MORTGAGE. lawful to and for the faid S. B. her heirs and affigns, peaceably and quietly to have, hold, and enjoy the faid piece or parcel of ground, hereditaments and premises hereby, or mentioned, or intended to be hereby granted and conveyed, with their and every of their appurtenances, and to receive and take the rents, iffues, and profits thereof, and of every part thereof, to and for her and their own ufe and benefit, without the lawful let, fuit, trouble, denial, eviction, or interruption, of or by the faid T. S. his heirs, executors, adminiftrators, or affigns, or any of them, or of, by, or from any other perfon or perfons lawfully claiming or to claim, from, by, or under, or in truft for him or them. AND the faid W. B. for himself, his heirs, executors, and adminiftrators, doth hereby further covenant, promife, and agree, to and with the faid W. S. his heirs, executors, adminiftrators, and affigns, that he the said W. B. his heirs or affigns, fhall and will, on or before the day of ——,

now next enfuing, at his and their own proper cofts and charges, infure, or cause to be insured, in fome or one of the public infurance offices for insuring houses and buildings from fire, in London and Westminster, all and every the faid meffuages and buildings hereinbefore mentioned, and intended to be hereby released from lofs or damage by fire, in the fum of- -, or upwards, in the names of them the faid W. B. and W. S. and fo on from time to time, as and when fuch insurance or insurances fhall cease, fo long as the faid fum of, or any part thereof, or the intereft thereof,

or any part thereof, fhall remain due and owing. MORTGAGE. And in cafe the faid W. B. his heirs or affigns, fhall neglect or refufe to make fuch infurance or infurances as aforefaid, it fhall and may be lawful to and for the faid W. S. his executors, adminiftrators, or affigns, to insure, or cause to be insured, the faid meffuage or tenement, and buildings, hereinbefore. mentioned to be hereby granted and releafed, in any office or offices for infuring houfes and buildings from fire, in London or Westminster, from lofs or damage by fire, in the fum of, or upwards, and fo on, from time to time, as and when fuch infurance or infurances fhall ceafe, and to retain and reimburse himself and themselves all fuch cofts, charges, and expences, as he or they fhall or may expend, or be put unto, in making fuch infurance or infurances as aforefaid, by and out of the faid meffuages or tenements, hereditaments and premises, hereinbefore mentioned, and intended to be hereby released, or by and out of the rents, iffues, and profits thereof. AND it is hereby agreed and declared, that in cafe the faid meffuages or tenements, buildings and premifes, hereby released, or intended fo to be, or any part thereof be burnt down, or damaged, or destroyed by fire, then and in fuch cafe, all fuch fum and fums of money as fhall or may be recovered or received, upon or by virtue of fuch infurance or infurances as aforefaid, shall be laid out and expended in the rebuilding or repairing the faid meffuages or tenements, buildings and premifes, hereby released, or intended fo to be, or fo much thereof as fhall be burnt down, damaged, or deftroyed by fire, as aforefaid, or that he the faid W.S. his executors, adminiftrators, or affigns, fhall have, take, and receive the monies to be due and payable therefore, and apply the fame, or fo much thereof as fhall be neceffary in difcharge of the faid fum of, and the intereft which fhall

MORTGAGE. be then due for the fame, for all which purposes the faid W. B. doth hereby make and ordain the faid W. S. his executors, adminiftrators, and affigns, his true and lawful attorney and attornies, deputy and deputies.

Declaration that outstanding Terms fhall be in Truft, for Mortgagee, then to attend the Inheritance.

AND laftly, it is hereby agreed and declared, by and between the faid parties, that all and every perfon or perfons now ftanding or being, or who fhall or may hereafter ftand, or be poffeffed of, or interested in, any outstanding term or terms of years, limited or created, of or concerning the faid meffuages, lands, tenements, hereditaments, and premises, hereby released, or intended fo to be, with the appurtenances, or any of them, or any part thereof, and their refpective executors, adminiftrators, and affigns, fhall from henceforth ftand, and be poffeffed of, and interested in fuch term or terms of years, or fo much thereof, refpectively, as are or is now to come, or unexpired, in truft, in the first place, for the faid W. S. his executors, adminiftrators, and affigns, for the purpose of better fecuring to him and them the payment of the faid principal fum of, and the intereft thereof, as aforefaid, and fubject thereto, in truft for the faid W. B. his heirs and affigns, and to attend and wait upon, and go along with the freehold and inheritance of the faid meffuages, lands, tenements, and hereditaments, and all and fingular other the premises hereby released, or fuch part or parts thereof as fhall be comprised therein, or affected thereby, in order to protect the fame premifes from all mefne incumbrances, if any fuch there be.

CREDITORS. tended (and which was foon after folemnized) between the faid G. earl of, and the faid A. M. D. now countefs of and that the faid A. M. D. was (among other things) feifed of or entitled to one copyhold meffuage or tenement, with the appurtenances, and divers pieces of land, to her and her heirs, according to the cuftom of the manor whereof the fame are holden, fituate in the parish of, in the faid county of, therein and hereinafter more particularly defcribed; and was alfo poffeffed of plate, pictures, houthold furniture, and other perfonal eftate which were agreed to be fettled, for the feparate ufe, benefit and difpofition of the faid A. M. D. in manner therein and hereinafter mentioned. AND further reciting that the faid A. M. D. now countefs of --, in pursuance of the faid agreement, had on or before the day of the date thereof, with the privity and confent of the faid G. earl of, (teftified by his being made a party to, and the fealing and execution of thefe prefents,) duly furrendered, or caufed to be furrendered to the ufe of them the faid fir G. P. and fir 7. E. W. all that his cuftomary and capital meffuage, out-houses, gardens, orchard and land, containing customary acres,

and a fummer house, and a little plot of ground over against the said meffuage, between the road and the river, and alfo all that cuftomary acre of land thereto adjoining, on the eaft, and on the garden or orchard, late the land of L. H. with the appurtenances thereto belonging, and that they the faid fir G. P. and fir 7. E. W. had been admitted thereto, to hold to them and their heirs, according to the custom of the said manor. It is thereby witnessed that for the confiderations thereinbefore mentioned, it was thereby agreed and declared by and between the faid parties thereto and the faid fir G. P. and fir J. E. W. by and with the confent, privity and approbation of the
