GENERAL ORDER, DATED 28TH FEBRUARY, 1867, PRESCRIBING FORM OF CONTRACT FOR MEDICAL AND SURGICAL SUPPLIES. To the GUARDIANS OF THE POOR of the several concern. WHEREAS by a General Order under our Seal, bearing date the nineteenth day of January, 1852, for regulating the meetings and proceedings of Boards of Guardians in Ireland, we, the Commissioners for administering the Laws for Relief of the Poor in Ireland, have, among other things, ordered and directed as follows: "ARTICLE 16. All contracts to be entered into on behalf of the union, relating to the maintenance, clothing, lodging, employment, or relief of the poor, or for any other purpose relating to, or connected with, the general management of the poor, shall be made and entered into by the Guardians." "ARTICLE 21. The contracts shall be in such form as the Commissioners may, from time to time, prescribe or approve, if any form shall have been prescribed or approved for that purpose by the Commissioners." And whereas by another General Order under our Seal, prescribing General Rules and Regulations for the Government of Dispensary Districts, and bearing date the sixteenth day of December, 1853, we have, among other things, directed as follows: "ARTICLE 26. General Order: ments of each dispensary in the union, from time to time, and the requisition of the Committee of Management thereon, cause the necessary supplies to be immediately furnished for the use of such dispensary district. And whereas it appears to us to be expedient 28 Feb. 1867. to prescribe a special form of contract to be entered into by persons undertaking to supply to the Board of Guardians for the use of a workhouse or dispensary in any union in Ireland, drugs, medicines, and medical and surgical appliances, so as to insure, as far as possible, the supply of articles of a proper quality: Now therefore, in exercise of the powers and authorities vested in us under the provisions of the Acts in force for the Relief of the Poor in Ireland, we do hereby order and direct that in making contracts for the supply of drugs, medicines, and medical and surgical appliances for the use of a workhouse or dispensary in any union in Ireland, the Guardians of such union shall adopt and make use of the form of contract hereinafter set forth : And we do hereby further order and direct that the person or persons so contracting shall be required to enter, with two sureties who may be approved by the Board of Guardians, into a bond according to the form of bond annexed to the said form of contract, in such penal sum as the Board of Guardians shall think fit, conditioned for the due performance of the contract. FORM OF CONTRACT AND BOND HEREINBEFORE Contract for Supplies of Drugs, Medicines, and Medical and of to the day of MEMORANDUM OF AGREEMENT, made the Poor of the dag day of between of the one part, and the Guardians of the Union, of the other part. It is hereby agreed by and between the said parties hereto; payments to be made to hereby contract with the Guardians of the Poor of the Union, that the day of the said as hereinafter mentioned, shall and will, from until the day of next, FORM OF CONTRACT FOR MEDI CAL AND SURGICAL General inclusive, serve, supply, and deliver, or cause to be delivered, SUPPLIES. free of all expense, at in the said union, at such times, and in such manner as the said Guardians, or their clerk, or other officer of the said union, duly authorized by 28 Feb. 1867. them, shall from time to time direct, the articles hereinafter mentioned and described, in such quantities as shall from time to time be required by the said Guardians, and at and after such rates or prices as in the list hereinafter enumerating the said articles, are set forth: And they, the said Guardians of the Poor of the Union aforesaid, do hereby agree, that in case the said shall well and truly serve, supply, and deliver the articles aforesaid, upon the terms and in manner aforesaid, according to said agreement, they, the said Guardians Union, shall and will well and of the Poor of the truly pay or cause to be paid to the said and of which a bill of particulars shall have been sent at the time or articles as shall or may from time to time be supplied or will thereupon take back such rejected article or articles, and FORM OF CONTRACT FOR MEDI CAL AND SURGICAL SUPPLIES. General As their clerk, or other officer duly authorized by them, or in case such article or articles as shall or may be found and decided by such referee as aforesaid, not to be in every respect of good quality or of the sort contracted for, shall not have been so taken away and replaced by the said hereinbefore provided, or in case such article or articles, or any of them, shall be deficient in the weight, size, measure, 28 Feb. 1867. or quantity, stated and charged for in such bill of particulars, or if the same shall be delivered without such bill of particulars, they, the said Guardians, or their clerk, or other officer so authorized by them, shall be at liberty to return the same at the expense of the said contractor, or give notice for the same to be sent for and fetched away by and that in every such case the said Guardians, or their clerk, or other officer so authorized by them as aforesaid, may purchase a fresh supply of such articles, or of such other articles in lieu thereof, as the said Guardians, or their clerk, or other officer so authorized as aforesaid, shall think fit, or employ any other person or persons to furnish a fresh supply of such first-mentioned articles or of such other articles in lieu thereof, as aforesaid, in such a manner as may be required during the period of the said contract, or any part of such period in the place of the said And it is hereby further agreed that in case such first-mentioned articles shall not be duly served, supplied, and delivered in such quantities as shall from time to time be required by the said Guardians, then in every such case, and as often as it shall so happen, the said Guardians, or their clerk, or other officer so authorized as aforesaid, may purchase from any other person or persons other than such a supply of the said first-mentioned articles, as shall be necessary to complete the quantity required, or to purchase and provide such quantity or quantities of any other article or articles, directed by the said Guardians to be used instead of the said first-mentioned articles, as shall be considered necessary by the said Guardians to supply such deficiency, and that in any and every of such cases the said executors and administrators, shall bear and make good all charges and expenses of such articles so to be provided, over and above the price at which such first-mentioned articles are herein before contracted to be supplied and delivered by the said And also that the said Guardians of the Poor of the Union may retain and apply any sum of money which may be due to the said under and by virtue of this agreement, at the time of any failure in the performance hereof, to the payment of such charges and expenses, as the said Guardians may incur, or be put to by reason thereof. And that, notwithstanding the agreement hereinbefore contained for making good the articles which shall not be served, supplied, and delivered according to the terms hereinbefore agreed on and in pursuance of this Contract, the said Guardians of the Poor of the Union may put in suit the bond to be given for the performance of this contract, of even date herewith, against the said |
