Much has been said during the course of the hearings on S. 2800, February 27 to March 3, 1934, regarding the effects of the proposed law on manufacturers and producers, but little has been said regarding its effect on the dealer, and especially the small dealer.

The National Hairdressers and Cosmetologists Association is an organization founded in 1921, composed of nearly 9,000 members, with 18,000 additional code affiliates, and is devoted to the interests and protection of the so-called "beauty-shop" business. There are estimated to be 56,000 "beauty shops" in the United States.

Α beauty shop" is mainly a service institution; but inasmuch as it uses cosmetics professionally and sells them, it is a dealer. In years gone by it made the cosmetics which were used in its own establishment or sold to the patrons. This practice has gradually decreased, but it still persists in many shops, such as the larger ones in the bigger cities, therefore, such shop proprietors must be classed as "manufacturers " as well as "dealers" in interpreting S. 2800. It is difficult to establish a line of demarcation between the two since many shops make a tonic, cream, lotion, or solution for use and/or sale in their own trade.

The National Hairdressers and Cosmetologists' Association is an affiliate member of the industry relations committee, which body is an advisory council for four national associations, the products of the members of which find their main outlet through the beauty shop. This council comprises the manufacturers, the jobbers, the schools where beauty culture is taught, and finally, the beauty shop itself. Thus the National Hairdressers and Cosmetolobists' Association is interested in the possible effects of S. 2800 upon, firstly, the beauty shop itself and, secondly, upon the industry.

UNEXPECTED INTERPRETATIONS OFFER OPPORTUNITY FOR GRAFT

A permanent-wave apparatus certainly should not be expected to be classed as an adulterated drug. Yet that is exactly what is made possible in S. 2800. On page 2, line 11, in section 2 (b), we find one definition of " drug as all substances and preparations, other than food, and all devices intended to affect the structure or any function of the body." The permanent wave is created in the hair by the alteration of the hair structure by means of the device known as the permanent-wave machine or apparatus. Page 5, line 12, of section 4 provides that a "drug" shall be deemed to be adulterated if it is dangerous
