upon such prescription unless it shall specify the time when and place where it is given, the kind and quantity of liquor prescribed, the name and residence, permanent or temporary, of the person for whom it is prescribed, and that such liquor is needed by such person for medicinal or mechanical uses, and shall be signed with the name written in full by the physician issuing such prescription, who shall be known to such druggist as a reputable practicing physician residing in this State and who has no pecuniary interest in the sale for which such prescription provides. Such prescription shall not be filled except within three days next after its date. The person making a sale upon any such prescription shall write across the face the number of such prescription and the date of the sale or delivery thereof, and shall retain and keep such prescription on file in his possession, and shall enter in a book to be kept for that purpose the date of the sale, the name of the person to whom such liquor is delivered, and the amount and kind thereof; and such prescription and book shall be open at all reasonable times to the inspection of the Selectmen of the town and of the prosecuting agents of the county in which such sale was made; and the entry in said book shall be sufficient evidence of such sale. No physician shall knowingly issue a prescription for spirituous or intoxicating liquors, falsely stating any fact required to be stated as above, and no person shall procure a prescription for spirituous or intoxicating liquor under the provisions of this section intending that the same shall be used as a beverage. Every physician or person who shall violate the provisions of this act shall be subject to the penalties of Section 2712 of the General Statutes.

CHAPTER 181.

(Substitute for House Bill No. 74.)

An Act amending an Act concerning Penalties for Violation of Liquor Laws.

Be it enacted by the Senate and House of Representatives in General Assembly convened—

Section 2712 of the general statutes is hereby amended by adding at the end thereof the words "but when such subsequent conviction shall be for the violation of any such provision for a violation of which such person shall have been previously convicted, such person shall be fined not less than twenty-five nor more than two hundred dollars, or imprisoned not less than ten days nor more than six months, or both," so that said section as amended shall read as follows: Every person convicted of a first violation of any of the provisions of the laws relating to the sale of spirituous and intoxicating liquors shall be fined not less than ten nor more than two hundred dollars; on every subsequent conviction such person shall be uned as aforesaid, or imprisoned not less than ten days nor more than six months, or both; but when such subsequent conviction shall be for the violation of any such provision for a violation of which such person shall have been previously convicted, such person shall be fined not less than twenty-five nor more than two hundred dollars, or imprisoned not less than ten days nor more than six months, or both. An Act amending an Act concerning the Definition of Spirituous and Intoxicating Liquors.

SECTION I. Section 2636 of the general statutes is hereby amended by adding to the end thereof the following: "and all wines made in this state from grapes grown in this state, and sold by the grower and maker thereof to be drunk upon the premises, or sold in quantities less than five gallons to be delivered at one time," so that said section as amended shall read as follows: The term spirituous and intoxicating liquors, as used in this title shall be held to include all spirituous and intoxicating liquors, all mixed liquors, all mixed liquor of which a part is spirituous and intoxicating, all distilled spirits, all wines, ale, and porter, all beer manufactured from hops and malt, or from hops and barley, and all beer on the receptacle containing which the laws of the United States require a revenue stamp to be affixed, and all fermented cider sold to be drunk' upon the premises, or sold in quantities less than one gallon to be delivered at one time in towns where licenses to sell intoxicating liquors are

granted, or in quantities less than five gallons to be delivered at one time in towns where licenses are not granted, and all wines made in this state from grapes grown in this state, and sold by the grower and maker thereof to be drunk upon the premises, or sold in quantities less than five gallons to be delivered at one time.

SEC. 2. The burden of proof that any wines were made in this state from grapes grown in this state shall be upon the person selling said wines. Approved, July 30, 1907.

CHAPTER 265.

(Substitute for House Bill No. 175.)

An Act Concerning the Sale of Intoxicating Liquors.

Be it enacted by the Senate and House of Representatives in General Assembly convened

SECTION I. The county commissioners in their respective counties shall be hereafter prohibited from issuing retail licenses for the sale of spirituous and intoxicating liquors to any person, unless his application therefor has been indorsed and signed by five electors and taxpayers, owning real estate, of the town, who shall certify that the applicant is suitable person to be licensed and that they have not signed for any other applicant for a license to sell spirituous and intoxicating liquors; provided, however, that nothing herein shall prevent a corporation organized under the laws of this state from holding in its corporate name one license to sell spirituous and intoxicating liquors at its place of business in any one town. No more than five licenses shall be issued to any one person, and the county commissioners may in their discretion refuse to issue more than one license to any one person.

SEC. 2. No person who is by statute declared to be an unsuitable person to hold a license to sell spirituous and intoxicating liquors in his own name shall be employed as a bartender or manager in any licensed saloon in this state, nor shall he be allowed to have a financial interest in any such licensed saloon. Any licensed dealer who shall violate any of the provisions of this act shall be subject to the penalties of section 2712 of the general statutes.

SEC. 3. The holder of a license to sell spirituous and intoxicating liquors, except druggists, shall be the bona fide owner of the business carried on under the license and before issuing the license the county commissioners shall require each applicant to make oath that he is the bona fide owner of the business and that no person unsuitable to hold a license to sell spirituous and intoxicating liquors is in any way interested in the business.
