Bargain and Sale of Monies for fecuring an Annuity.

THIS INDENTURE made, &c. between F. L. of

and M. F. his wife, late M. F. L. widow and relict of L. C. of -, deceased, of the one part, and D.C. of, of the other part. WHEREAS the faid L. C. deceased, in his life time, and at the Recital of will. time of his death, was feifed, poffeffed of, and entitled unto divers freehold, copyhold, and leasehold eftates, and alfo a confiderable perfonal eftate, and being fo feifed and poffeffed, did, in or about the month of, duly make and publish his last will and teftament, in writing, and thereby amongst other things did bequeath to his wife M. F. L. now the wife of the faid F. L. in lieu of fettlement, if she should furvive him the said teftator, during her natural life, his leafehold house in, and to enable her to live comfortably, therein he willed that his executors should

M.F. L. had taken upon themselves the execu-
tion thereof. And further reciting, that the
faid M. F. L. had made her election to take under
the will of the faid L. C. deceased, and to take
and accept the gifts and bequests, and power
thereby to her made, given, and reserved, in lieu
of provifions made and provided for her by a cer-
tain indenture or deed of fettlement, made prior
to her marriage, bearing date the — day of

fourth part of a thirty-fixth part of and in the

C. parties thereto, and C. S. and were then standing in their names at the books kept at the Eaft India House and Bank of England. It is by the faid indenture now in recital witneffed, and agreed, and declared, by and between the said parties thereto, that the faid fhare in the works, &c. were fo respectively conveyed, affigned, affured and transferred, unto the said M. I. and L. C. parties thereto, and C. S. as aforefaid, upon truft, that they, and the furvivors and furvivor of them, and the heirs, executors, and administrators, of them, fhould, during the life of the faid M. F. L. receive all the rents, iffues, and profits, dividends and annuities thereof, and thereout pay, or cause to be paid, unto the faid M. F. and her affigns, during her life, as and for the yearly fum of, by the faid will of the faid L. C. deceased, ordered, and directed, to be paid to her the faid M. F. L. during her natural life, as aforefaid, one annuity or yearly fum of, of lawful money of Great Britain, by four equal quarterly payments, on or at the days or times thereinafter mentioned, (that is to fay,) in every year, without any deduction or abatement, the first quarterly pay- of fettlement ment thereof to begin and be made on - then in- of £ftant. ture, and alfo reciting that a marriage was intended to be (and which was foon after,) had between the faid F. L. and M. F. L. it was witneffed, that in confideration of the then intended marriage, and for other confiderations, fhe the faid M. F. L. with the confent and approbation of the faid F. L. did grant, bargain, fell, and affign, unto the faid E. F. and A. I. their executors, administrators, and affigns, the faid annuity or yearly fum of, payable to the faid M. F. L. and her affigns, for her life, and all powers and remedies for recovering the fame, and enforcing payment thereof, to hold, receive, and take the faid annuity thereby affigned unto the faid E. F. and A. I. their executors, adminiftrators, and affigns, during the joint lives of the faid M. F. L. and F. L. upon truft for the faid M. F. L. until the faid then intended marriage should be had, and after the folemnization thereof, upon truft, that they the faid E. F. and A. I. and the furvivor of them, and the executors, administrators, and affigns, of fuch furvivor fhould receive and take the faid annuity or yearly fum of— as the fame fhould from time to time grow due and thereout, in the firft place, from time to time, during the joint lives of the faid F. L. and F. M. L. pay, or caufe to be paid, into the proper hands of the said M. F. L. for her own fole and separate use and benefit, or to fuch perfon or perfons as the in writing, figned with her proper hand, fhould, notwithstanding her faid intended coverture, from time time, direct or appoint the clear annual fum of of lawful money of Great Britain, and that from time to time her receipt alone, or the receipt or receipts of fuch perfon or perfons as fhe fhould appoint to receive the fame, fhould be a good and fufficient difcharge for the fame, or fo much thereof as fhould be therein acknowledged, or expreffed to be received, upon further trust that
