Special Gifts, and Grants.

A Deed of Gift of a Capital Meffuage and Lands, with a Covenant to levy a Fine thereof.

HİS Indenture made, &c. Between L. M.of,&c. Efquire, of the one Part; and B, M. Son and Heir of the faid L. M. of the other Part, Witneffeth, That the faid L. M. for and in Confideration of the natural Love and Affection which he the faid L. M. hath and beareth unto the faid B. M. and for divers other good Caufes and Confiderations him thereunto efpecially moving, Hath given, granted, alienated, enfeoffed and confirmed, and by thefe Prefents doth give, Grant, &c. unto the faid B., M. his Heirs and Affigns, All that Capital Meffuage or Dwelling-houfe, with a Barn, Stable, Garden, Orchard, and feveral Clofes of Meadow and Pafture thereunto ad joining and belonging, commonly called by the Names of, &c. All which faid Premiffes are fituate, lying and being in, &c. and wete formerly in the Tenure or Occupation of, &c. or his Affigns, and now in the Tenure or Occupation of the faid L. M. his Affigns or Under-Tenants: And alfo all Out-houses, EdifiA

ces, Buildings, Barns, Stables, Court-yards, Gardens, Orchards, Lands, Tenements, Meadows, Paftures, Feedings, Trees, Woods, Under-woods, Commons, Common of Pasture, Ways, Paths, Paffages, Waters, Water-courfes, Eafements, Profits, Commodities, Privileges, Advantages, Hereditaments and Appurtenances whatsoever to the faid Capital Meffuage, Clofes, Lands, Tenements, Hereditaments and Premiffes above-mentioned, or to any Part or Parcel thereof belonging, or in any wife appertaining, or therewith commonly used, occupied or enjoyed, or accepted, reputed, taken or known, as Part or Parcel thereof; And all other the Lands, Tenements and Hereditaments of him the faid L. M. fituate, lying and being in the Parish of, &c. or elsewhere in the faid County of, &c. whereof or wherein he is feized of any Eftate of Inheritance; And the Reverfion and Reverfions, Remainder and Remainders, Rents and Services, of all and fingular the faid Premiffes; And all the Eftate, Right, Title, Intereft, Benefit, Claim and Demand whatfoever of him the faid L. M. of, in and to the fame Premiffes, and of, in and to every Part or Parcel thereof, with their and every of their Appurtenances; And alfo all Deeds, Evidences and Writings, touching and concerning the faid Premiffes only, or only any Part thereof, which he the faid L. M. now hatlı in his Cuftody, or which he can or may come by without Suit in Law; together with true Copies of all other Deeds, Evidences and Writings, concerning the faid Premiffes only, or any Part thereof, amongst other Lands, the fame Copies to be made and written at the Cofts and Charges of the faid B. M. his Heirs

or Affighs, To have and to hold the faid Capital Meffuage, Lands, Tenements, Hereditaments and Premiffes above-mentioned to be granted and conveyed, with their and every of their Appurtenances, unto the faid B. M. his Heirs and Affigns, To the only proper Ufe and Behoof of him the faid B. M. his Heirs and Affigns for ever. And the faid L. M. for himfelf, his Heirs, Executors and Adminiftrators, doth covenant, promife and grant to and with the faid B. M. his Heirs and Affigns, That he the faid B. M. his Heirs and Affigns, shall and may from henceforth for ever hereafter peaceably and quietly have, hold, ufe, occupy, poffefs and enjoy the faid Capital Meffuage, Lands, Tenements, Hereditaments, and all and fingular other the Premiffes hereby granted, or mentioned or intended to be hereby granted, with their and every of their Appurtenances, without the Let, Trouble, Hindrance, Moleftation, Interruption and Denial of him the faid L. M. his Heirs, Executors or Adminiftraand of all and every other Perfon or Perfons whatsoever: And that freed and discharged, or otherwife well and fufficiently faved and kept harmless and indemnified, of and from all former and other Gifts, Grants, Bargains, Sales; Feoffments, Leafes, Dowers, Jointures, Ufes, Wills, Entails, Fines, Poft-Fines, Iffues, Amerciaments, Seizures, Bonds, Annuities, Writings Obligatory, Statutes Merchant and of the Staple, Recognizances, Extents, Judgments, Executions, Rents, and Arrearages of Rents, and of and from all other Charges, Eftates, Rights, Titles, Troubles and Incumbrances whatfoever had, made, committed, done or fuffered, or to be had, &c. by the faid L. M. his Heirs, Executors

Executors or Administrators, or any other Perfon or Perfons what foever claiming, or to claim, by, from or under him, them, or any or either of them. And the said L. M. for himself, his Heirs, Executors and Administrators, doth alfo covenant and grant to and with the faid B. M. his Heirs and Affigns, That he the said B. M. fhall and will before the End of Hillary Term next enfuing the Date hereof, upon the reasonable Requeft, and at the proper Cofts and Charges in the Law of the faid B. M. his Heirs or Affigns, in due Form of Law acknowledge and levy in the Court of Common Pleas at Westminster, before His Majesty's Juftices of the faid Court, one Fine Sur Conuzance de Droit come ceo, &c. to be purfued with Proclamations, according to the Form of the Statute in that Cafe made and provided, unto the said B. M. and his Heirs, or to fuch other Perfon or Perfons, as he the faid B. M. fhall nominate and appoint to be Conufee or Conufees of the faid Fine, either of the faid Capital Meffuage and Premiffes hereby granted alone, by it felf, or together, with any other Lands, Tenements or Hereditaments, by fuch Name and Names, Quantities and Number of Meffuages, Acres and Things, and other Certainties and Descriptions as shall be advised and thought fit. And it is hereby concluded and agreed upon by and between the faid Parties to these Prefents, That the faid Fine in manner as aforefaid, or in any other manner to be levied; and alfo all other Fines and Affurances which fhall be had or levied of the faid Premiffes abovementioned, either alone by it felf, or together, with any other Lands, Tenements or Hereditaments as aforefaid, fhall be and enure, and shall
