A SUPPLEMENT

To an act, entitled "An Act to authorize the commissioners of the incorporated districts of the county of Philadelphia, to construct works for supplying said districts with water, from the Schuylkill river."

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same. That the judges of the court of quarter sessions, of the county of Philadelphia, shall, on the first Saturday in March of the present year, cause a jury to be drawn from the December list of road jurors, to assess the damThompson street, ages on Thompson street, from the Ridge road, to the Columbia and damages how as- Philadelphia railroad, as laid down on the plan of Penn township, in sessed and paid. the county of Philadelphia; and it shall be the duty of said jury, within two weeks after their appointment, to meet and view said street and assess the damages, and make their report of the same to the water commissioners of Spring Garden and the Northern Liberties, which report shall be final, and the amount of said damages shall be forthwith paid by the said water commissioners.

Commissioners to lay certain pipes.

Proviso.

SECTION 2. That the water commissioners of Spring Garden and the Northern Liberties, be and they are hereby authorized to lay pipes of conduit along the Ridge road, from Thompson street, to the northern line of Spring Garden: Provided, That the said water commissioners shall not take up any more of the said road than is absolutely necessary for the purpose aforesaid: And provided further, That all injury or damage done to the said road, shall immediately thereafter be repaired by the said water commissioners.

AN ACT

To authorize the register of wills in the county of Adams, to admit to probate the nuncupative will of Thomas M'Kee, deceased.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the nuncupative will of Thomas M'Kee, late of Liberty township, in the county of Adams, deceased, shall be admitted to probate by the register of wills of the said county; and that the estate in the said nuncupative will, devised or bequeathed, whether real or personal, shall be held, possessed, enjoyed and disposed of, by the persons to whom the same was so devised or bequeathed, their heirs and assigns, as fully and effectually as if the said nuncupative will of the said Thomas M'Kee, had been in writing, duly executed; any law or usage of this Commonwealth to the contrary notwithstanding.

AN ACT

To authorize Samuel Holstein to collect certain ground rents.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Thomas Prichett, of the city of Philadelphia, trustee of Abraham R. Prichett, Josephine Timlow, late Josephine Prichett, and Anna E. Holstein, late Anna E. Prichett, be hereby authorized and required on reasonable notice, to pay over to Samuel Holstein, assignee of the said Abraham R., Josephine and Anna E., all moneys received by the said Thomas Prichett, as trustee aforesaid, from certain rents and ground rents, with interest thereon, arising out of a certain trust or trusts, created by the last will and testament of Anna Catharine Prichett, late of said city, deceased, and by the same will directed to be laid out and expended in improving certain real estate, devised by the said will, in trust for the use of the

said Abraham R., Josephine, and Anna E., for life: And provided, That on refusal of the said Thomas Prichett, trustee aforesaid, to pay to said Samuel Holstein all said moneys, so as aforesaid authorized and required to be paid to him, the said Samuel Holstein may sue for and recover the same, as debts of the like amount are sued for and recovered by action in assumpsit, for moneys had and received for the use of said Samuel Holstein.

SUPPLEMENT

To an act authorizing the survey and regulation of a part of Penn township, in the county of Philadelphia, approved April nineteenth, one thousand eight hundred and forty-three, and for other purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the inhabitants of the district of Penn, as the same is bounded and described in the act of assembly of April nineteenth, one thousand eight hundred and forty-three, authorizing the survey and regulation of a part of Penn township, in the county of Philadelphia, be, and they and their suecessors forever are, truly constituted a corporation and body politic, in fact and in law, by the name, style and title of "the commissioners and inhabitants of the district of Penn," and by that name to have perpetual succession.

SECTION 2. That the inhabitants residing within the said described Election of com- district, who are, or who shall be qualified to vote for members of missioners, &c. assembly of this commonwealth, shall meet on the third Friday of March next, at the time and place of holding the constables' election, and elect by ballot nine commissioners, who shall be qualified voters in said district, viz: three for one year, three for two years, and three for three years; and every year thereafter they shall elect three commissioners to serve for three years; and said commissioners shall meet on the second Monday after their election, and organize by electing a president, clerk, treasurer and solicitor, and make such rules and regulations as may be necessary for their government.

SECTION 3. That said commissioners shall have all the powers, rights and privileges now possessed by the supervisors of said district, in addition to those conferred by the act of April nineteenth, one thousand

eight hundred and forty-three, and the act authorizing the election of supervisors is hereby repealed.

SECTION 4. The commissioners appointed by act of assembly, April Former commisnineteenth, one thousand eight hundred and forty-three, shall continue sioners time limiin power until the organization of the new board contemplated by this ted. act, when their power shall be vested in the new board of commissioners; and all moneys, books and papers, in the hands of the supervisors or commissioners superseded by this act, shall be handed over to the president of the said board of commissioners.

SECTION 5. That the survey, so far as made and returned, shall remain fixed and unalterable; and so much of the act of April nineteenth, one thousand eight hundred and forty-three, as requires the commissioners to give security, is hereby repealed.

SECTION 6. That so much of the act of the twenty-fourth day of Delaware
April, eighteen hundred and forty-three, entitled "A further supplement wharves.
to the act, entitled An Act to enable the mayor, aldermen and citizens of
Philadelphia to carry into effect certain improvements, and to execute
certain trusts, as requires that the assent of the commissioners of each
of the districts of Southwark, Northern Liberties and Kensington, shall
be first given, shall be and the same is hereby so modified as to require
the assent of the commissioners of a majority of said districts only to
be first given.

AN ACT

To authorize the commissioners of Philadelphia county to borrow money.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the county board of Philadelphia county is hereby authorized to direct the commissioners of said county to borrow, on the credit of the county, a sum not exceeding fifty thousand dollars, for a period not exceeding six months, in anticipation of the revenue of one thousand eight hundred and forty-four.

A SUPPLEMENT

To the act, entitled "An Act relating to the prison of the county of Chester," passed the first day of February, one thousand eight hundred and thirty-nine.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That so much of the third section of an act passed the first day of February, A. D., eighteen hundred and thirty-nine, entitled "An Act relating to the prison of the county of Chester," as relates to the time for appointing inspectors to said prison, be and the same is hereby repealed; and said inspectors shall hereafter be appointed in the manner provided in said section, some time in the month of November, in each year, and shall enter upon the performance of their duties on the first Monday of January following.

AN ACT

Relative to supervisors in the township of Smithfield, Monroe county.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall hereafter be lawful for the qualified voters of Smithfield township, in the county of Monroe, annually, to elect three supervisors of roads for said township, at the time and place now fixed by law for the election of supervisors.
