for granting life-annuities, (except annuities by will, marriage fettlement, or for the advancement of a child, and annuities fecured on fee-fimple or fee-tail lands of equal value, or on stocks of greater value actually transferred; or voluntary annuities, or annuities granted by corporations, by parliament, or laftly, annuities under Iol. per annum) which memorial is to contain the date, names of the parties, and witnesses.

The acts require only the dates, perfons names, additions, parcels, witnesses names, and their additions and places of abode, to be contained in the memorial; but it is ufual to make a short recital of the tranfaction.

Where there are more deeds than one to perfect a conveyance or fecurity, the lands, &c. need not be set forth in each memorial; but being described in one of them, may be referred to by the rest.

These memorials are to be on vellum or parchment, and to be figned and fealed in the common form by one of the grantors or grantees, his or their executors, adminiftrators, guardians or trustees, and attefted by two witneffes; and one of the witneffes to the deed must be a witness to the memorial, who is to make oath to the due execution of both before the register, and also produce the deed, grant or will at the fame time.

The reasons upon which these acts proceed, (though their policy has been doubted, fee 2 Black. Com. 343) are to guard against “ fraudulent charges and incumbrances, fince the difufe of the old Saxon cuftom of transacting all conveyances at the county court, and entering a memorial thereof in the chartulary or legerbook of fome adj cent monaftery.” Ib. and Co. Lit. 237.

Of a leafe for a year.

A memorial to be registered, pursuant to an act of parliament made in the feventh year of the reign of her late Majesty Queen Anne, intitled, an act for the public regiftering of deeds, conveyances, wills and other incumbrances which fhall be made, or that may affect any honours, manors, lands, tenements, or hereditaments, within the county of Middlefex, after the nine and twentieth day of September, one thousand feven hundred and nine.

Note. When the conveyance is accompanied by a bargain and fale, the memorial of the bargain and fale is ufually engroffed upon the fame fkin with the leafe and release, and where there is an affignment of a term, it follows the bargain and fale, one defcription of the premises being fufficient to regifter all the four deeds, as in the following precedent.
