a court for determining the private, right of foil withis the territory weftward of the Delaware, formerly in controversy between the ftates of Connecticut and Pent sylvania, and appointing the fourth Monday in June next, for the appearance of the parties by their lawful agents before Congress or a committee of the ftates be, and it is hereby fufpended, until Zebulon Butler, and the other petitioners claimants as aforesaid,exhibit to Congreso 1 committee of the ftates, fchedules particularizing their claims. Refolved, That the parties claimants as aforefaid beinformed that their appearance by their agents before Congress or a committee of the ftates as specified by the refulation of Congress of the 23d day of January laft, will not be neceffary until the further determinations of Congress or a committee of the states, in the premises be made known to them.

A motion was made by Mr. Howell, feconded by Mr. Montgomery, that the foregoing motion be committed And on the question for commitment, the yeas and nays being required by Mr. Hand.

According to the order of the day, Congrefs proceedeil to the election of two, commiffioners to negotiate with the Indians, in the room of Mr. S. Higgenfon and Mr. N. Greene, who have declined that office; and the ballots being taken,

Mr. Benjamin Lincoln, and

Mr. Arthur Lee were elected.

Congress affembled-Present eleven ftates as before. A motion was made by Mr. Howell, feconded by Mr. Gerry,

That the prefident be, and he hereby is authorized and directed, to adjourn Congrefs on the third day of June next, to meet on the thirtieth of October next at Trenton, for the dispatch of public bufinefs; and that a committee of the states shall be appointed to fit in the recess of Congrefs.

A motion was made by Mr. M'Henry, feconded by Mr. Spaight, to poftpone the confideration of the foregoing motion, in order to take into confideration the report of a committee confifting of Mr. Jefferson, Mr. Ofgood and Mr. Sherman, to whom was referred a report on the powers with which a committee of the states should be vefted during the recefs of Congress, and a motion on the fame fubject, which report is as follows.

That the committee of the ftates which shall be appointed purfuant to the 9th article of confederation and perpetual union to fit in the recefs of Congress, for tranf acting the bufinefs of the United States, fhall poffefs all the powers which may be exercised by feven states in Congress affembled ; except thofe of fending ambaffadors, minifters, envoys, refidents or confuls-Establishing rules for deciding what capturs by land or water fhall be legal, and in what manner prizes taken by land or naval forces

in

in the service of the United States, fhall be divided or appropriated-Establishing courts for the receiving and determining finally appeals in cafes of capture-conftituting courts for deciding difputes and differences arifing between two or more ftates-Fixing the ftandard of weights. and measures for the United States-changing the rate of poltage on the papers paffing through the poft-office eftablished by Congrefs, and of repealing or contravening any ordinance paffed by Congress.

That nine members fhall be requifite to proceed to bufinefs.

That no queftion, except for adjourning from day to day, fhall be determined without the concurrence of se

That the prefident of Congress, if a member of the said. committee, and if not a member, or if abfent at any time, then a chairman to be chofen by themfelves fhall prefide; the prefident or chairman retaining a right to vote.

That the fecretary and other officers of Congress fhall attend on the faid committee.

That they fall keep an accurate journal of their proceedings, to be laid before Congrefs; and that in thefe journals fhall bs entered the yeas and nays of the members when any one of them fhall have defired it before the question be put.

On the question to poftpone for the purpose abovementioned, the yeas and nays being required by Mr. M'Henry.

A motion was then made by Mr. Williamfon, feconded by Mr. M'Henry, to amend the motion of Mr. Howell, by adding thereto," provided a committee of the lates fhall first have been appointed to fit in the recess of Con grefs, and the powers defined with which the said com¬ mittee fhall be vested, according to the tenth of the ar ticles of confederation."

And on the question to agree to this amendment, the yeas and nays being required by Mr. Williamfon.

A motion was then made by Mr. M'Henry, feconded by Mr. Mercer, to poftpone the further confideration of the motion under debate, in order to take up the following.

That as foon as a proper place fhall be reported by the committee appointed to view and report a proper place for a federal town at or near Georgetown, on the Poto mack, and the soil and jurisdiction obtained as well for the town on Potomack as that on Delaware, Congrels will forthwith proceed to erect fuch public buildings as may be neceffary for their feffions, at the expence of the United States, out of the common treasury thereof that the foundations of the faid buildings thall be laid at the fame time, and no funt of money appropriated for the one, unless an equal fum be appropriated for the other.
