H. all his flock in trade in and upon the faid premises, together with all the fixtures, coppers and utenfils thereto belonging, at a fair appraisement to be made by two regular appraifers, one of whom for appraifing the flock in trade to be chofen by the faid G. H. and the other by the faid C. D. and by two other regular appraisers for the valuation of the faid fixtures, coppers and utenfils, one of whom to be alfo named by the faid G. H. and the other by the faid C. D.

Provided always, and the intent of these prefents and the parties hereto is, that the faid G. H. fhall have the ufe of one lodging room in the faid meffuage or tenement up two pair of ftairs backwards, for and during the space of three months to be computed from.

HEREAS the faid G. H. hath contracted and agreed with the faid C. D. to employ him as a factor in London, for him the faid G. H. for the vending, felling and uttering of all fuch wares and merchandizes, as he the faid G. H. fhall confign and fend unto the faid C. D. in his own dwelling-houfe in for and during the term of years to commence from the day of the date of thefe prefents: Whereupon they the faid G. H. and C. D. for themselves their executors and adminiftrators, do covenant and grant to and with each other reciprocally, and each of their executors and adminiftrators in manner following; first of all, that he the faid C. D. fhall and will accept and take into his truft, charge and cuftody, all fuch wares and merchandizes as he the faid G. H. fhall fend and confign to him the said C. D. and also fhall do his best endeavour to vend and fell the fame for the beft profit and advantage of the faid G. H. for and during the faid term of years to commence from the day of the date of these prefents as aforefaid; alfo that he the faid C. D. fhall keep or caufe to be kept juft and true books of account in writing of all fuch wares and merchandizes, as the faid G. H. fhall from time to time during the faid term confign unto the faid C. D. and shall come into his charge and

D. at the expiration of the faid term: Also that he the faid C. D. fhall be true and faithful unto the faid G. H. in the vending of all wares and merchandizes of the faid G. H. during the faid term, and not defraud the faid G. H. in the premiffes; but shall endeavour to vend the faid goods and merchandizes for the best prices and fooneft day or time of payment he can: Allo that he the faid C. D. fhall not during the faid years deal or trade as a factor for any other perfon or perfons, for the buying or felling of any wares or merchandizes whatfoever, befides the faid G. H. as aforefaid: Alfo the faid G. H. for and in confideration of the faid factorfhip, doth covenant and agree for himself, his executors and administrators, to pay unto the faid C. B. or his affigns, within three months after fuch delivery, the fum of, &c. and the said A. B. in confideration of the agreement aforefaid of the faid C. D. doth promise and agree, on or before, &c. aforefaid, at his own proper expence to fend in and deliver to the faid C. D. or his affigns, the faid three hundred quarters of wheat fo fold to him as aforefaid: and that he the faid A. B. fhall and will warrant the fame to be good, clean and mercantile grain. Minutes of agreement between a housekeeper and his lodger.

EMORANDUM, It is agreed by and between A. B. of, &c. and C. D. of, &c. as follows, (viz.) The faid A. B. in confideration of the rent herein after mentioned, and agreed to be paid to him, hath letten to the faid C. D. one room up two pair of ftairs forwards, part of the now dwellinghoufe of the faid A. B. fituate, &c. together with the furniture at prefent ftanding therein, that is to fay, one locking glafs, &c. To hold to the faid C. D. for the term of one whole year, to commence from, &c. at the yearly rent of, c. to be paid quarterly, to wit, at, &c. and the faid C. D. in confideration thereof agrees to pay the aforefaid yearly rent of, &c.

at the times above limited for payment thereof; and at the end of the term aforefaid, or in cafe of any default in payment, shall and will, at the request of the faid C. D. or his affigns, immediately yield and deliver up to him or them the peaceable and quiet poffeffion of the faid room, together with the whole furniture he from the first entrance thereon found and poffeffed, in good and fufficient plight and condition, reasonable wear and tear only excepted. EMORANDUM, That it is hereby declared and agreed by and between 7. F. of Devonshire-ftreet, Queen-fquare, in the county of Middlefex, engraver, and C. D. of the Inner Temple, gent. in manner following; that is to fay, That the faid J. F. hath agreed to let, and hereby doth let, and the faid C. D. hath agreed to take, and hereby doth take all that the first and fecond floor, front garret, and front kitchen, with the conveniences and appurtenances thereto belonging, of the houfe now in the occupation of the faid 7. F. fituated No. 20, in Devonshire-firect aforefaid, together also with two cellars adjoining to each other under the pavement of the faid ftreet, and to the faid houfe belonging, to hold the fame with their appurtenances, and the fole and uninterrupted ufe and occupation thereof unto the faid C.
