not fill that office by appointment, but they shall have power.nevertheless to remove such chief-engineer." SECTION 3. Section ten of said act is hereby amended by striking out the words "an assessor" where they occur in said section, so that when so amended it will read as follows: "Section 10. Within ten days after the board of trustees shall have determined who were elected to office at the annual elections of said village, they shall by ballot appoint a marshal and a clerk, who shall hold their respective offices for one year, unless the same shall sooner become vacant, and until their successors shall be appointed and qualified." SECTION 4. The person who shall hereafter be annually elected treasurer of the town of Manitowoc, in said county, shall and hereby is declared to be ex officio treasurer of said village, possessing all the powers and subject to all the duties and liabilities conferred or imposed by this act and the act of which this is. amendatory, or by law. SECTION 5. When the assessment roll of the said town of Manitowoc shall be completed annually, the president and trustees of said village shall cause to be levied such amount of tax as shall have been determined by them to be necessary for the purposes of said village to be raised for the year upon the property of said village, and shall set opposite to each description and valuation of taxable property within the limits of said village, the amount of tax charged upon such property and to each person, respectively. taxes, redemp-] &c. SECTION 6. All the taxes levied by the said presi- Collection of dent and trustees, shall be levied and collected in the tion of lands, same manner as taxes are levied and collected in said town for town and county purposes, and when so collected shall be paid over to the treasurer of said corporation; and the said annual tax shall be placed on the tax-roll of said town in a separate column, and the delinquent list shall be returned to the said town treasurer, and shall be by him credited to the treasurer of said village corporation, and returned to the county treasurer. If any person claiming the title to or interest in any lots or parcels of land heretofore sold for taxes, and described in the certificate of sale issued by the treasurer on such sale, shall not within three years from the date thereof pay to the county treasurer, for the use of the holder of such tax-certificate, his heirs or assigns, the sum mentioned in such certificate, together with the interest thereon, at the rate of twentyfive per centum, the clerk of the board of county supervisors shall execute to such person, his heirs or assigns, a conveyance of such lot or parcel of land, in the same manner and with like effect as is or may be provided by law for the conveyance of land sold for the non-payment of county taxes. The said village treasurer shall receive as a compensation for his services as such treasurer, one and one quarter per cent. on all moneys collected and received by him belonging to said village, and the same per centum on all such moneys as shall be paid out by him pursuant to the provisions of this act, and of the act of which this is amendatory. Redemption SECTION 7. The treasurer of said village shall pay moneys. over to the county treasurer all the redemption moneys in his hands paid on outstanding certificates of sale heretofore issued by the treasurer of said village, and the same shall be paid over to the person, party or corporation entitled to receive the same, on the order drawn upon the county treasurer by the clerk of the board of supervisors of said county, in the same manner as is or may be provided by law in other cases. SECTION 8. Before the first day of June next, the List of delinpresident and trustees of said village shall cause to be quent lande, made out and certified by their clerk, a full and accurate list of all the lots or parcels of land on which any Repealed. taxes shall remain due, with the dates and amounts of such taxes set opposite the proper description, and deliver the same to the clerk of the board of supervisors of said county, to be kept by him in his office; and the said president and trustees may compromise with the owner or person interested in any lot or parcel of land sold for taxes, and with other persons for the cancellation of any certificate of sale of such lot or parcel of land held by the said village, in like manner as the supervisors of said county are or may by law be authorized to compromise for the cancellation of certificates of sales of lands held by the county. SECTION 9. Sections twenty-eight, forty-three, fortyfour, forty-five, forty-six, forty-seven, forty-eight, fortynine, fifty, fifty-one, fifty-two, fifty-three, fifty-four, fifty-five, fifty-six, fifty-seven, fifty-eight, fifty-nine, sixty, sixty-one and sixty-two of said act, are hereby repealed. SECTION 10. This act shall take effect and be in force. from and after its passage. Approved March 21, 1867. Amended. CHAPTER 131. [Published March 22, 1867.] AN ACT to amend chapter 124 of the private and local laws of the year 1867, entitled "an act to consolidate and amend the act to incorporate the city of Fond du Lac, and the several acts amendatory thereof, and to amend an act entitled an act to consoli date the several school districts in the city of Fond du Lac,' and the several acts amendatory thereof." The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SECTION 1. Chapter 124 of the private and local laws of the year 1867, is hereby amended, as follows: by adding thereto the following words: "This act shall take effect and be in force from its passage." SECTION 2. This act shall take effect and be in force from and after its passage. Approved March 21, 1867. CHAPTER 132. [Published April 3, 1867.] AN ACT to authorize the county board of supervisors of the county of Sauk to levy and collect a tax "to build a soldiers' monument on the court-house square, in the village of Baraboo." The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SECTION 1. The county board of supervisors of May levy tax for the county of Sauk are hereby authorized to levy and ment. collect a tax, of not more than three mills on the dollar, on all the real and personal property of the county subject to taxation, for the purpose of building a "soldiers' monument" on the court-house square, in the village of Baraboo. Collection of SECTION 2. The tax aforesaid shall be levied and tax, &c. collected the same and at the same time that the next county, state and town taxes are levied and collected in the county of Sauk, and when collected by the town treasurers, shall be paid to the county treasurer without unnecessary delay, and shall be drawn out of the hands of the county treasurer upon the orders of the treasurer of the "Sauk county soldiers' monument association," as the work progresses. Accounts of SECTION 3. It shall be the duty of the county moneys. treasurer to keep a just and accurate account of all moneys received by him from the several town treasurers, and the amount paid out upon the orders aforesaid; and after all has been collected and paid by the county treasurer for the purposes above specified, he shall on demand furnish the president of the association with a certified copy of the same. SECTION 4. All acts and parts of acts inconsistent Repealed. with this act, are hereby repealed. SECTION 5. This act shall take effect immediately and be in force from and after its passage.
