GENERAL ORDER, DATED 12TH OCTOBER, 1866, AS TO CHARGING EXPENSES UNDER THE SANITARY АСТ, 1866. MODE OF CHARGING To the GUARDIANS OF THE POOR of each of the concern. WHEREAS, by the "Sanitary Act, 1866," it is among other things enacted, that in Ireland the "Sewer Authority," as defined by the provisions of that Act, shall be also the "Nuisance Authority" for executing the Nuisances Removal Acts: And whereas the Sewer Authority in Ireland for all places not under another Sewer or Nuisance Authority is, by the provisions of the said Sanitary Act, 1866, defined to be the Board of Guardians of the Union in which each such place is situate: And whereas by the provisions of the said Sanitary Act the Sewer Authority may appoint one or more Committees consisting wholly of its own members or partly of its own members, and partly of such other persons contributing to the rate or fund out of which the expenses incurred by such Authority are paid, and qualified in such other manner as the Sewer Authority may determine : And whereas by the provisions of the "Nuisances Removal Act for England, 1855," it is among other things enacted, that the Nuisance Authority may appoint any Committee of its own body to receive notices, take proceedings, and in UNDER SANI- General 12 Oct. 1866. MODE OF CHARGING all or certain qualified respects to execute the said EXPENSES Act, and the provisions of the said Act are now UNDER SANI- extended to Ireland : TARY ACT. General Order: And whereas by an Order under our Seal, bearing date the twenty-fifth day of August in 12 Oct. 1866. the present year, it is directed that when cholera is in any union the Committee of Management of each dispensary district shall be the Sanitary Committee for that district for carrying out the purposes of the Diseases Prevention Act: And whereas by the provisions of the "Sewage Utilization Act, 1865," it is among other things provided that the expenses incurred in carrying | out that Act in any town or village for which the Guardians are the Sewer Authority, shall be charged only on the electoral division in which such town or village is situate, and it is therefore not necessary to make any Order in that behalf; but by the Sanitary Act, 1866, it is provided that the expenses incurred under the Nuisances Removal Act, and likewise the expenses incurred under the Diseases Prevention Act, shall be charged to the union or any electoral divisions thereof, in such manner as the Poor Law Commissioners shall, from time to time, by General Orders applicable to classes of cases, or by Order in any particular case, direct : Now therefore, we, the Commissioners for administering the Laws for Relief of the Poor in Ireland, do hereby order that all expenses incurred by the Board of Guardians as a Nuisance Authority, whether directly by the Board itself, or through the agency of any Committee appointed as aforesaid, shall be charged upon the electoral division within and for which such expenses shall have been incurred, unless we shall by special Order in any particular case otherwise direct, and in that case such expenses shall be charged as we shall in the said special Order direct: The Order here referred to is not now in force, the Order of the Privy Council, under which alone it could be issued, having expired.
