CONCURRENT RESOLUTION.

Resolved by the Senate, the Assembly concurring, That our Senators and Representative in Congress be, and they are hereby, requested to urge upon the Congress of the United States the necessity of an appropriation for clearing out and rendering navigable the Choctawhatchee river from its mouth to Geneva, Alabama.

Be it further resolved, That the Secretary of State be, and he is hereby, directed to forward a copy of this resolution to each of our Senators and Representative in Congress at an early day. Approved February 2, 1872.

CONCURRENT RESOLUTION in Relation to the Island of Cuba.

WHEREAS, The people of the Island of Cuba are struggling for a national existence against a foreign and alien power, and are attempting to establish for themselves a free government, and to secure the blessings of free institutions for themselves and their posterity; AND WHEREAS, The war waged by Spanish despotism against their feeble and struggling power has no parallel for its atrocity and inhumanity in the annals of modern warfare, and should in no manner be countenanced by civilized nations; Therefore,

Be it resolved by the people of the State of Florida, represented in Senate and Assembly, That the Congress of the United States is hereby requested to adopt such legislation as may be necessary to enable the national government to extend such aid to the people of Cuba as becomes a great and free republic, whose people so ardently sympathize with the struggles and hopes of the oppressed of all nations; And,

Be it further resolved, That our Senators and Representative in Congress are hereby requested to present these resolutions to their respective bodies as expressive of the sense of the people of Florida.

AN ACT entitled An act to Alter and Amend An act Relating to the Finances of the State.

The people of the State of Florida, represented in Senate and Assembly, do enact as follows: SECTION 1. That section ten (10) of Section 10an act entitled "An Act Relating to the Finances of this State," amended. which became a law January 26, 1871, be and the same is hereby amended so as to read as follows: Section 10. D. 1872, for services rendered subsequent to that date, and those issued in exchange for juror's and witnesses' certificates, and for school purposes, shall be receivable for all taxes due after the first day of January, A. SEC. 4. It shall be the duty of the Comptroller of the State to specify in writing across the face of each warrant hereafter issued, that the same is or is not receivable for taxes to become due after January 1, A. D. 1872.

CHAPTER 1932.-[No. 2.]

AN ACT entitled An act to Compel Railroad Companies to Pay for Property
Destroyed, Killed or Injured by their Trains, and to Provide for the Service
of Summons and other Process in Suits to Recover the Value of Property so
Destroyed, Killed or Injured.

The people of the State of Florida, represented in Senate and Assembly, do enact as follows: SECTION 1. That from and after the passage of this act, all railroad companies doing business in this State shall pay for all property destroyed, killed, or injured by their trains.

SEC. 2. That in suits to recover damages for the destruction, summons, &c. death or injury of any property as aforesaid, summons or other legal process on any depot-agent of such railroad company in the county where the damage may be done, shall be held sufficient service on the company.

SEC. 3. That all laws or parts of laws conflicting with the foregoing be, and the same are hereby, repealed.

CHAPTER 1933.—[No. 3.]

A BILL to be entitled An act to Protect the State Against an Overissue of Jurors' and Witnesses' Certificates, and to make the same Receivable for Taxes.

The people of the State of Florida, represented in Senate and Assembly, do enact as follows: SECTION 1. The clerk of the Circuit Court of the several counties of this State shall immediately at the close of every term of the Circuit Court make out a pay-roll, which shall contain the name of every juror and witness who shall have attended every such session of court; which payroll shall state the number of days which each witness and juror has attended court, and the number of miles travelled and the amount of moneys which witness and juror is entitled to for his services during such term of court. The witness and juror shall

sign the same in presence of a witness, and the circuit judge of the circuit shall approve the same, if found correct, in triplicate. SEC. 2. The clerk of the Circuit Court shall forward one of such pay-rolls to the Comptroller, which shall be in lieu of the report of jurors and witnesses now required to be made, and shall also deliver the same to the Collector of Revenue of his county, and the third shall remain on file in his office.

SEC. 3. The clerk of the Circuit Court shall issue to each witness and juror a certificate for the amount due such witness or Certificatesjuror for his services, and such certificates shall be received by receivable for the Collector of Revenue in payment of State taxes, excepting the tax levied to pay the interest upon the public debt, sinkingfund tax, and school taxes.

SEC. 4. Be it further enacted, that the Comptroller shall cause to be prepared suitable blank forms, upon which the clerks of the respective counties shall make the pay-rolls required by section 1 of this act, and furnish the clerks with the same. Approved May 8, 1872.

CHAPTER 1934.-[No. 4.]

AN ACT entitled An act to Appropriate Certain Moneys Therein Named.

The people of the State of Florida, represented in Senate and Assembly, do enact as follows: For the purpose of paying the Appropriamileage and salary of the members and attaches of the Legisla- tions. ture in extraordinary session convened, six thousand dollars. For stationery for the use of the Legislature, two hundred dollars.

The Comptroller is directed to audit and allow, and the Treasurer to pay the accounts for printing during the present extraordinary session, including any extra printing which may be ordered by either House: Provided, That the rate of compensation allowed shall not exceed that paid in 1872.

For Harry Hawkins, for services during last regular session as janitor, one hundred and forty-seven dollars ($147).

For Henry Mathews, janitor of the Senate during regular session of 1872, one hundred and forty-seven dollars ($147).

For pay of jurors and witnesses, fifteen thousand dollars ($15,000).

For Lewis Plater, carpenter, work last session, forty-eight dollars and fifty cents ($48.50).

For W. P. Frink, expenses incurred in contesting the seat of J. W. Underwood for the year 1869, two hundred and fifty dollars ($250)..

For Lewis Plater, repairs on desks, furnishing locks and keys, nine dollars and fifty cents ($9.50).

Warrants.

For A. C. Clark, twenty dollars, and H. C. Cruse five dollars, for mileage due them at the last session of the Legislature.

SEC. 2. The Secretary of the Senate and the chief clerk of the Assembly shall, on the last day of the present extraordinary Pay-roll of session of the Legislature, prepare a pay-roll of the members and members, &c. attaches of each House respectively, which shall be examined by the Committee on Appropriations of the respective Houses; and if found correct shall be approved by the chairman of the respective committees and by the presiding officers of each House respectively; and the Comptroller shall issue his warrants for the amounts stated on the said roll: Provided, That the Secretary of the Senate and chief clerk of the Assembly shall only enter upon such roll the names of the members and attaches in actual Compensation attendance upon the extraordinary session.
