Power for

SETTLE receivers, bankers and agents, they are to have power and authority to nominate, with liberty to employ them as they fhall think fit, and full power to allow them fuch reafonable falaries and gratuities in refpect of their labour, pains and trouble, as to the faid trustees for the time being fhall from time to time feem meet) neither shall they the faid truftees, nor any of them, be anfwerable or charged, or chargeable for any other misfortune, lofs or damage which may happen in the execution of the aforefaid trufts, or otherwife, in relation thereto, except the fame fhall be by or through their own wilful default refpectively, and alfo that they the faid feveral trustees, and every of them, their, and every of their refpective imbürfe them. heirs, executors and adminiftrators, fhall and may, by and out of the monies which fhall or may come to their refpective hands, by virtue of the trufts aforefaid, retain to and reimburse himfelf and themselves, and also fhall and may, out of such monies, allow to his and their co-trustee and trustees, all costs, charges, damages and expences, which they or any of them fhall or may refpectively fuftain, expend, difburse, be at, or be put unto, in or about the execution of the trufts hereby in them repofed, or any of them, or in be regulated as any wife relating thereto, the allowance of which between foli- colts fhall be regulated by the methods practifed and not as be- between folicitor and client, and not as between and party party. WHEREAS, under and by virtue of an in- Recitals denture of bargain and fale, bearing date the --day of the month of — laft, enrolled in his majesty's court of common pleas at Westminster, and made, or expreffed to be made, between the faid T. T. of the fourth part; and under and by virtue of two common recoveries fuffered in Trinity term now laft paft, in his majefty's faid court of common pleas, in pursuance of an agreement for that purpofe contained in the said indenture, the manor, and other hereditaments after mentioned to be hereby limited, appointed, granted and released, by the faid T. SETTLE- trufts, and for fuch intents and purposes, and charged and chargeable in fuch manner, and fubject to and by, with and under fuch powers, and fuch conditions, provifos, limitations, declarations and agreements, as the faid T. H. the father and T. H. the fon, at any time or times hereafter, during their joint lives, by any deed or deeds, inftrument or inftruments, in writing, with or without power of revocation, to be fealed and delivered by them in the prefence of, and attefted by two or more credible witneffes, fhall jointly direct, limit, or appoint, of or concerning the fame, or of or concerning any part or parcel thereof. AND WHEREAS, the faid T. H. the father is feifed of the lands, and other hereditaments hereinafter mentioned to be hereby released by him the faid T. H. alone, for an estate of inheritance in fee fimple, in poffeffion, free from all incumbrances. AND whereas, a marriage hath been agreed upon, and is intended to be shortly had and folemnized, between the faid T. H. the fon and T. F. AND whereas, the faid T. H. the father and T. H. the fon, did, upon the treaty for the faid intended marriage, agree (amongst other things) to execute the power of appointment fo limited or referved to them, with respect to the manor and other hereditaments comprised in the faid recited indenture and common recoveries as aforefaid, and to fettle and affure the fame manor, and other hereditaments, with their rights, members, and appurtenances, in manner hereinafter mentioned. AND the faid T. H. the father did also agree to fettle and affure the lands, and other hereditaments, of which he is fo feifed in fee fimple, as aforefaid, with their appurtenances, in manner hereinafter mentioned. Now THIS Indenture wit- INDENTURE WITNESSETH, that in confideration of neffeth the faid intended marriage, and of the portion or fortune of the faid T. F. which, with the privity,

H. the fon, purfuant to, and by force and virtue, and in exercife and execution, of the power and authority fo given, limited, or referved to them, by the fame indenture of bargain and fale and common recoveries, as aforefaid, and of all other powers and authorities whatsoever, enabling them in this behalf, Do, by this deed or inftrument in writing, fealed and delivered by them in the prefence of and attested by the two credible perfons whofe names are intended to be indorfed hereupon, as witneffes to the fealing and delivery of these prefents by the faid T. H. the father, and T. H. the fon, jointly, direct, limit, and appoint, that the recoveror named in the faid indenture of bargain and fale and common recoveries, and his heirs, and all and every other person and perfons who is or fhall be feifed of the manor, and other hereditaments comprised therein, or any of them, or any part thereof, shall stand and be feifed of the fame; and the faid common recoveries, and all other conveyances and affurances of the faid manor, and other hereditaments, or any part thereof, fhall be and enure; and that the faid manor, and other hereditaments, and every of them, and every part and parcel thereof, with their rights,

SETTLE- members, and appurtenances, and the reverfiont and reverfions, remainder and remainders, rents, iffues, and profits thereof, fhall from henceforth remain, continue, and be, To the ufes, upon and for the trufts, intents, and purposes, and with, under, and fubject to the powers, provifos, and agreements hereinafter limited, declared, and contained of and concerning the fame. AND THIS Further wit. INDENTURE FURTHER WITNESSETH, that for the confiderations aforefaid, and in purfuance and further performance of the agreements fo entered into by the faid T. H. the father and T. H. the fon, as aforefaid, fo far as the fame relate to the manor, and other hereditaments, comprifed in the faid indenture of bargain and fale and common recoveries, and in confideration of the fum of 10s. of lawful money of Great Britain to each of them the faid T. H. the father, and T. H. the ther and T. H. fon, paid by the faid J. T. and B. F. 'at or imand convey un- mediately before the fealing and delivery of these to the fad J. T. prefents, the receipt whereof is hereby acknowledged, they the faid T. H. the father, and T. H. the fon, have, and each of them hath granted, bargained, fold, aliened, released, and confirmed, and by these presents do, and each of them doth grant, bargain, fell, alien, release, and confirm, unto the faid 7. T. and B. F. (in their actual poffeffion now being by virtue of a bargain and fale to them thereof made by the faid T. H. the father and T. H. the fon, in confideration of 5 S. a-piece by indenture bearing date the day next before the day of the date of thefe prefents, for the term of one whole year, commencing from the day next before the day of the date of the said indenture of bargain and fale, and by force of the ftatute for transferring uses into poffeffion), and their heirs, all, &c. and all and fingular other the meffuages, lands, tenements, rents, fervices, woods, wood grounds, wood oats, dues of hens,
