and have been reputed and looked upon as the bounds and limits thereof, and the faid chapel called North Chapel shall be the parish church of the faid parifh of North Chapel, and the faid parish of North Chapel fhall to all intents and purposes be a rectory of itself, and the tithes of all the lands, tenements and hereditaments, fituate and contained within the faid ancient bounds and limits of the faid chapely of North Chapel fhall from thenceforth be payable and paid to the rector of the faid parith of North Chapel and his fucceflors for ever, and the faid rectory fhall be therewith endowed for ever, and that the dwellinghouse heretofore used for the habitation of fuch perfon as from time to time officiated in the faid chapel called North Chapel as chaplain there, with the barns, ftables, out-houses and orchard, garden and yards thereunto belonging, and one clofe of ground containing by eftimation four acres, commonly reputed the glebe belonging to the faid chapel, fhall be from thenceforth enjoyed by the rector of the faid parish of North Chapel and his fucceffors for ever, and fhall be the glebe of the faid parifh of North Chapel for ever: And be it further enacted by the authority aforefaid, that from and after fuch time as the faid church of Petworth The chapelry fhall become void by the death, ceffion or furrender of the faid of Dungton Doctor Pelling, or otherwife howfoever, the faid chapely of Dungton, and the meffuages, lands, tenements and hereditaments, fituate and included within the bounds and limits of the faid chapelry of Dungton, fhall be a parifh of itfelf to all intents and purposes diftinct from the faid parifh of Petworth, and divided wholly from the fame, and shall be called the parish of Dungton, and the faid parifh of Dungton fhall be extended to, and contained within the fame ancient bounds and limits which now do and of ancient time have bounded the faid chapelry of Dungton, and been reputed or looked upon as the bounds and limits of the faid chapelry of Dungton, and the chapel, called Dungton chapel, fhall be the parish church of and for the faid parish of Dungton, and the faid parish of Dungton fhall to all intents and purposes from thenceforth be, and fhall be accepted, reputed and taken to be a rectory of itself, and the tithes and tenths of all the lands, tenements and hereditaments, fituate and contained within the faid ancient bounds and limits of the faid chapelry of Dungton, fhall from thenceforth be payable, and paid to the rector of the parish of Dungton, and his fucceffors for ever; and that it fall and may be lawful to and for the faid Duke of Somerfet, his heirs and afligns, by any writing or writings, or inftruments, under his or their hand and feal, or hands and feals, to annex and add to the faid rectory of Dungton for ever, any parcel or parcels of land or ground lying within the bounds or limits of the faid chapelry of Dungton, of which he is or he or they fhall be then feifed in fec-fimple not exceeding in

And be it further enacted, that from and after fuch time as the faid church of Petworth fhall become void as aforefaid, all the tithes of the lands in the faid parish of Petworth, lying within the bounds and limits hereinafter-mentioned, (that is to fay) all the lands lying on the fouth-fide of the lane beginning from Rotherbridge, and leading eaftward by cross-lands and Haflingebourne-mills and Gorehill, and onward to Egdeane common, and from Rotherbridge weftward by the river, as far as the faid river runs betwixt the parishes of Petworth and Tillington on the fouth-fide of the faid river, fhall be holden, taken and enjoyed by the rector and incumbent of the faid rectory and parish church of Dungton, and his fucceffors for ever, in right of the faid church of Dungton, as a portion of tithes annexed to the faid rectory of Dungton for ever; yet fo, nevertheless, that the faid lands laft mentioned fhall for ever remain and not ceafe to be parcel of and within the faid parish of Petworth, and fhall pay taxes to the repairs of the faid parifh church of Petworth, and to the relief of the poor, and reparations of highways in the faid parifh of Petworth, as now it doth and formerly hath done, and that the faid lands fhall not be contributary to the repairs of the faid parish church of Dungton, nor the relief of the poor, or repairs of the highways in the faid parish of Dungton. affigns, fhall and may use and maintain any writ of pedit, darreine prefentment, or writ of right of advowson for or upon any difturbance that shall or may at any time or times hereafter be given to him or them in or about the prefenting to any of the faid rectories or churches, as fully to all intents and purpofes as if he or they had had actual seifin of the said advowłon, and formerly prefented clerks to the fame, who, upon his prefentation, had been admitted, inftituted and inducted into the fame rectories and churches, any law, ufage or cuftom to the contrary thereof in any wife notwithstanding; and be it further enacted, that from and after such time as the faid church of Petworth fhall firft and next become void as aforefaid, the inhabitants of the faid refpective parishes of North Chapel and Dungton, fhall and may have and elect churchwardens, overfeers of the poor and furveyors of the highways, and all parish officers respectively within the faid refpective parishes, and make and lay, and affefs taxes and affeffments upon the refpective parishioners and inhabitants of the faid refpective parishes refpectively, towards the repairs of the faid refpective parish churches, maintenance of their refpective poor, and repairs of the highways within the faid refpective parishes, as fully to all intents and purposes as the parishioners of other parifhes within this kingdom of England may lawfully do, and that from and after fuch firft and next avoidance of the faid church of Petworth aforefaid, the refpective rectors and parfons of the faid refpective parishes of North Chapel and Dungton, for the time being, fhall and may, for ever, have and take, receive and enjoy fuch and the like oblations, obventions, fees and duties, within the faid refpective parishes, as other rectors and parfons of other rectories and parfonages may do by law; provided nevertheless, that the faid chapelries of North Chapel and Dungton, during the incumbency of the faid Doctor Pelling in the faid parish of Petworth, fhall remain, continue and be parcel of and within the said parish of Petworth to all intents and purposes, and in fuch and the fame manner as now the fame are, and fhall pay all their oblations, obventions, tithes, fees and duties to the faid Doctor Pelling, as rector and incumbent of and in the faid church of Petworth, in the said manner as they should or ought to have done if this act had not been made; and be it further enacted by the authority aforefaid, that the Little Manor within the faid parifh of Petworth, commonly called the Manor of the Rectory of Petworth, with the rights, members and appurtenances thereof, fhall, immediately from and after fuch time as the faid church of Petworth fhall become void as aforefaid, be for ever annexed to the Honour of Petworth, and together with the fame, be holden and enjoyed by the lords owners of the faid Honour of Petworth, as part of the faid Honour of Petworth for ever, and in lieu and re

tompence thereof, the rector and parfon of the church of Petworth and his fucceffors fhall from thenceforth for ever have, receive and take out of the Honour and Manor of Petworth and the demefne lands thereof, one annuity peniion and yearly rent of ten pounds, being much more than the yearly value of the faid Little Manor, to be paid unto the faid rector or parfon of the faid church of Petworth and his fucceffors, yearly and every year for ever, at the two moft ufual feafts or days of payment in the year, (that is to fay) the feaft of Saint Michael the Archangel, and the Annunciation of the Bleed Virgin Mary, by even and equal. portions; and if the faid annuity or yearly rent of ten pounds Thall be behind and unpaid, in part or in aii, by the pace of twenty days next over or after any of the faid feaft days on which the fame ought to be paid, that then and fo often, it fhall and may be lawful, to and for the faid parfon of Petworth and his fucceffors, to diftrain for the fame in the demefne lands of the faid Manor of Petworth, and the diftrefs there found to take, keep and detain till the faid rent fo in arrear, and his or their charges in and about the recovery thereof he or they shall fuftain, be fully fatisfied and paid, faving always to all and every Saving the perfon and perfons, bodies politick and corporate, (other than rights of their faid Majefties, their heirs and fucceffors, and the faid Duke all pe fons and Duchefs and their heirs, and the faid provoft of the faid their Majefties (other than college-royal of the Bleffed Mary of Eton near unto Windfor, and the Duke and the faid college and their fucceffors) all their rights of prefentation Duchefs and to the faid churches or any of them, and all their eftates, rights, titles, interefts, claims and demands, of, in and to the faid advowfons, patronages and prefentations, of and to the faid rectories, vicarage and churches, or any of them, in the fame manner and as fully to all intents and purposes as if this act had never been made, any thing herein to the contrary thereof in any wife notwithstanding. And the jurors aforefaid, upon their oath aforefaid, further fay, that the manor of the rectory of Petworth in the faid recited act above-mentioned, hath, ever fince the making of the faid act, been held by the faid Dukes of Somerfet and Earls of Egremont, who have been reípectively intitled to, and have enjoyed the faid Honour of Petworth, in the faid indenture mentioned, under and by virtue of the faid indentures as annexed to and parcel of the Honour of Petworth aforefaid; and the jurors aforefaid, upon their oath aforefaid, further fay, that the annuity, penfion and yearly rent of ten pounds, mentioned in the faid act of parliament, has been conftantly paid to the rector of Petworth for the time being, and that the faid rectory of Petworth hath, ever fince the making of the faid act, been divided into three diftinct rectories, called by the feveral names of Petworth, North Chapel and Dungton; and that the faid three rectories have been conftantly held fince the making
