ARTICLE XIV.

And in the fame cafe where one of the parbe furnish ties is engaged in war with another power, fea-letters, that the veffels of the neutral party may be readily and certainly known, it is agreed, that they fhall be provided with fea-letters, or paffports, which fhall exprefs the name, the property and burthen of the veffel, as alfo the name and dwelling of the master, which paffports fhall be made out in good and due forms, (to be fettled by conventions between the parties whenever occafion fhall require) shall be renewed as often as the veffel fhall return into port; and fhall be exhibited whenfoever required, as well in the open fea as in port. But if the faid veffel be under convoy of one or more veffels of war, belonging to the neutral party, the fimple declaration of the officer commanding the convoy, that the faid veffel belongs to the party of which he is, fhall be confidered as establishing the fact, and fhall relieve both parties from the trouble of further examination.

ARTICLE XV.

Pour prévenir entiérement tout défordre et toute violence en pareil cas, il a été ftipulé que lorfque des navires, de la partie neutre, navigans fans convoi, rencontreront quelque vaiffeau de guerre public ou particulier de l'autre partie, le vaiffeau de guerre n'approchera le navire neutre qu' au delà de la portée du canon, et n'enverra pas plus de deux ou trois hommes dans fa chaloupe à bord, pour examiner les lettres de mer ou paffeports. ARTICLE XVI

It is agreed that the fubjects or citizens of each of the contracting parties, their veffels and effects, fhall not be liable to any embargo or detention on the part of the other, for any military expedition, or other public or private purpose whatsoever. And in all cases of seizure, detention or arreft, for debts contracted or offences committed by any citizen or fubject of the one party, within the jurifdiction of the other, the fame fhall be made and profecuted by order and authority of law only, and according to the regular courfe of proceedings ufual in fuch cafes.

ARTICLE XVI.

Il a été convenu que les fujets ou citoyens de l'une des parties contractantes, leurs vaiffeaux ni éffets, ne pourront être affujettis à aucun embargo, ni retenus de la part de l'autre pour quelque expédition militaire, ufage public ou particulier de qui que ce foit. Et dans les cas de faifie, de détention, ou d'arrêt, foit pour dettes contractées, ou offenfes commifes par quelque citoyen ou fujet de l'une des parties contractantes dans la jurifdiction de l'autre, on procédera uniquement par ordre et autorité de la justice et suivant les voyes ordinaires en pareil cas ufitées.

ARTICLE XVII.

S'il arrivoit que les bâtimens ou effets de la puiffance neutre fuffent pris par l'ennemi de l'autre, ou par un pirate, et enfuite repris par la puiffance en guerre, ils feront conduits dans un port de l'une des deux parties contractantes et remis à la garde des officiers du port, afin d'être reftitués en entier au propriétaire légitime, dès qu'il aura duement conftaté fon droit de propriété.

ARTICLE XVIII.

nefs, and fhall be permitted to furnish themfelves, at reasonable prices, with all refreshments, provifions and other things neceffary for their fuftenance, health and accommodation, and for the repair of their veffels.

ARTICLE XIX.

The veffels of war, public and private, of both parties, fhall carry freely wherefoever they prizes into please, the veffels and effects taken from their the ports of enemies, without being obliged to pay any duties, charges or fees to officers of admiralty, of the customs, or any others, nor shall fuch prizes be arrested, fearched or put under legal procefs, when they come to and enter the ports of the other party, but may freely be carried out again at any time by their captors to the places expreffed in their commiffions, which the commanding officer of fuch veffel fhall be obliged to fhew. But no veffel which fhall have made prizes on the fubjects of his Moft Chriftian Majefty the King of France, fhall have a right of afylum in the ports or havens of the faid United States; and if any fuch be forced therein by tempeft or dangers of the fea, they fhall be obliged to depart as foon as poffible, according to the tenor of the treaties existing between his faid Moft Chriftian Majefty and the faid United States.
