Employee may sue
to collect unpaid
wages due under
the act.
Secretary may take
assignment of such
claim and may
join various claim-

ants in one action.
Action must be
brought within 3
years from date
violation occurs.
Employee, or his
representative,
may release or
compromise any
claim under this
act, either before
or after legal ac-
tion taken.
Any agreement be-
tween employer
and an employee
for lower wages
than the employee
would be entitled
to under this act
does not consti-
tute a defense
against employee's
suit.

Employer subject to
a penalty of $50-
$200, or imprison-
ment for 30-60
days, or both, for
violation of the act
or for discharge or
other discrimina-
tion against an em-
ployee because such
employee institutes
proceedings or tes-
tifies in any such
proceeding.
Employer liable to a
fine of $50-$200 if
he fails to keep
records, or falsifies
records; interferes
with a Department
representative
refuses him entry
to an establish-
ment.

Each day any such
violation continues
constitutes a sepa-
rate offense.
