The first witness is Mr. Tyre Taylor, general counsel of the Southern States Industrial Council. STATEMENT OF TYRE TAYLOR, WASHINGTON, D. C., GENERAL COUNSEL, SOUTHERN STATES INDUSTRIAL COUNCIL Mr. TAYLOR. Mr. Chairman and gentlemen of the committee, my name is Tyre Taylor. My address is 712 Jackson Place, Washington, D. C. I appear here on behalf of the Southern States Industrial Council, which has its headquarters in the Stahlman Building, in Nashville, Tenn. The council is an employers' organization and was established in 1933. I wish to introduce to your committee, if I may have permission to do so, two of my assistants, Gen. J. H. Ballew, the Nashville counsel for this organization, and my assistant in Washington, Mr. Henry J. Bison, Jr. If I should be stumped on a question, I should like permission to bring up these able reinforcements. Senator BALL. Very well. Mr. TAYLOR. The membership of the council is comprised of some 3,000 industrial and business concerns in 16 Southern States. I should like to commence this statement by referring to four aspects of this bill which, in our opinion, represent a decided improvement over the present law. 1. Section 1 makes a finding that the Fair Labor Standards Act has been applied in such a way as to distort the intent of Congress and give rise to wholly unexpected liabilities. This finding is thoroughly in accordance with the facts and points up the urgent need for reform in the operation of the law. The constant fluctuation and perversion of the meaning of the act is by now common knowledge. The events necessitating the enactment of the portal-to-portal law in order to rescue our economic system from certain bankruptcy because of a court decision are without |
