to be for- fpirits, other than fea-ftores, the ship or veffel, together with her tackle, apparel and furni ture, and the lading found on board, fhall be forfeited: Provided, however, if fuch fhip or vessel be at sea, at the expiration of the time, for which the licence was given, and the mafter of fuch fhip or veffel fhall fwear, or affirm that fuch was the cafe, and fhall also within forty-eight hours after his arrival deliver to the collector of the district in which he fhall firft arrive the licence which fhall have expired, the forfeiture aforefaid fhall not be incurred, nor fhall the fhip or veffel be liable to pay the fees and tonnage aforefaid. n.

Sec. 7. And be it further acted, That the to number collector of each diftri&t fhall progreffively number the licences by him granted, beginning anew at the commencement of each year, and fhall make a record thereof in a book, to be by him kept for that purpose, and fhall, once in three months, tranfmit to the Register of the treasury, copies of the licences, which fhall have been fo granted by him; and alfo of fuch licences, as fhall have been given up or returned to him, refpectively, in pursuance of this act. And where any fhip or veffel shall be licenced, or enrolled anew, or being licenced or enrolled, shall afterwards be registered, or being registered, fhall afterwards be enrolled, or licenced, fhe fhall, in every fuch case, be enrolled, licenced or registered by her former name. Sec. 9. it cannot be found, and the mafter offuch ship or veffel fhall make and fubfcribe an oath or affirmation, that fuch licence is loft, destroyed, or unintentionally miflaid, as he verily believes, and that the fame, if found, fhall be delivered up, as is herein required, then the aforefaid penalty fhall not be incurred. And if fuch licence fhall be loft, destroyed, or un intentionally miflaid, as aforefaid, before the expiration of the time, for which it was granted, upon the like oath or affirmation being made and fubfcribed by the mafter of fuch fhip or veffel, the faid collector is hereby authorized and required, upon application being made therefor, to licence fuch fhip or veffel

Sec. 10. And be it further enacted, That it fhall and be lawful for the owner or ownmay cence, and ers of any licensed fhip or veffel, to return obtain new fuch licence to the collector who granted the fame, at any time within the year, for which it was granted, who fhall thereupon, cancel the fame, and fhall licence fuch veffel anew, upon the application of the owner or owners, and upon the conditions herein before required, being complied with; and in cafe the term, for which the former licence was granted, fhall not be expired, an abatement of the tonnage of fix cents per ton fhall be made, in the proportion of the time fo unexpired.

Sec. 11. Sec. 12. And be it further enacted, That Proceedwhen the mafter of any licenced fhip or veffel, ings on change of ferry boats excepted, fhall be changed, the mafters of new mafter, or, in cafe of his abfence, the owner or one of the owners thereof, fhall report fuch change to the collector refiding at the port where the fame may happen, if there be one, otherwife, to the collector refiding at any port, where fuch fhip or veffel may next arrive, who, upon the oath or affirmation of fuch new master, or in cafe of his absence, of the owner or one of the owners, that he is a citizen of the United States, and that such fhip or veffel shall not, while fuch licence continues in force, be employed in any manner, whereby the revenue of the United States may be defrauded, fhall endorse such change on the licence, with the name of the new master; and when any change fhall happen, as aforefaid, and fuch change fhall not be reported, and the endorsement made of fuch change, as is herein required, fuch fhip or veffel, found carrying on the coafting trade or fisheries, fhall be fubject to pay the fame fees and tonnage, as a veffel of the United States, having a register, and the faid new master shall forfeit and pay the fum of ten dollars.

Sec. 13. And be it further enacted, That it By whom fhall be lawful, at all times, for any officer enrolments concerned in the collection of the revenue, to may be inspeeted. infpect the enrolment or licence of any ship or veffel; and if the master of any such ship or veffel shall not exhibit the fame, when thereunto required by fuch officer, he shall pay one hun dred dollars.

destined from a district in one state, to a diftrict in the fame, or an adjoining state on the coafting sea coaft, or on a navigable river, having on veffels, haha- board, either distilled fpirits in casks exceedboard dif- ing five hundred gallons, wine in cafks exceedtilled fpiing two hundred and fifty gallons, or in bottles exceeding one hundred dozens, fugar in casks or boxes exceeding three thousand pounds, tea in chefts or boxes exceeding five hundred pounds, coffee in cafks or bags exceeding one thousand pounds, or foreign merchandize in packages, as imported, exceeding in value four hundred dollars, or goods, wares exceeding or merchandize, confifting of fuch enumerated or other articles of foreign growth or manufacture, or of both, whofe aggregate value exceeds eight hundred dollars, fhall, previous to the departure of fuch fhip or vessel,, from the port where she may then be, make out and fubfcribe duplicate manifefts of the whole of out dupli- fuch cargo on board fuch fhip or veffel, specifying in fuch manifefts, the marks and numbers of every cafk, bag, box, cheft or package containing the fame, with the name and place of refidence of every fhipper and confignee, and the quantity shipped by and to each, and if there be a collector or furveyor, refiding at fuch port, or within five miles thereof, he shall deliver fuch manifefts to the collector, if there be one, otherwife to the furveyor, before whom he fhall fwear or affirm, to the best of his knowledge and belief, that the goods therein contained were legally imported, and the duties thereupon paid or fecured, or if spirits diftilled within the United States, that the duties thereupon have been paid or fecured, whereupon the faid collector or furveyor fhall certify the fame on the said manifefts, one of
