Conveyance of Freehold and Alignment of Leafehold, and Covenant to furrender Copyhold Lands, with Covenants applicable.

PURCHASERS.

THIS INDENTURE quadripartite, made theday of, in the year of the reign, &c, and in the year of our lord, Between L. B. of, efquire, brother and heir of C. B. efq. deceased, who was eldest fon and heir of C. B. heretofore, of, efq, deceased, and which faid C. B. the fon, and L. B. were devifees named in the last will and teftament of the said C. B. (a) the father, of the first part, dame F. G. of ——, in the county of, widow, daughter of the faid C. B. the father, and a devifee named in his faid will, of the fecond part, C. B. of, efquire, fon and heir of L. B. late of ——, efquire, deceased, who was brother of the aforefaid C. B. the father, and a devifee named in his will, of the third part, and N. O. of the parish of, in the county of fpinster of the fourth part. WHEREAS the Recitals. faid C. B. the father, being feifed in fee fimple, of

(a) The reason that F. S. and C. B. were made parties in this inftrument, and that the acts of R. B. deceased, are covenanted againft, is, that C. the father having devised as in the deed is ftated, without using words either of inheritance or perpetuity, a doubt arofe whether the fon B. had a fee or only a life eftate in the premises; in order therefore to. obviate all confequences, and for a greater fatisfaction of the purchafer, it was agreed, that the perfons fuppofed to be entitled in reverfion fhould be made parties, and the acts of fuch of them as were dead, fhould be covenanted against for conveying the freehold and furrendering the copyhold, Pow, MSS.

O. at or before the fealing and delivery of thefe prefents, the receipt whereof is hereby acknowledged, and in pursuance and performance of the aforefaid agreement, in this behalf, they the faid dame F. G. and C. F. party hereto, at the request and by the order and direction of the faid R. B. party hereto, hath granted, bargained, fold, aliened, releafed, and confirmed, and by these presents doth grant, bargain, fell, alien, releafe, and confirm unto N. O. (in her natural poffeffion, now being by virtue of a bargain and fale thereof, to her made by the faid D. B. party hereto, dame F. G. and C. B. party hereto, in confideration of 5s. a-piece, by indenture, bearing date the day next, before the day of the date of these prefents, for the term of one year commencing from the day next before the day of the date of the faid indenture of bargain and fale, by force of the ftatute made for transferring uses into poffeffion, and to her heirs,) all those two fields, or clofes of meadow or pasture ground,
