Section 3. The board may employ such experts as shall be necessary to assist them in making investigations under this act and such clerks and stenographers as may be necessary to perform the clerical work of the board.

Section 4. For the purpose of making such investigation and report, the board may issue subpoenas, compel the attendance of witnesses and the production of books, records, papers, and documents. In case of failure of any person to comply with any order of the board or any subpoena lawfully issued or on the refusal of any witness to testify to any matter regarding which he may be interrogated, it shall be the duty of the circuit court of any county or the judge thereof, on the application of a member of the board, to compel obedience by attachment, proceedings for contempt, as in the case of disobedience of the requirements of subpoena issued in such court or a refusal to testify therein.

Section 5. The board, or any member thereof, or any person employed by the board for that purpose, shall, upon demand, have the right to inspect the books, records, and papers of any employer who is under investigation by the board and to examine under oath, any officer, agent, or employe of such employer, provided that any person other than a member of the board who shall make such demand or conduct such examination shall first produce his authority therefor, signed by the board or a majority thereof.

Section 6. No person shall be excused from testifying or from producing any books, records, papers or documents before the board on the ground or for the reason that such testimony, books, records, papers or documents may tend to incriminate him or subject him to a penalty or forfeiture, but no person having so testified or produced such books, records, papers or documents, shall be prosecuted or subjected to any penalty or forfeiture for or on account of any transaction, matter or thing concerning which he may have testified or produced books, records, papers or documents, provided that no person so testifying shall be exempted from prosecution or punishment for perjury in so testifying. Any person who shall wilfully interfere with the board or any of its employes in conducting any examination or who shall wilfully testify falsely to any matter or thing material to the investigation, or who shall, after a proper demand has been made therefore, fail or wilfully refuse to produce any book record, naner or document which is in his possession or under his control, shall be guilty of a misdemeanor and, unon conviction, shall be pun shed by a fine of not less than one hundred, nor more than one thousand dollars for each offense.

Section 7. Whenever the board shall have made and compelled an investigation under the provision of this act, it shall make and file its written report thereon as soon as practicable, which report shall be open to the public and the board shall, immediately upon making and filing such report, furnish a certified copy thereof to the employer so investigated and a like certified copy thereof to his employes.

Section 8.

There is appropriated from the general fund to the board of conciliation annually such sum as may be necessary to carry out its functions.

XVI. MISCELLANEOUS LABOR LAWS

Seats for women employes. Section 17281. Every person or corporation employing females in any manufacturing, mechanical or mercantile establishment in the state of Wisconsin shall provide suitable seats for the females so employed. and shall permit the use of such seats by them when they are not necessarily engaged in the active duties for which they are employed.

Any person or corporation who shall violate the provisions of this section shall, upon conviction thereof, be considered guilty of a misdemeanor and shall be punished by a fine of not less than ten dollars nor more than thirty dollars for each and every offense.

Protection of employes as members of the National Guard; depriving of employment, etc. Section 21.14. A person who, either by himself or with another, wilfully, deprives a member of the national guard of his employment, or prevents his being employed by himself or another, or in respect to his trade, business or employment, because said member of said national guard is such member, or dissuades any person from enlistment in the said national guard by threat of injury to him in case he shall so enlist, in respect to his employment, trade, or business, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than ten dollars nor more than twenty-five dollars, or by imprisonment in the county jail for not less than ten days nor more than twenty days.

Section 4423n. No association or corporation. constituted or organized for the purpose of promoting the success of the trade, employment, or business of the members thereof, shall by any constitution, rule, by-law, resolution, vote or regulation, discriminate against any member of the National Guard of the State of Wisconsin, because of such membership in such association or corporation, or in respect to his right to retain said last-mentioned membership. It is the purpose of this section and section 21.14 to protect a member of said National Guard from disadvantage in his means of livelihood and liberty therein but not to give him any preference or advantage on account of his membership in said National Guard. A person who aids in enforcing any such provisions against a member of the said National Guard with the intent to discriminate against him because of such membership, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than ten dollars nor more than twenty dollars, or by imprisonment in the county jail for not less than ten days nor more than twenty days.

Discharge or threat of discharge to influence votes of employes. Section 1728n. No person shall, by threatening to discharge a person from his employment or threatening to reduce the wages of a person or by promising to give employment at higher wages to a

person, attempt to influence a qualified voter to give or withhold his vote at an election.

Mutual forfeit upon leaving and discharge. Section 1728m. Any person or corporation engaged in manufacturing, which requires from persons in his or its employ, under penalty of forfeiture of a part of the wages earned by them, a notice of intention to leave such employ, shall be liable to the payment of a like forfeiture if he or it discharges, without similar notice. a person in such employ except for incapacity or misconduct, unless in case of a general suspension of labor in his or its shop or factory or in the department thereof wherein such employe is engaged.

Bribery of employes. Section 4575m. Whoever corruptly gives, offers or promises to an agent, employe or servant, any gift or gratuity whatever, with intent to influence his action in relation to his principal's, employer's or master's business; or an agent, employe or servant who corruptly requests or accepts a gift of gratuity or a promise to make a gift or to do an act beneficial to himself, under an agreement or with an understanding that he shall act in any particular manner in relation to his principal's, employer's or master's business; or an agent, employe or servant, who, being authorized to procure materials, supplies or other articles either by purchase or contract for his principal, employer or master, or to employ service or labor for his principal, employer or master, received directly or indirectly, for himself or for another, a commission, discount or bonus from the person who makes such sale or contract, or furnishes such materials, supplies or other articles, or from a person who renders such service or labor; and any person who gives or offers such an agent, employe or servant such commission, discount or bonus, shall be punished by a fine of not less than ten dollars nor more than five hundred dollars, or by such fine and by imprisonment for not more than one year.

Firemen's pension fund. Sections 959-46e to 959-46u and 959-46v. (Summary). In cities of the second, third and fourth classes having paid fire departments, pension funds are established for pensioning disabled and superannuated firemen and the widows and orphans of deceased members. Into these funds go the allotments made to such cities under section 1926 of the tax on fire insurance premiums and contributions are also required of the fireThese funds are administered by a board of trustees composed of the mayor, city treasurer, city comptroller or city clerk, city engineer, and three firemen elected annually.

Pension funds for Milwaukee city employes. Sections 959-46ua to 959-46uo. (Summary). The city council of Milwaukee may establish pension funds for its civil service employes in all of its departments classed as being regulated by the public utility act. Persons who receive any pension from this fund may not also claim compensat on under the workmen's compensation act when disabled.
