A BILL To prevent the manufacture, shipment, and sale of adulterated or

misbranded food, drink, drugs, and cosmetics, and to regulate traffic therein; to prevent the false advertisement of food,

drink, drugs, and cosmetics; and for other purposes. 1 Be it enacted by the Senate and House of Representa

tives of the United States of America in Congress assembled,

SECTION 1. That this Act may be cited as the “ Federal Food, Drugs, and Cosmetic Act.”

SEC. 201. As used in this Act, unless the contost

The term “food " includes all substances and preparations used for, or entering into the composition of, food, 3 drink, confectionery, or condiment for man or other animals.

(b) The term “ drug”, for the purposes of this Act 5 and not for the regulation of the legalized practice of the 6 healing art, includes (1) all substances and preparations rec7 ognized in the United States Pharmacopæia, Homeopathic 8 Pharmacopoeia of the United States, or National Formulary 9 or supplements thereto; and (2) all substances, preparations,

and devices intended for use in the cure, mitigation, treat

ment, or prevention of disease in man or other animals; and

(3) all substances, preparations, and devices, other than

13 food, intended to affect the structure or any function of

15 (c) The term cosmetic " includes all substances and 16 preparations intended for cleansing, or altering the appear17 ance of, or promoting the attractiveness of, the person. 18 (d) The term “ Territory

Territory ” means any Territory or 19 possession of the United States, including the District of

21 (e) The term “interstate commerce means (1) 22 commerce between any State or Territory and any place 23 outside thereof, and (2) coinmerce or manufacture within

the District of Columbia or within any other territory not 25 organized with a legislative body.

5 (h) The term "label" means the principal display 6 or displays of written, printed, or graphic matter (1) upon 7

any food, drug, or cosmetic, or the immediate container 8 thereof, and (2) upon the outside container or wrapper, 9 if any there be, of the retail package of any food, drug, or

(i) The term “labeling” includes all labels and other 12 written, printed, and graphic matter, in any form whatso13

ever, accompanying any food, drug, or cosmetic. 14 (j) The term “advertisement

advertisement" includes all represen15 tations of fact or opinion disseminated in any manner or by 16 any means other than by the labeling. 17 (k) The term “medical profession'

means the 18 legalized professions of the healing art; and the term 19 medical opinion ” means the opinion within their respec20 tive fields, of the practitioners of any branch of the healing 21 art, the practice of which is licensed by law in the jurisdiction 22 where such opinion is placed in issue in any proceeding under

23 this Act.

24 (1) The term official compendium " means the 25 United States Pharmacopoeia, Homeopathic Pharmacopeia
