A BILL ΤΟ Give to the Commissioners of Her Majesty's Works [Note. The Words printed in Italics are proposed to be inserted W HEREAS by the Thirty-ninth Chapter of the Statutes Preamble. made in the Session of Parliament held in the Ninth and 9 & 10 Vict. Tenth Years of Her Majesty Queen Victoria, and which c. 39. received the Royal Assent on the Third Day of August One thousand 5 eight hundred and forty-six, the Commissioners of Her Majesty's Woods, Forests, Land Revenues, Works, and Buildings were empowered to construct and complete an Embankment and Roadway along the North Bank of the River Thames from Battersea Bridge to Vauxhall Bridge, and to construct and complete a Bridge across the said River from a Point near to Chelsea Hospital to a Point near the Public House called the Red House, with convenient Approaches thereto, together with convenient Piers, Stairs, Hards, and 10 Landing Places; and also a Street from the South End of Lower Sloane Street to the Northern Extremity of such Bridge, in manner therein mentioned, and according to certain Surveys, Plans, and Designs therein referred to; and which Plans and Designs, in pursuance of a Provision in that Behalf in the Sixth Section of the 5 said Act contained, were duly deposited for public Inspection at the Office of the said Commissioners: And whereas in a Schedule to the said Act was contained a List of the Houses and Buildings, Lands and Hereditaments, which would probably be required for the Purposes thereof; and it was by the Eighth Section of the said Act 10 provided that the said Commissioners, in making the said Roadway and Street and the Approaches to the said Bridge, should not deviate more than Fifty Feet from the Lines described in the aforesaid Plans and Designs, without the Consent and Approbation of the Person through whose Lands or Tenements such Deviation should be made, 15 or the Use and Enjoyment of whose Tenements should be affected by such Deviation; and that in respect to the Soil or Freeholds of the Reverend Joseph George Brett, Clerk, no Deviation should take place without adequate Compensation in reference to the same being made to him in manner therein mentioned; and by the Twenty-first 20 Section of the said Act it was provided that no Houses or Buildings, Lands or Hereditaments, other than the Bed of the said River, should be taken or made use of for the Purposes of the said Act, except such as were mentioned in the said Schedule thereunto annexed, or as were situated within the Limits of the Line of Deviation therein-before 25 authorized, without the Consent in Writing of the Owner or Owners thereof being first had and obtained for that Purpose; and it was by the Twenty-seventh Section of the said Act also enacted, that if the said Commissioners for executing the said Act should not within the Space of Seven Years, to be computed from the passing of the 30 said Act, purchase or take the Tenements and Hereditaments, or Parts thereof respectively, which they were thereby empowered to take, use, and purchase, then and from thenceforth the Powers thereby granted to them for such Purpose should cease, determine, and be utterly void: And whereas it was by the said recited Act also stated 35 that the whole Cost of constructing such proposed Embankment and Roadway as aforesaid was not to fall ultimately upon the Public, but that a certain Proportion of such Cost was to be contributed (either in Money or by conveying the Land required free of Expense, or by constructing the same Embankment and Roadway, or Parts 40 thereof, at Prime Cost or otherwise), by certain of the Owners of or Parties interested in the Tenements situated on the River Frontage, along which the said intended Embankment and Roadway were to pass, in consideration of the Benefit which would accrue therefrom to their said respective Tenements, and that certain 45 of 20 5 of such Parties were willing to contribute accordingly in some of the Modes aforesaid, and that it was intended that they should respectively enter into Agreements with the said Commissioners of Her Majesty's Woods, Forests, Land Revenues, Works, and Buildings, to make such Contribution accordingly in such Sums or otherwise as the Lord High Treasurer, or the Commissioners for executing the Office of Lord High Treasurer, should approve of; and that no Part of the said intended Embankment and Roadway should be commenced until after all such Agreements as aforesaid, so approved of as aforesaid, should 10 have been duly executed, and the Powers and Authorities by the said Act given to the said Commissioners of Her Majesty's Woods, Forests, Land Revenues, Works, and Buildings were so given as to take effect (except as to the said Bridge, which the said Commissioners were authorized to commence forthwith) only when and so soon as such 15 Agreements for Contribution as aforesaid (including a certain Agreement with the Governor and Company of Chelsea Waterworks therein referred to), should have been made and entered into, but not sooner: And whereas under and by virtue of the Provisions of the Forty- 14 & 15 Vict. second Chapter of the Statutes made in the Session of Parliament held c. 42. in the Fourteenth and Fifteenth Years of Her said Majesty, the Commissioners of Her Majesty's Works and Public Buildings are now substituted for the Commissioners of Her Majesty's Woods, Forests, Land Revenues, Works, and Buildings, for the Purposes of the said recited Act: And whereas the intended Bridge authorized by the said firstrecited Act hath been commenced and is now in course of Construction: And whereas by the Seventy-first Chapter of the Statutes made in the 15 & 16 Vict. Session of Parliament held in the Fifteenth and Sixteenth Years of c. 71. Her said Majesty, the said Commissioners of Her Majesty's Works and Public Buildings were empowered to proceed with the Con30 struction of the Eastern Division of the said intended Embankment and Roadway, notwithstanding that the said Agreements mentioned in the said first-recited Act had not then been entered into; but no Proceedings have been yet taken under the last-recited Act: And whereas the said Commissioners of Her Majesty's Works and Public Buildings have made certain Alterations in the original Plans and Designs of the said proposed Embankment and Roadway, and it is expedient that the said Commissioners should now be authorized to proceed with and complete the whole of the said proposed Embankment and Roadway and new Street, and for that Purpose it is neces40 sary that the Time limited by the said first-recited Act should be extended, and that the Powers by the said first-recited Act conferred with reference to the said original Plans and Designs, and to the Houses and Buildings, Lands and Hereditaments, comprised in the Schedule to the said first-recited Act, should be extended to the said 45 amended Plans and Designs, and to the Houses and Buildings, Lands 25 35 Commission ered to com and Hereditaments comprised in the Schedule to this Act annexed: I. For the Purposes of this Act all the Enactments of the said 9 & 10 Vict. first-recited Act shall be considered as herein repeated, with the 15 Substitution of the said amended Plans and Designs for the Plans and Designs mentioned in the said first-recited Act, and of the Schedule annexed to this Act for the Schedule annexed to the said first-recited Act, and of the Commissioners of Her Majesty's Works and Public Buildings for the Commissioners of Her Majesty's Woods, Forests, 20 Land Revenues, Works, and Buildings: Provided nevertheless, that if the Commissioners of Her Majesty's Works and Public Buildings shall not, within the Space of Four Years from the passing of this Act, purchase and take the Tenements and Hereditaments or Parts thereof respectively which they are by this Act, by Reference as 25 aforesaid, empowered to take, use, and purchase, then the compulsory Powers for such Purpose shall cease.
