Failure of officers to perform duty not preventing criminal prosecution.-A criminal prosecution for the obstruction of navigable waters of the United States under act of Sept. 19, 1890, secs. 6, 7, 10 (26 Stat. 426), may be maintained though neither the officers and agents of the United States in charge of works for the improvement of said waters, nor the collectors of customs or other revenue officers, have given information to the district attorney as provided in this section.
