M. and J. E. or any purchaser or purchafers of the faid feveral eftates, or of any parts thereof, or their or any of their counfel learned in the law, fhall reafonably defire, advife or require, for vefting the legal eftate, and intereft of and in the faid eftates fo directed to be fold as aforefaid, in the purchafer or purchafers thereof, his, her, or their heirs, executors, adminiftrators, and affigns. PROVIDED ALWAYS, and it is hereby declared by and between the parties thereto, to be the true intent and meaning of them, and of these prefents, that nothing in these presents contained shall extend, or be construed to extend, to divert or deprive the faid G. earl of, his executors, adminiftrators, or affigns, of the crops of corn, grain, hops, and hay, and the hop-poles, now ftanding, growing, and being in or about fuch part of the premises hereby conveyed and appointed, or covenanted fo to be, as are now in the tenure or occupation of him the faid G. earl of -; but that he the faid G. earl of his executors, adminiftrators, or affigns, fhall and may have, receive, and take the fame to them, and their own proper use and benefit, and shall have full power and authority to enter into and upon the faid premifes, or any part thereof, to

L. in fuch and the fame manner, to all intents and purposes, as if he had been originally named and trufted by this indenture for the purposes aforefaid. Provided always, and it is hereby declared and agreed, by and among all the faid parties to thefe prefents, that in cafe this prefent indenture fhall not be executed and affented to, by fuch and fo many of the creditors of the faid G. earl of, whofe feveral debts collectively, amount to the fum of, on or before the day of, next enfuing the date hereof, (fave and except fuch creditors whofe debts are fecured by mortgage, of any part of the estates of the faid G. earl of fave and except J. L. of - gent.) then these presents, and the grant and release, affignments, appointments, and furrenders hereby, or in confequence hereof to be made, fhall cease, determine, and be of no effect, and that in fuch cafe the faid 7. M. and J. E. their heirs, executors, and administrators, fhall and will at the request and charges of the faid G. carl of --, his heirs,

H. for business done for the faid earl of, relating to the debts which he now owes prior to the preparing this indenture, and all other cofts, and charges whatfoever, which they fhall or may be put unto, in or about the premifes, furrender and re-affign all the faid feveral premifes above mentioned, unto the faid G. earl of, the faid A. M. countefs of ——, the faid fir G. P. and fir 7. E. W. their heirs, executors, adminiftrators, or affigns, according to their feveral and respective interefts therein at the time of executing these prefents, and according to the nature of the different eftates aforefaid, in as full and ample a manner as if these presents had not been made or executed, freed and difcharged of and from all incumbrances whatfoever, to be made, done, executed, or committed by the faid J. M. and J. E. or either of them, their or either of their heirs, executors, adminiftrators, or affigns. Provided laftly, and it is hereby declared and agreed to be the true intent and meaning of thefe prefents, and of the parties hereunto, that the faid J. M. and J. E. their respective heirs, executors, and adminiftrators, fhall be charged or chargeable only, for and with his own respective receipts, payments, acts, and wilful defaults, and not otherwife, and fhall not be charged or chargeable with any fum or fums of money, other than fuch as fhall actually and refpectively come to his or their hands, or with the acts, defaults, or any of the mifcarriages of the faid A. L. or of any other perfon or perfons that fhall by virtue of the provifo hereinbefore for that purpose contained, be elected, nominated, and appointed to act in execution of all or any of the trufts hereinbefore repofed in the faid A.
