ration of the permits and licenses themselves, the first permits and licenses were not issued until March 2, 1921. Between that date and the end of the fiscal year final action was taken on 47 applications. Of this number 8 were rejected, 9 withdrawn, and 2 consolidated with other applications. Preliminary permits were authorized in 13 cases and licenses in 15. Of the licenses authorized, 8 were for transmission lines. The remaining 7 involved 532,000 primary horsepower and an estimated installed capacity of 1,226,000 horsepower. The preliminary permits involved 706,000 primary horsepower and an estimated installed capacity of 1,107,000 horsepower; making an aggregate of 28 projects with 1,238,000 primary horsepower and 2,333,000 horsepower of estimated installation.

Between July 1 and November 1, 1921, 42 applications were acted upon by the Commission. Five applications were rejected and 7 withdrawn, and 14 preliminary permits and 16 licenses authorized. Of the licenses authorized, 6 were for transmission lines. The remaining 10 involved 35,600 primary horsepower and 54,000 installed horsepower. The 14 preliminary permits involved 142,000 primary horsepower and an estimated installed capacity of 240,000 horsepower, making a total for the 31 projects of 177,600 primary and 294,000 installed horsepower.

Up to November 1 final action has been taken on 89 applications. Thirteen have been rejected, 16 withdrawn, 2 consolidated with other applications, and 27 preliminary permits and 31 licenses authorized. The 58 projects authorized to November 1 aggregate 1,415,600 primary and 2,627,000 installed horsepower. Of the 31 licenses, 5 affect navigable waters, 21 national forests, 3 Indian reservations, and 13 public lands. Of the 27 preliminary permits, 15 affect navigable waters, 9 national forests, 3 Indian reservations, and 11 public lands. The permits and licenses thus authorized are as follows:

The 89 cases in which final action has been taken are 34 per cent of the total filed up to November 1. Many of the larger projects not yet acted upon are awaiting from other agencies authorizations which must precede approval by the Commission. In several of the States, particularly in California, action upon applications is awaiting the approval of water rights as required by section 9 (b) of the act. Projects on the St. Lawrence must await the action of the International Joint Commission. The applications on the Columbia River are so involved with proposed irrigation developments that it has been found necessary to make a thorough investigation before further action is taken. This investigation is now being made by the Columbia River Board. Under authority of a recent act of Congress an interstate commission is proposing to allocate the water of the Colorado among the several interested States, and action upon applications before the Federal Power Commission may depend in considerable degree upon the conclusions reached by this interstate commission. The applications thus suspended on these three streams alone aggregate 8,325,000 horsepower or one-half the total before the Commission.

Declarations of Intention.

Under the terms of section 23 of the act "any person, association, corporation, State, or municipality intending to construct a dam or other project works across, along, over, or in any stream or part thereof, other than those defined herein as navigable waters, and over which Congress has jurisdiction under its authority to regulate commerce between foreign nations and among the several States, may in their discretion file declaration of such intention with the commission, whereupon the commission shall cause immediate investigation of such proposed construction to be made, and if upon investigation it

shall find that the interests of interstate or foreign commerce would be affected by such proposed construction, such person, association, corporation, State, or municipality shall not proceed with such construction until it shall have applied for and shall have received a license under the provisions of this act. If the commission shall not so find, and if no public lands or reservations are affected, permission is hereby granted to construct such dam or other project works in such stream upon compliance with State laws."

Under the provisions quoted 11 declarations of intention were filed during the fiscal year and 5 more between July 1 and November 1, 16 in all. The Commission had taken final action on 8 on July 1, and on 13 on November 1. In 5 cases it was found that the interests of interstate or foreign commerce would be affected, and in 8 cases that no such interests were involved. Details of action taken during the fiscal year may be found in the minutes of the Commission's meetings.

Withdrawals.

Section 24 of the act provides that "lands of the United States included in any proposed project under the provisions of this act shall from the date of filing of application therefor be reserved from entry, location, or other disposal under the laws of the United States until otherwise directed by the commission or by Congress.'

Of the applications on file on July 1, 173 involved the use of lands of the United States. Notices of withdrawal under the provisions quoted covering 121 applications and involving a total of 552,590 acres had been submitted to the General Land Office. In 52 cases sufficient information had not been furnished to identify the areas subject to withdrawal.

Between July 1 and November 1 withdrawals were made in 17 additional cases, making a total up to November 1 of 138 withdrawals, involving an aggregate of 624,866 acres. Details of withdrawals by States are given in the following table:
