Mr. Murphy (by unanimous consent) introduced Senate bill, No. 485, for "An act authorizing the board of county commissioners, elected in pursuance of article 10, section 6, of the Constitution, to perform the powers and duties heretofore devolving upon the county courts in the transaction of county business in counties not under township organization." Mr. Sheldon (by unanimous consent) offered the following resolution: WHEREAS, doubts exist as to the constitutionality of the schedule of rates for passengers and freights npon the railroads in this State, as fixed by the Railroad and Warehouse Commissioners, as required by section 8 of an act approved May 2d, 1873, unless such rates be approved or fixed by the General Assembly, as required by section 12, article 11, of the Constitution; therefore, Resolved, That the Committee on Judiciary of this Senate take the matter above set forth under consideration, and report to the Senate what action, if any, is needed by the General Assembly, as required by the section of the Constitution aforesaid, and that they report by bill, or otherwise, at as early a day as possible. On motion of Mr. Sheldon, The rules were suspended, and the resolution was taken up for consideration. On motion of Mr. Crews, The previous question was ordered.
