for further fecuring the punctual and regular payment of such intereft as aforesaid, it hath been agreed by and between the faid A. A. and C. C. that the the faid A. A. fhould pay, and accordingly fhe hath this day actually paid into the hands of the faid E. E. and F. C. the fum of pounds, of lawful money of Great Britain, upon the trufts and to and for the intents and purposes herein after mentioned concerning the fame, the receipt and payment whereof they do hereby acknowledge. Now therefore this indenture further witnesseth, and it is hereby declared by and between the faid parties hereto, that the faid fum of pounds fo paid to the faid E. E. and F. C. as aforefaid was fo paid to them, upon the trufts and to and for the ends and purposes following; that is to fay, upon truft that they the faid E. E. and F. C. and the furvivor of them, and the executors, adminiftrators and affigns of fuch furvivor, fhall and do from time to time, by and out of the yearly intereft, profits and produce of the faid

pounds, as the fame fhall from time to time arife and come to their respective hands, pay, fatisfy and make up unto the faid C. C. his executors, adminiftrators and affigns, the full intereft of the faid pounds, after the rate aforefaid, at fuch time and in fuch manner as are herein before mentioned for payment thereof, in fupply of the deficiency of the rents and profits of the faid moiety of the faid manor and premifes to be applied for that purpose as aforefaid, when and fo often as any fuch deficiency fhall happen, and shall and do render and pay over to the said A. A. her executors, adminiftrators and affigns, the overplus (if any) of the yearly intereft, profits and produce of the faid pounds above what thall from time to time be paid and applied for making up fuch deficiency as aforefaid. But in cafe fuch yearly intereft and produce fhall fall fhort, and not be fufficient to make up fuch deficiency, then upon this further truft, that they the faid E. E. and F. C. and the furvivors of them, his executors, adminiftrators and affigns do and fhall from time to time make good and pay the fame, by and out of the faid principal fum of pounds, or by fale or mortgage of the fecurity or fecurities, ftock or annuities, whereof or wherein the fame fhall from time to time confift or be invefted, or otherwife, as the fame trustees in their difcretion fhall think fit. Provided always nevertheless, and it is hereby declared and agreed by and between the faid parties to these prefents, that from and after payment of the faid pounds, and all intereft to grow due for the fame unto the faid C. C. his executors, adminiftrators or affigns, together with the charges and expences attending the execution of the last mentioned trufts, and immediately thereupon, or fo foon after as conveniently may be, they the faid E. E. and F. C. or the furvivor of them, his executors, adminiftrators or affigns, fhall and will, at the request, cofts and charges of the faid A. 4. her executors or adminiftrators, pay back, affign and make over the faid fum of pounds; and all fecurity

or fecurities, ftock or annuities, whereof or wherein the fame fhall then confift or be invefted, or fo much thereof as fhall then remain

undifpofed of for the purposes aforefaid, and all intereft and produce then due for or upon the fame, or any part thereof, unto the faid 4. A. her executors and administrators, to and for her or their own use and benefit, any thing herein contained to the contrary notwithstanding. And it is hereby declared and agreed by and between the faid parties to thefe prefents, that it fhall and may be lawful to and for the said E. E. and F. C. and the survivor of them, his executors and adminiftrators, from time to time, to lend and place out the faid fum of pounds, fo paid to them as aforefaid, or any part thereof, with the confent and approbation of the faid A. A. and C. C. or their refpective executors or adminiftrators, upon any public or private fecurity or fecurities, at intereft, or lay out and inveft the fanie, or any part thereof, in the purchase of stock or annuities in any of the public funds or companies, and from time to time to call in fuch monies fo lent and placed out on fecurities as aforefaid, or fell and dispose of fuch ftock or annuities fo to be purchased as aforefaid, or any part thereof, and again to lend and place out on fecurities aforefaid, or fell and difpofe of fuch stock or annuities, fo to be purchased as aforefaid, or any part thereof, and again to lend, place out, or inveft the fame, or any part thereof, in manner aforefaid, as often as they shall think fit, with fuch approbation as aforefaid, upon the trufts and fubject to the provifo herein before mentioned and contained of and concerning the fame. And it is hereby further declared and agreed by and between the faid parties to these prefents, that the faid E. E. and F. C. their executors, adminiftrators and affigns, or any of them, fhall not be charged or chargeable with or accountable for any more monies. than they refpectively fhall actually receive, or fhall come to their respective hands by virtue of the trufts hereby in them reposed as aforefaid, nor with or for any lofs which fhall happen of the fame truftmonies, or any part thereof, fo as the fame happen without their wilful default, nor the one of them for the other of them, or for the acts, deeds, receipts and disbursements. And alfo, that it fhall and may be lawful to and for the faid E. E. and F. C. their executors, adminiftrators and affigns, and every of them, in the first place, by and out of their faid truft-premifes, to deduct and reimburfe him and themselves all fuch lofs, cofts, charges, damages and expences as they or any of them fhall be put unto or sustain, for or by reason of the trufts hereby in them repofed, or the management or execution thereof, or any other thing in any wife relating thereunto.

HIS INDENTURE tripartite, made the

day of —

in the year of our Lord 17-, and in the fourth year of the reign of our Sovereign Lord George the Third, by the grace of God, King of Great Britain, &c. between E. E. of A. in the county of B, Gent. and C. E. his wife, daughter and heir of D. D. late citizen and ironmonger of London, by C. D. his wife, [both deceased] which faid C. D. was one of the three daughters and coheirs of E. D. late of, &c. Gent. deceased, of the first part, F. E. of G, in the faid county of B-, fpinfter, of the fecond part, and H. H. of H. in the faid county of B-, draper, and I. I. of H. aforefaid, carpenter, of the third part, witneffeth, That for and in confideration of the fum of pounds, of lawful money of Great Britain, to the faid E. E. and C. his wife, or one of them, in hand well and truly advanced, lent and paid by the said F. E. at or before the enfealing and delivery of these prefents, the receipt and payment whereof they the faid E. E. and C. his wife, do hereby acknowledge, and thereof, and of every part thereof do acquit, releafe and difcharge the faid F. E. her executors, adminiftrators and affigns, and every of them for ever, by these presents; and for the fecuring the repayment of the faid

pounds, with intereft, in manner herein after mentioned, and for fettling and affuring the meffuages, lands, tenements, third parts and hereditaments, as well freehold as copyhold, herein after mentioned, to fuch ufes, upon fuch trufts, and to and for fuch intents and purposes, and fubject to fuch provifo and agreements herein after expreffed and declared of and concerning the fame, he the faid E. E. doth hereby for himself and the faid C. his wife, his and her heirs, executors and adminiftrators, covenant, promise, grant and agree, to and with the faid H. H. and I. I. their heirs and affigns, that they the faid E. E. and C. his wife, fhall and will at their own proper cofts and charges, as of this prefent Trinity term, acknowledge and levy before his majesty's justices of the court of common pleas at Westminster, one or more fine or fines fur conuzance de droit, come ceo, &c. whereupon proclamations fhall be had and made, according to the form of the ftatute in that cafe made and provided, and the usual course of fines in fuch cafes used, unto the faid H. H. and I. I. and their heirs, or the heirs of one of them, OF all thofe fields or clofes,

clofes, pieces and parcels of land and hereditaments, fituate lying and being in the parish of G. aforefaid, in the faid county of B. and next hereafter particularly mentioned; that is to say, &c. And also of all other the meffuages, lands, tenements and hereditaments whatsoever, being freehold and not copyhold, of them the faid A. A. and C. his wife, or either of them, or whereof or wherein they or either of them, or any perfon or perfons in truft for them, or either of them, have or hath any eftate of inheritance in poffeffion, reverfion, remainder or expectancy, fituate lying and being in the parish of G. aforesaid, in the faid county of B. with their and every of their appurtenances, and of the reverfion and reverfions, remainder and remainders, yearly and other rents, iffues and profits thereof, and of every part and parcel thereof, by such apt and convenient names, quantities, qualities, number of acres, and other defcriptions to ascertain the fame as shall be thought meet; which faid fine or fines fo as aforefaid, or in any other manner, or at any other time or times levied or to be levied and acknowledged, and all and every other fine and fines, conveyances and affurances in the law whatsoever heretofore had, made, levied, fuffered or executed, or hereafter to be had, made, levied, fuffered or executed of the meffuages, lands, tenements, third part, hereditaments and premifes, or any of them, or any part thereof, by or between the faid parties to these presents, or any of them, or whereunto they or any of them are or fhall be parties or privies, fhall be and enure, and fhall be adjudged, deemed, conftrued and taken, and fo are and were meant and intended to be and enure, and are hereby declared by all the faid parties to these prefents to be and enure, to the ufe.and behoof of the faid F. E. her executors, adminiftrators and affigns, for and during the full time and term, and unto the full end and term of years from henceforth next enfuing, and fully to be complete and ended, without impeachment of or for any manner of wafte, fubject nevertheless to the provifo or agreement herein after mentioned for making void the fame term. And from and after the end, expiration or other fooner determination of the faid term, and in the mean time subject thereto; then as to for and concerning all those the faid first mentioned fields or closes, parcels of land and hereditaments in the parish of G. aforefaid, called K. and L. with the cottage and barn ftanding therein, and the four acres called the meadow, with the fpring of wood thereto adjoining, with their and every of their appurtenances, to the ufe and behoof of the faid E. E. for and during the term of his natural life, without impeachment of or for any manner of wafte. And as to for and concerning the faid third part, and all other the hereditaments and premifes whereof a fine or fines åre covenanted to be levied as aforefaid, and whereof no ufe is herein before declared to take effect after the determination of the said term of -years, from and immediately after the end, expiration or other fooner determination of the fame term, and in the mean time subject thereto, to the use and behoof of the faid H. H. and I. I. their heirs and affigns, during the life of the faid C. E. upon fuch trufts neverthe

lefs, and to and for fuch intents and purposes as are herein after mentioned, expreffed and declared of and concerning the fame. And from and after the decease of the said C. A. then to the use and behoof of the faid A. A. for and during the term of his natural life, without impeachment of or for any manner of wafte; and from and after his difceafe, then as to, for and concerning all the faid meffuages, lands, tenements, third part, hereditaments and premiffes, whereof a fine or fines are herein before covenanted to be levied as aforefaid, to the use and behoof of such person or perfons, and for fuch eftate and eftates, and in fuch parts, fhares and proportions, manner and form, with or without power of revocation, as the the faid C. A. notwithstanding her coverture, and whether the fhall be fole or married, by any deed or deeds writing or writings under her hand and feal, executed in the presence of two or more credible witneffes, or by her laft will and teftament in writing, or any writing purporting her laft will and teftament, to be by her figned, fealed and published in the prefence of three or more credible witneffes, fhall from time to time direct, limit, give or difpofe of the fame. And for want of, and until fuch direction, limitation, gift or difpofition, or in cafe any fuch fhall be, when and fo foon as the eftate and interefts thereby limited fhall refpectively end and determine; and as to fuch part and parts thereof, whereof no fuch direction, limitation, gift, or difpofition shall be made, to the use and behoof of the faid C. A. and of her heirs and affigns for ever, and to and for no other use, intent or purpose whatsover. Provided always nevertheless, and it is hereby declared and agreed by and between all the faid parties to these presents, that if the faid A. A. and C. his wife, or either of the, their or either of their heirs, executors or adminiftrators, shall and do well and truly pay, or cause to be paid unto the faid F. E. her executors, administrators or affigns, at or in the common dining hall of Lincoln's Inn in the county of the full and juft fum of pounds of lawful money of Great Britain, on the next ensuing the date hereof, and which will be in the year of our Lord 17 together with intereft for the fame pounds. In the mean time, and until payment thereof, after the rate of fhillings, per cent. per annum, by two equal half yearly payments, viz. at Chriftmas and Midfummer, without any deduction, defalcation or abatement of the fame pounds and intereft, or any part of them, or either of them, for or in refpect of any taxes, charges, affeffments, payment, or other matter, caufe or thing whatsoever, taxed charged or impofed upon the premiffes, or any of them, or upon the faid F. E. her executors, adminiftrators or affigns, in refpect thereof by authority of parliament, or otherwise howfoever, then and at all times from thenceforth the said term of years herein before limited to the said F. E. her executors adminiftrators or affigns as aforesaid, fhall cease, determine, and be utterly void to all intents and purposes,
