RESOLUTION 14907 OF THE COUNCIL OF THE CITY OF SAN JOSE SUPPORTING THE SAN LUIS PROJECT

Whereas Senator Clinton P. Anderson is supporting a bill pertaining to the feasibility of the San Luis project in Santa Clara County: Now, therefore, be it Resolved by the Council of the City of San Jose, That it hereby declares its support of and urgently requests inclusion of county of Santa Clara as a service area of the proposed San Luis project and particularly of the authorization of the project with works to serve this and other central coast areas subject to fiding of feasibility thereof.

Adopted this 19th day of May 1958 by the following vote:

Ayes: Councilmen Delmas, Hathaway, Moore, Starbird, Watson, and Solari. Noes: None.

Absent: Councilman Doerr.

MEMORANDUM OF TRANSMITTAL

To the Members of the Senate Committee on Interior and Insular Affairs: As the members of the committee know, Senate Joint Resolution 12, providing for transfer of right-of-way for Yellowtail Dam and Reservoir, Hardin unit, Missouri River Basin project, and payment to Crow Indian Tribe in connection therewith, and for other purposes, is now in conference.

Subsequent to action by the Houses of Congress, the United States Court for the District of Montana handed down a decision involving the lands and rights in question. The opinion was written by Judge William J. Jameson, former president of the American Bar Association.

The facts, legal issues, and conclusions of law in Judge Jameson's opinion are highly pertinent to the pending legislation, and I am transmitting to each member of the committee and to the conferees the opinion and order in the case, for their information and guidance. For convenience, I have instructed the committee counsel, Stewart French, to prepare a summary of the opinion and this is appended. Also transmitted is an expert appraisal of the value of the Yellowtail Dam site made by Hon. J. A. Krug, former Secretary of the Interior and former Chairman of the War Production Board.

I am certain these materials will be of interest and value in final action by the Congress on Senate Joint Resolution 12.
