ACCOUNTS. scribed by law, or making a false certificate or return of an election, or neglecting to certify it to the clerk of the house of delegates or senate, as the case may be, within the time No. 1. Ch. 92, sec. 56, pa. 167-The same penalty for post-dating an account, in order to avoid the statute of limitations in suits against executors or administrators. ACTIONS POPULAR. Rev. Code, vol. 1, ch. 25, pa. 32-Prosecutor, for penalties not wholly appropriated to his use, compounding with the offender, or discontinuing the prosecution, unless by leave of the court, forfeits so much of the penalty to the commonwealth, or any other, as they would be entitled to if the defendant had been convicted. ADULTERY AND FORNICATION. Rev. Code, vol. 1, ch. 138, sec. 6, pa. 276A person, not being a servant or slave, convicted of adultery or fornication, by the oaths of two or more witnesses, or the confession of the party, shall forfeit twenty dollars. To the overseers of the poor, for the use of the poor. AFFRAYS. Rev. Code, vol. 1, ch. 21, pa, 30-Persons guilty of affrays, within the meaning of this act, forfeit their armor to the commonwealth, and may be imprisoned not exceeding one month. ARMS.-See Militia. ASSEMBLY. See Bribery and Extortion, No. 3, 4. No 1. Rev. Code, voi. 1, ch. 17, sec. 6, pa. 19-Qualified electors failing to vote, at an election of delegates or a senator, to pay onefourth of their proportion of levies and taxes of the ensuing year. 2- Sheriff failing to lay before the grand jury, a list of all the land holders resident in his county, forfeits fifty pounds. 3 Sec. 17. Sheriff or mayor refusing to take a poll when required by a candidate or elector, or taking it otherwise than pre neglecting to deliver the poit books to the clerk of the court, or refusing to suffer a candidate or elector to take a copy of the poll books, forfeits £50.-One half to the inform er, the other to the commmonwealth. 4. Sec. 20. Each absent deiegate or senator to pay ten pounds, besides losing his wages, if a sufficient number do not attend on any day to proceed to business-To the commonwealth. 5. Ch. 39, sec. 6, pa. 42, Elector voting twice at an election, forfeits £10.- To the informer. 6. Ch. 248, sec. 1, pa. 389. Any person arresting or prosecuting a delegate or sena. tor, for words spoken or written, or propositions made in the assembly, to be imprisoned, not exceeding twelve months, and fined, not exceeding two thousand dollars. ATTORNIES AT LAW. No. 1. Rev. Code, vol. 1, ch. 71, sec. 2, pa. 96. Any person practising as counsel or attorney without licence, or without qualifying according to law, forfeits 150 dollars.-One moiety to the informer, the other to the commonwealth. 2. Sec. 5. No counsel or attorney who shall prosecute a suit in an inferior court, in which an appeal may be prayed, shall appear or prosecute such appeal in a superior court, under the penalty of sixty dollars -To him who will sue. 3. Sec. 8. An attorney engaging to appear for a defendant, by endorsement on the writ, and failing to do so, forfeits eight dollars.--To the defendanı, 4. Sec, 10. Any attorney appearing under a power of attorney made before acti. on brought, for confessing judgment, or suf fering it to pass by default or otherwise, for any defendant in any court of record, forfeits 1500 dollars,- To such defendant, she 5. Lawyers demanding, or directly or indirectly taking more than the legal fees, before the services are performed, or the suit ended, shall forfeit 150 dollars, for every offence. One half to the governor, for the use of the commonwealth, the other to the informer. AUTHORS OF LITERARY WORKS. Rev. Code, vol. 1, ch. 8, pa. 14. Ferprinting, re-printing, or importing from abroad, any literary work, without consent of author, double the value of each copy.- -To the author. form his duty, or stamping any barrel of heef contrary to the directions of this act, forfeits four dollars-To the informer. 2 Sec. 4. Every person exposing to sale or barter a barrel of beef containing less than 204 lbs, of merchantable meat, forfents four dollars-To the same. 3 Sec. 5. Every seiler or exporter of beef packed in this commonwealth, shall take an oath before a justice, that the bargels are the same that were inspected, and contain the full quantity; for a false oath, he shall incur the penalties of perjury, and forfeit 100 do.lars-To any person who will sue. BILLS OF EXCHANGE. No. 1. Rev. Code, vol. 1, ch. 77, sec. 4, pa. 114-A person receiving or purchasing a bill of exchange, which does not express the true, sum in current money, forfeits the whole sum for which it was drawn-To the drawer. BILL OF HEALTH-See cattle. BOATS-See James River. BOOK DEBTS-See accounts, BREAD.. See flour and bread, unwholsome meat, &c. BREWERS. See unwho/some meat, bread and drink. BRIBERY, & BRIBERY & EXTORTION. No. 1. Rev. Code, vol. 1, ch. 59, sec. 1, pa. 56 Treasurer, keeper of any public seal, councillor of state, counsel for the common 2 Sec. 4 & 5. Ballast master failing to attend the unlading of bailast, after notice, for-wealth, judge, clerk of the peace, sheriff, feits sixty dollars. 3 Sec. 6. Master of a vessel failing to give notice to the ballast master of the time he intends to unlade his ballast, and unlading without such notice, forfeits $100. BANK NOTES. No. 1. Rev. Code, vol. 1, ch. 11, pa. 16. Offering in payment a private bill or note, payable to bearer, incurs a forfeiture of ten times the amount.- To the informer. 2 Rev. Code, vol. 2, ch. 54, pa. 79. The same penalty inflicted for offering in payment|| any note or bill, payable to bearer or other person, which shall be emitted by a bank having no charter. BASTARDS.—See overseers of the poor. coroner, escheator, or any other officer of the commonwealth, taking any brokerage or reward for doing his office, other than that allowed by law, shall pay to the party grieved treble the value of what he shall have received, shall be amerced and imprisoned at the discretion of a jury, and be discharged from his office forever-One third of the a. mercement to him who will sue for himself and the commonwealth 2 Rev. Code, vol. 2, ch. 61, sec. 4, pa. 86If the clerk of any court knowingly and fraudulently shall charge, demand, exact or take more than the legal fees, or charge, &c. for business not actually done, he shall be held guilty of extortion, and on conviction in the general court, shall be amerced and imprisoned at the discretion of a jury and discharged from his office forever. 3 Rev. Code, vol. 1, ch. 59, sec. 3, pa. 57, and ch. 304, sec. 8, pa. 434-Any candidate or other in his behalf, directly or indirectly, No. 1. Rev. Code, vol. 1, ch. 137, sec. 1, pa. 273-Beasts breaking into fields, inclosed with a lawful fence, may, for the third offence, be killed; for the first offence, reparation shall be made to the party injured for the true value of the injury; for every tres-giving or agreeing to give any elector or prepass afterwards double damages. No. 1. Rev. Code, vol. 1, ch. 128, sec. 2, pa. 242—An inspector of beef, failing to per a BROKERAGE. Rev. Code, vol 1, ch. 31, sec. 4, pa. 37Every broker taking more than at the rate of five shillings for the brokerage of one hun dred pounds a year, or one shilling for making or renewing the bond, &c. concerning the same, forfeits 20/- -One moiety to the commonwealth, the other to the informer. BURNING THE WOODS. Rev. Code, vol. 1, ch. 292, sec. 2, pa. 423Any person setting the woods on fire, except by accident, shall forfeit 30 dollars One half to the informer, the other towards lessening the county levy. BUTCHERS-See unwholsome meat, Ve. No. 1. Rev. Code. vol. 1, ch. 137, sec. 6, pa. 274. A freeholder refusing to obey a warrant from a magistrate, relative to ob. taining a bili of health, for cattle drove through this state, shall be amerced by such magistrate, not exceeding five dollars, CHEATING AT GAMING. See gaming No 6. Rev. Code, vol. 1, ch. 110, sec. 6--7-Certain descriptions of persons prohibited from migrating to, or becoming citizens of this commonwealth, under the penalty of six months imprisonment without bail or mainprize, and a fine not exceeding 300 dollars; and if found at large after the expiration of 12 months from the time of his conviction, to be committed to jail for five years, without bail or mainprize, and torfeit all his goods and chattels; and in any suit brought by such person, the jury shall find for the de fendant, and the plaintif sll pay treble costs. CLERKS OF COURTS, When to transmit lists of fines and under what penalty-See fines. No. 1. Rev. Code, voi. 1, ch. 70, sec 1. pa 94. Any person executing the office of clerk of a county or inferior court, without taking the necessary oaths, forfeits 1500 dodlars, and is subject to one year's imprisonment without bail or mainprize--One moiety to the informer, the other to the commonwealth, by sec. 6 of the same law. 2 Sec. 6. If cattle appear by the report of the freeholders, to be distempered, the owner may impound them; if he refuse or suffer them to escape before a justice certifies they may be removed with safety, a magistrate 2 Sec. 2. Every person failing to restrain his distempered cattle, or when they die, to bury them with their hides on as above directed, shall forfeit 4 dollars for each head. 4. Sec. 7. A driver of caitle coming into this state, and failing to produce to a justice of the next county a manifest, under the hand of a magistrate of the state from whence he came, distinguishing the sexes, ages, &c and also bills of sale for them, and particularising the place of abode and name of the seller, and to make oath that he knows of no more cattle in the drove than are mentioned in the manifest and bill of sale; and if bought in this state to be driven into another, the same method to be pursued; and so in every county through which he may pass; failing herein, he shall forfeit his whole drove; and it may be sold by order of a justice, &c-One moiety of the amount of sale to the overseers of the poor, the other to the informer. 5 Sec. 8. Not to extend to any inhabitants of this commonwealth, who may buy cattle and be driving them home; nor to persons coming with their families and stocks to settle in this commonwealth. CHAMPERTY. Rev. Code, vol. 1, ch. 97, pa. 177. A person convicted of champerty, shall be punished by imprisonment and amercement at the discretion of a jury. CHANCELLOR, Penalty on for executing his office without taking the necessary oathssee judges and justices. the discretion of a jury; and be liable to the action of the party grieved. 3 Sec. 3. Clerk of county or other inferior court, failing to transmit his hand for the faithful execution of his office to the clerk of his district court, within 3 months, forfeits 300 dollars, or executing his office without entering into bond forfeits 600 dollars -One moiety to the informer, the other to the commonwealth. 4 Sec. 4. Neither the court nor clerk of any county or corporation shall remove the records or papers of the same without the county, unless in cases of invasion or insurrection, or where authorised by law, under the penalty of 600 dollars-To the same. 5 Rev. Code, vol 2, ch. 34, sec. 2, pa 37. Clerk of county and corporation court failing to transmit and certify immediately to clerk of district court, copies of recognizances of witnesses or criminal admitted to bai!, when sent for further trial, forfeits 100 dollars. And failing to transmit to attorney for the con:monwealth, in the district court, copies of warrant of commitinent and depositions, forfeits 50 dollars-To the commonwealth. 6 Rev.
