S. C. 842), as submitted by the Treasury Department.

Since no appropriation for the payment of this claim is provided by the above act, an appropriation for that purpose is necessary at this time, as follows:

SIR: Pursuant to the provisions of section 2 of the act of July 7, 1884 (U. S. C., title 5, sec. 266), there is enclosed for your consideration, with a view to its submission to Congress, schedule of a claim allowed by the General Accounting Office, in which case certificate of settlement has been forwarded to the Treasury Department for payment, covering judgment rendered by the United States District Court for the Western District of Washington against the collector of customs, where a certificate of probable cause has been issued, as provided for under section 989, Revised Statutes (U. S. C., title 28, sec. 842).

For the payment of this judgment there is required an appropriation under the Department of Commerce, as follows:

SIR: I have the honor to transmit herewith for the consideration of Congress an estimate of appropriation submitted by the Navy Department to pay claims for damages by collision or damages incident to the operation of vessels of the Navy, in the sum of $11,836.76, which have been considered and adjusted under the provisions of the act of December 28, 1922 (34 U. S. C. 599), and which require an appropriation for their payment.

The necessity for the appropriation asked is explained in the letter of the Director of the Bureau of the Budget, transmitted herewith, in whose comments and observations thereon I concur.

claims for damages by collision or damages incident to the operation of vessels of the Navy, which have been considered and adjusted under the provisions of the act of December 28, 1922 (34 U. S. C. 599), and which require an appropriation for their payment, as follows:

Claims for damages by collision with naval vessels: To pay claims for damages adjusted and determined by the Secretary of the Navy under the provisions of the act entitled "An act to amend the act authorizing the Secretary of the Navy to settle claims for damages to private property arising from collisions with naval vessels," approved Dec. 28, 1922, as fully set forth in Senate Document No. Seventy-eighth Congress_

$11, 836. 76 The letters of the Navy Department submitting these claims are transmitted herewith.

In accordance with the provisions of the act providing for these submissions, I recommend that this estimate be transmitted to Congress.

Code, section 599, I have considered, ascertained, adjusted, and determined the following described claim for settlement, which accrued after April 6, 1917, on account of damage to privately owned property where the amount of the claim does not exceed $3,000, caused by negligence of a vessel of the United States.

This claim has been examined by the Judge Advocate General of the Navy, who has advised that it is a legal claim for submission under the act above referred to.

I, therefore, certify the amount found due the claimant, as set forth, to be a legal claim and recommend that it be submitted to the Congress for payment out of an appropriation that may be made therefor:

Claim of Henry Mello, Jr., Rural Free Delivery, Wakefield, R. I., for damage to fishing boat Alice and Nellie caused by the United States Navy pontoon crane barge on April 9, 1944.

The total amount claimed and allowed is $54.

ascertained, adjusted, and determined the following described claim for settlement which accrued after April 6, 1917, on account of damage to privately owned property where the amount of the claim does not exceed $3,000, caused by negligence of a vessel of the United States. This claim has been examined by the Judge Advocate General of the Navy, who has advised that it is a legal claim for submission under the act above referred to.

I, therefore, certify the amount found due the claimant, as set forth, to be a legal claim and recommend that it be submitted to the Congress for payment out of an appropriation that may be made therefor: Claim of Board of State Harbor Commissioners, Ferry Building, San Francisco, Calif., for damage to windows between piers 35 and 37, San Francisco, Calif., caused by the U. S. S. LST-481 on September 19, 1943. The total amount claimed and allowed is $14.89.

The total amount claimed is $3,741.17. The total amount allowed is $3,000.
