AN ACT

To provide for the ordinary expenses of the Government, and for other purposes.

Money how paid.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, no money shall be paid out of the state treasury other than is hereby appropriated: Provided, however, That nothing herein contained shall affect or repeal so much of the provi-Proviso. sions of the act of eighth April, one thousand eight hundred and fortythree, entitled "An Act to provide for the payment of the domestic creditors, the sale of state stock, and for other purposes," as provides for the payment of the domestic creditors of this commonwealth, for the payment of so much of the interest on the funded debt of this commonwealth, as is provided for in the act passed the seventh day of March, one thousand eight hundred and forty-three, and for the ordinary repairs upon the finished lines of canals and railroads.

Third.—To military expenses, twenty thousand dollars: Provided, That after the passage of this act, no compensation shall be allowed to any militia company for music for company, battalion and regimental training, except three dollars to the commanding officer of any battalion or regiment for music to his respective battalion or regiment; that all delinquents shall pay the sum of fifty cents per day, for every day absent on such company, battalion or regimental training: And provided fur- Proviso. ther, That each volunteer company, lawfully organized, in this commonwealth, shall be entitled to one bass and one tenor drummer and one Volunteers. fifer for four days in each year at one dollar per day each; and so much of the fiftieth section of the act of second of April, one thousand eight hundred and twenty-two, entitled "An Act for the regulation of the Parts of former militia of this commonwealth," and of the seventh section of the act of law repealed. the tenth of April, one thousand eight hundred and twenty-six, entitled "A further supplement to the act, entitled An Act for the regulation of the militia of this commonwealth,' as authorizes the payment by the state treasurer, on the draft of the auditor general, for the balance of the accounts of the brigade inspectors of this commonwealth, be and the same is hereby repealed: Provided, That this section shall not be so construed as to prevent the auditor general from drawing his warrant on the state treasurer, in favor of any brigade inspector for any balance which may be due in compensation for his own services: And provided Further proviso.

further, That this provision shall not apply to amounts now actually due and unpaid to said brigade inspectors.

Fourth. To universities, colleges, academies and female seminaries, twenty-three thousand five hundred dollars, being one-half of the amount heretofore appropriated, and excepting the amount herein directed to be paid during the present year; all laws heretofore passed directing certain sums to be paid annually to said colleges, academies and female seminaries, be and the same are hereby repealed.

Five. To common school purposes, two hundred and fifty thousand dollars.

Sixth. To the house of refuge, five thousand dollars.

Seventh. To the institution for the instruction of the blind, eight thousand dollars, payable semi-annually.

Eighth. To the institution for the instruction of the deaf and dumb, eleven thousand dollars, payable semi-annually.

Ninth. To the repair and keeping in order of the public grounds at the seat of government, three hundred dollars.

Tenth.-To the state library, two thousand dollars: Provided, That said sum of two thousand dollars shall be drawn from the treasury upon the warrant of the governor, in favor of the chairman of the library committee, after which the accounts for the said money shall be audited Further proviso. and settled by the auditor general: Provided further, That no part of the appropriation to the state library shall be expended in the purchase of books or maps, until the whole amount of the present outstanding State library and debts against the library shall have been paid; and that three hundred dollars of said sum be and hereby is appropriated to the late state librarian, in addition to his salary now due.

Eleventh.-To the payment of the Nicholson court and commissionand commission- ers, and the printers bills for advertising said lands, (by order of the commissioners,) which printers bills shall be first paid, four thousand five hundred dollars; to be paid out of the compromise of the sales of the lands of Peter Baynton and John Nicholson, against which the State has a lien; and that the state treasurer is hereby authorized to refund to Certain moneys Greenwood Bell, Abraham Hartsock, Thomas Bloom, Caleb Way and Robert Askey, the money paid into the treasury by them, not exceeding in the whole one hundred and twenty dollars-and to Pearly Johnson, the money which he has paid, not exceeding seventy-five dollars; and Halstead Stark, not exceeding twenty dollars; on compromises and purchases of their farms, they being actual settlers, and by law entitled to have their bonds cancelled. And that no purchaser from the commonwealth of any of the lands sold as the property of John Nicholson, who has not prior to the seventeenth day of April, eighteen hundred and forty-three, paid the Commonwealth any part of the consideration money, shall be considered to take any title under or by virtue of said purchase. That all sales and compromises made by the commissioners, to settle the estate of John Nicholson and Peter Baynton, where deeds have not been made, are hereby declared null and void; and the state treasurer is hereby authorized to return to the persons giving the same, all the bonds in his office, together with the money paid the CommonSales at Pittsburg wealth. commissioners, purporting to lie in M'Kean county, are hereby annulled, and the treasurer shall pay back the money to the purchasers and cancel their bonds; and that the ninth section of the act, entitled "An Act to repeal the Nicholson court of pleas, and to release the lien of the com

monwealth on the estate of John Nicholson, deceased," passed the

Twelfth.-To the eastern penitentiary, eight thousand dollars. Thirteenth.-To the western penitentiary, five thousand dollars; and Western penitenthat hereafter in estimating the expenses of maintaining and keeping tiary. convicts in the eastern and western penitentiaries, it shall be the duty of the inspectors to include the conveying of convicts from the several counties, the salaries of the wardens, keepers and officers, and all other expenses necessarily incurred in the management of their respective institutions; and charge the same to the counties respectively from which the prisoners are sent, in proportion to the number of convicts, subject to the proper deduction on account of labor performed by such convicts. Fourteenth.-For the payment of interest on the fourth of May Interest on 4th issue, thirty thousand dollars. May issues. Geological survey

Sixteenth.-Temporary loan under the act of the fourteenth April, Temporary loan one thousand eight hundred and thirty-eight, fifteen thousand dollars. of 14th April, Seventeenth.-For the completion of geological survey, two thousand two hundred dollars; to be applied to the payment of the incidental expenses of the geological survey, including the preparation of the general cabinet collections of geological and mineralogical specimens, and the maps and drawings designed to accompany and elucidate the final report of the state geologist; and the governor is hereby further authorized to take such other measures as in his opinion the public interest may require in relation to the reception and protection of said final report, maps, drawings and cabinet collections; which sum shall be deemed and taken as full and final compensation for completing the same, as per act of fourth of May, eighteen hundred and forty-one. For continuing the meteorological observations in the several counties of this commonwealth, according to the provisions of the fourth section of the act of twenty-first March, eighteen hundred and thirty-seven, three hundred dollars: Provided, That the state geologist shall give Proviso. bond with sufficient sureties, to be approved by the governor, conditioned for the completion of the work according to existing laws.

Eighteenth.-Miscellaneous, five thousand dollars.

Nineteenth.-For the payment of lock-keepers, collectors, weigh- Lock-keepers, masters, supervisors, clerk hire, house rent, stationery, &c., on canals collectors, &c. and railroads, fifty thousand dollars.

according to the directions of the act of fifteenth April, eighteen hundred and thirty-four, entitled "An Act to fix the standards and denominations of measures and weights in the commonwealth of Pennsylvania;" and a sum not exceeding one hundred dollars, is hereby appropriated to defray the expenses that may be incurred in the performance of the duty hereby directed; and the account for such expenditure shall be settled by the accountant officers of the commonwealth, in the usual

manner.

SECTION 3. That this act shall not be so construed as in any way to affect or repeal so much of the provisions of the act of eighth of April, eighteen hundred and forty-three, entitled "An Act to provide for the payment of the domestic creditors, the sale of state stock, and for other purposes, as provides for the cancellation of relief issues on the last days of each month, respectively.

SECTION 4. That the amount of sixty thousand three hundred thirsurplus revenue teen dollars and twenty-seven cents, received from the general governfrom general gov-ment, remaining in the treasury, is hereby appropriated to the payment of the amount due upon the check-rolls on the different lines of finished canals and railroads in this commonwealth, for labor performed and materials furnished; and the same shall be apportioned to the different lines, pro rata, according to the several amounts due upon each.

AN ACT

To annul the marriage contract of Eve Hamilton and William Hamilton.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the marriage contract entered into between Eve Hamilton, of Franklin county, and William Hamilton, be and the same is hereby annulled and made void, and the parties released and discharged from the said contract, and from all legal duties and obligations arising therefrom as effectually and absolutely as if they had never been joined in marriage.

We do certify that the bill, entitled "An Act to annul the marriage contract of Eve Hamilton and William Hamilton," was presented to the governor on the seventeenth day of April, one thousand eight hundred and forty-three, and was not returned within three days after the meeting of the present legislature; wherefore, it has, agreeably to the constitution of this commonwealth, become a law in like manner as if he had signed it.
