RULES AND REGULATIONS

OF THE

HEALTH DEPARTMENT

OF THE

CITY OF NEW YORK.

Meetings.

1. THE regular meetings of the Board of Health of the Health Department shall be held on Wednesday in each week, at one o'clock P. M., unless otherwise ordered.

2. Special meetings of the Board may be held at three o'clock P. M. on Monday and Saturday of each week, for the transaction of business requiring prompt attention. At such special meetings no ordinance or regulation shall be made, repealed, or changed; no officer, clerk, or agent shall be dismissed, employed, or have his term extended, or his compensation diminished or increased; no final order (under the first clause of section 14, chapter 74, Laws of 1866, relating to orders), or order of arrest shall be made; no money or compensation exceeding two hundred and fifty dollars shall be voted or allowed, and no action shall be taken upon any measure or matter touching the general policy or duty of the Board, or of its officers, except to refer the same to the next meeting of the Board, unless eight members are present, and all the members of the Board shall have been specially notified of such meeting, and the intention to take action on some matter aforesaid.

3. Special meetings may be called at any time by the Sec

retary, when requested by the President, or a majority of the members, specifying the object of the meeting.

4. No notice shall be required for meetings referred to in sections one and two, but three hours' notice of special meetings shall be given personally, or left at such place as the members may severally designate.

Appointments and Transfers.

5. No appointment or transfer of any clerk or subordinate shall be made, except by the Board, on the recommendation of the appropriate committee.

Committees.

6. Standing and Special Committees shall (unless other wise ordered by the Board) be appointed by the President. 7. The Standing Committees shall be as follows:

(1) A Committee on Sanitary Matters, Disinfectants, Chemical Researches, and Supplies for the same, to consist of four members, to be called the Sanitary Committee. Two members of this Committee shall constitute a quorum for the transaction of its busi

ness.

(2) A Committee on Vital Statistics, to consist of three members.

(3) A Committee on Permits, to consist of three members.

(4) A Committee on Street Cleaning, to consist of three

members.

(5) A Committee on Finance, to consist of three mem

bers.

(6) A Committee on Law and Ordinances, to consist of three members.

To the Sanitary Committee shall be referred all subjects of a scientific or medical nature, and it shall have supervision of the Bureau of Sanitary Inspection, the Chemical Depart

ment, the Disinfecting Corps, and shall furnish the supplies for the same. This Committee shall not authorize any liability or expenditure, on the part of the Board, exceeding five hundred dollars in the aggregate, without the previous vote of the Board. They shall make a written report to the Board, monthly, of all supplies authorized or purchased, and of all expenditures authorized or made by the Committee, stating the kind, amount, and prices of such supplies, and from whom obtained or authorized, and the items of said expenditures.

To the Committee on Vital Statistics shall be referred all matters appertaining to the Bureau of Records of Vital Statistics, and it shall have supervision of its labors and operations.

To the Committee on Permits shall be referred all matters appertaining to the Sanitary Permit Bureau, and it shall have supervision of the labors and operations of said Bureau.

To the Committee on Street Cleaning shall be referred all that belongs to the subject of Street Cleaning, and it shall have special charge of the Bureau of Street Cleaning.

To the Committee on Finance shall be referred all questions in respect to expenses and salaries, and the procuring of supplies other than those given in charge of the Sanitary Committee; it shall audit all bills and superintend the offices of the Secretary, Chief Clerk, and their assistants.

To the Committee on Law and Ordinances shall be referred all matters and subjects of law and ordinances, and it shall have direction of the examination or hearings, and in conjunction with the counsel of the Board have charge of all suits and litigations.

It shall also be the duty of said Committees to examine and report upon all cases of remissness in the performance of duty by any officer or clerk of their respective Bureaus and all cases in which any such officer or clerk has been guilty of any conduct that they may think impairs his usefulness in the service of the Board, and on all changes they

think would promote economy or efficiency in the respective Bureaus.

8. The President and the Mayor shall be ex-officio members of all Standing Committees.

9. No expense shall be incurred by any officer or employé of this Board, without an order of the Board, or the written approval of a majority of the Committee having charge of the supplies, and until the same has been entered upon the books of the Secretary.

Order of Business.

10. The following shall be the order of business at meetings of the Board:

1. Reading of minutes.

2. Reports from attorney and counsel.

3. Reports of standing committees.

4. Report of special committees.

5. Communications from Chiefs of Bureaus.

6. Communications from the Board of Police.

7. Communications of importance from all other

sources.

8. Resolutions and orders.

9. Unfinished business.

10. New business.

11. All resolutions shall be submitted in writing.

Oath of Office.

12. All officers appointed by this Board shall take the constitutional oath of office.

Authentication.

13. Except in the cases where a different mode of authentication is required by the rules or regulations of this Board, or by law, all orders made, or that may be made, by this Board, may be authenticated by adding to a copy of

such order the words "a true copy," and by the signature thereunder of the name of the Secretary of this Board by such Secretary, or of the name of the Chief Clerk by such Chief Clerk.

Reports under Oath.

14. Before any order be made under the 14th section of chapter 74, Laws of 1866, the report or reports, on which the same is to be founded, shall be sworn to by the persons making the same.

Hearings.

15. The power of the President to suspend the execution of an order shall only extend to its suspension until the next meeting of the Board, when every suspension since the last meeting shall be by him reported to the Board and entered on its minutes. No suspension shall be of any effect unless the same be in writing upon the order suspended, and a note of such suspension shall be at the same time entered upon the record of such order in the books of the Board.

In all proceedings under the 1st subdivision of Section 14 of Chapter 74, of the Laws of 1866, where the person or persons served, or intended to be served, with the order made thereunder, shall, within the time limited, apply to the Board, or to the President thereof, to have said order, or its execution, stayed or modified, the following proceedings shall be had, save in cases of imminent danger from impending pestilence. The person or persons so applying shall, unless the Board otherwise direct, appear, and make their proofs before such officers as in any given case the Board may direct, and the said officers are hereby appointed persons, and authorized to take, any and all proofs, affidavits, and examinations, as to any matters under Chapter 74 of the Laws of 1866. Such appearance shall be at the office of the Board, at No. 301 Mott Street, New York, at 10 o'clock of the forenoon of the day succeeding such application; the applicant shall produce
