LAND. -ferved, the obfervance and performance of the covenant hereinbefore entered into by the faid C. N. and the conditions hereinbefore contained, fhall or may lawfully, peaceably, and quietly have, hold, ufe, occupy, poffefs, and enjoy all and fingular the faid hereby demifed premises, and every part thereof, with the appurtenances, henceforth for and during the said term or time of 99 years hereby granted therein, determinable as aforefaid, without any let, fuit, trouble, moleftation, eviction, ejection, expulfion, interruption, or denial of, from, or by them the said B. M. and P. his wife, K. T. and I. H. any or either of them, their, any, or either of their heirs or affigns, or of, from, or by any perfon or perfons rightfully claiming, or to claim by, from, or under them, any or Declaration either of them, or the faid A. F. deceased; AND laftly, it is agreed by and between all the faid parties to thefe prefents, that a fine which is about to be levied by the faid B. M. and the faid P. his wife, to the faid K. T. of the faid hereby demifed premises, among others, in or as of term now last past, or term now next enfuing, or fome fubfequent term, fhall, as to the faid premises with the appurtenances, and the famerights, eafements, liberties, privileges, interefts, and authorities, hereby granted to be enjoyed therewith, be and enure immediately after the fame fhall be levied; and that he the faid K. T. and his heirs, fhall accordingly ftand feifed of the faid hereby demifed premifes, to the ufe of the faid C. N. his executors, adminiftrators, and affigns, for the term of 99 years, to be computed from the delivery of thefe prefents, and determine as aforefaid, for the corroborating and confirming the term, estate, and intereft, hereby granted to the faid C. Leafe of Coal Mines.

MINES.

THIS INDENTURE, made, &c. between G. A. carl of, of the one part, and W. O. of, &c. coal-miner, of the other part, WITNESSETH, that the faid G. A. for and in confideration of the rent, duties, payments, covenants, and agreements, Demise. hereinafter referved and contained on the part of the faid W. G. his executors, administrators, and affigns, to be paid, done, obferved, and performed, hath demised, leafed, and to farm letten, and by these presents doth demife, leafe, grant, and to farm let and fet unto the faid W. O. his executors, adminiftrators, and affigns, all and every the mines, veins, pits, groves, beds, and holes of coal of all kinds, nature, and quality, which now are, can, fhall, or may be opened, found out, or difcovered by any ways or means whatsoever, in, upon, or underneath all that, &c. AND ALSO full and free liberty, licenfe, and authority, to and for the faid W.O. his executors, adminiftrators, and affigns, to open, dig, fearch for, work, win, gain, raife, and get up all forts of coal in and from the faid lands, or any part or parcel thereof, and to dig, fink, drive, run, and make any pits, fhafts, levels, foughs, trenches, and water-courses, in and about the faid mines or works; and alfo to erect, build, and fet up, in and upon the faid lands, or any part thereof, any bingfteads, ftorehouses, fmithies, forges, mills, engines, hovels, and other buildings or machines, for the better and more effectual working of the faid mines, and getting up in and upon. wafte aforefaid, fuch buildings as fhall be neceffary for the accomoda tion of the colliers who fhall from time to time be employed in and about the faid mines, and for that purpose to raife, take, convert, and use stone

MINES. and clay in and upon the faid wafte, (except from the rock of aforefaid;) AND likewise full and free ingrefs, egrefs, and regrefs, to and for the faid W.0. his executors, adminiftrators, and affigns, his and their agents, workmen, labourers, fervants, customers, and dealers, in and upon the said farms, yard, and wafte, with horfes, carts, and other carriages, to and for the getting, taking, and carrying away the faid coal, making fuch reafonable fatisfaction as hereinafter mentioned to the tenants or occupiers for the 'time being, of the faid farms and yard, for fuch trefpafs or other damage as fhall be committed or occafioned thereon, in confequence of the liberties and premises hereby granted, To HAVE, HOLD, ufe, exercise, and enjoy the faid mines, veins, pits, groves, beds, and holes of coal, privileges, liberties, and powers, and all and fingular other the premises hereby refpectively granted and demifed, or intended fo to be, with their and every of their appurtenances, unto the faid W. O. his executors, adminiftrators, and affigns, from the day next before the day of the date hereof, for, and during, and unto the full end and term of 21 years then next following, and fully to be complete and ended; AND TO HAVE AND TO HOLD all and every the coal that fhall be found, gotten, and raised, within the term aforefaid, in all or any part of the faid lands, unto the faid W.0. his executors, adminiftrators, and affigns, to his and their own proper use and uses, as his and their Refervation of own proper goods and chattels, for ever. YIELDING AND PAYING unto the faid earl of his heirs and affigns, for every ton or stack of coals that fhall be found, gotten, and raised, as aforefaid, the rent, royalty, or fum of 8d. of lawful money of Great Britain, the faid ton or stack to be calculated and ascertained by measure on the bank, and to

contain one fquare yard in length and breadth, and one yard and three quarters in height; and the faid rent, royalty, or fum, to be paid quarterly at or upon the four usual days of payment in the year, (that is to say,) the feaft of the nativity of St John the Baptift, St. Michael the Archangel, the birth of our Lord Chrift, and the annunciation of the bleffed Virgin Mary, during the faid term hereby granted; the first payment to be made on Midfummer-day: AND the faid W. W. O. his executors, administrators, and affigns,
fhall and will from time to time, and at all times
hereafter during the said term hereby granted, work
and make trials for coal, in, through, and under-
neath the faid lands, according to the best and most
improved methods of carrying on collieries, and
the ufual courfe of proceeding in and continuing
fuch works with effect, and according to the true
intent and meaning of these prefents; AND get
and raise all the coal of every kind which fhall be
found in the faid mines or pits fully and clearly.

therein: AND not neglect or omit the effectual
working of the faid mines for the space of
weeks in any one year, except only fo far as he or
they fhall be hindered by fome inevitable acci-
