I. and K. A. his wife, that the names of them the faid V. E. D.B. and H. T. fhall respectively stand and be used in this present indenture, and in the faid bond thereby referred to as aforefaid, as to the faid fum of, and intereft, in truft, and for the benefit of the perfon or perfons who, by virtue of the trufts declared in the faid indenture of release, is or are, or fhall or may, from time to time, be intitled to the intereft of the faid principal fum of, or to the principal itself. AND it is hereby alfo declared and agreed, by and Agreement that between them the faid V.E. D.B. and H. T. in cafe mortgagors neglect and the faid C. I. that, if the faid C. I. his to renew leafes heirs, executors, or adminiftrators, fhall, whilft for lives, mortthe faid fum of —, and interest, or any part fums expended thereof, remains a charge upon the faid hereby released and affigned premifes, at any time after charge on pre the death of any of the perfons named as lives, in mifes. the faid leafes of the and refpectively, or any renewed leafe or leafes of the premises therein refpectively comprised, and request to him or them made by the faid V. E. D. B. and H. T. or either of them, their executors, adminiftrators, or affigns, refufe or neglect to renew and take a new lease or leafes, from time to time, for three lives, from the perfon or perfons who, for the time being, fhall have power to grant the fame, and to pay the fines, and other charges and expences incident to, and ufually paid on fuch renewals; that then, and in fuch cafe, and as often as it shall so happen, it fhall and may be lawful, to and for the faid V. E. D. B. and H. T. their refpective executors, adminiftrators, or affigns, to furrender the present or any future leafes, and renew the fame, refpectively, and to take a new

in fuch renewal shall be, a

MORTGAGE, leafe or leafes, instead of fuch furrender, leafe, or leafes, by adding any other perfon or perfons, as a life or lives, inftead of fuch deceased person or perfons, and to disburse and lay out fuch fines, charges, and expences as fhall be payable and occafioned as aforefaid; and every fuch new leafe or leafes, of the faid leafehold premifes for lives, fhall remain and be a fecurity to the faid V. E. D. B. and H. T. as well for the payment of all fuch fum and fums of money as fhall be difburfed or laid out by them, or any of them as aforefaid, together with intereft for the fame, after the rate aforefaid, as for the payment of the faid principal fum of, and intereft, and shall not be redeemed or redeemable in law or equity, until all fuch fum or fums of money, and the intereft thereof, fhall be fully paid and fatisfied to them the faid V. E. D. B. and H. T. or the furvivor of them, his heirs, executors, adminiftrators, or affigns, any thing hereinbefore contained to the contrary thereof in any wife notwithstanding: And it is hereby further declared and agreed, by and between the faid V. E. D. B. and H. T. and the faid C. I. that if the faid C. I. his executors, adminiftrators, or affigns, fhall neglect or refuse to apply for and procure a renewed leafe, for a term of — years, of the faid lands and premises hereby affigned as aforefaid, within calendar months next after the expiration of the first, and every fucceeding years, from the commencement of the faid lease of from the perfons who, (for the time being,) fhall have power to grant the fame, and to pay the fine, and other charges and expences, incident to and ufually. paid on fuch renewals; that then, and in fuch cafe, it fhall and may be lawful to and for the faid V. E. D. B. and H. T. and the survivor of them, and the executors, administrators, or affigns of fuch furvivor, to furrender the prefent lease, or

any future renewed leafe of the premises, and to MORTGAGE renew the fame, for a term of -years, in his, her, or their own name or names, and to pay, disburse, and lay out fuch fines, charges, and expences, as fhall be payable by every fuch renewal; and every fuch renewed lease shall remain and be a fecurity to the faid V. E, D. B., and H. T. their executors, adminiftrators, and affigns, as well for the payment of all fuch fum or fums of money as fhall be paid, disbursed, and laid out by them, or any of them as aforefaid, together with interest for the fame, at the rate above-mentioned, as for payment of the faid principal fum of, and intereft, and fhall not be redeemed, or redeemable, in law or equity, until all fuch fum or fums of money, and the intereft thereof, fhall be fully paid and satisfied to the faid V. E. D. B. and H. T. their executors, administrators, or affigns, any thing hereinbefore contained to the contrary thereof in any wife notwithstanding. IN WITNESS, &c.

MORTGAGE. Mortgage of an Annuity, and Rectory, granted for Lives, and Leafeholds for Years.

THIS INDENTURE of four parts made the day of, in the year of the reign of our fovereign lord George the third, by the grace of God of Great Britain, France and Ireland, king defender of the faith and fo forth, and in the year of our Lord between E. E. of &c. clerk, and E. E. of &c. gent, of the first part, E. E. of &c. fpinfter, of the fecond part; B. P. of &c. of the third part; and B. A. of &c. of the fourth: Recital of a part. Whereas E. M. of the parish of ——, in the county of—, aforefaid, efq. deceased, by his laft will and teftament in writing, bearing date on or about the day of, in the year of our Lord, after charging his eftate both real and perfonal with the payment of his debts, and of feveral legacies as therein mentioned, gave and bequeathed unto his fifter the faid E. E. one yearly rent-charge of £, payable half-yearly, and charged his eftates in the parishes of
