SEC. 10. SEC. 11. SEC. 12. That this act shall take effect and be in force from and after its passage.

CHAPTER CCLX.

AN ACT to incorporate the Stauton University at Stanton.

Be it enacted by the Governor and Legislative Assembly of the Territory Kansas, as follows:

SECTION 1. That R. W. Massey, Samuel Howser, P. R. Wilkerson, Jr., D. C. Baker, William Smith, and John T. Benning, and their successors, are hereby constituted and de- and powers. clared body corporate and politic, and shall be known by the name of "The Board of Trustees of Stanton University," and by such name shall have succession and be capable of making contracts, of suing and being sued, pleading and being impleaded in all courts of law or equity in this territory or elsewhere; may have and use a common seal and alter the same at pleasure; and by that name and style shall be capable in law and equity of taking and holding by devise and otherwise, or of purchasing, holding, and enjoying to them and their successors, and real estate in fee simple or otherwise, any goods, chattels and personal estate, and of selling, leasing, mortgaging or otherwise disposing of said real and personal eseate or any part thereof, as they may think proper.

SEC. 2. That the present trustees of said university and

their successors in office, under such constitution as may be hereafter adopted, or as the same may be hereafter altered or amended, shall have the care and management of said university and of its estate and property, and shall also have power in conformity with the provisions of the constitution of said university, to make by-laws and ordinances, for the appointment of professors and other officers of said university; for regulating the duties and conduct of the professors, officers and students therein; for the conducting of its business and concerns, and generally for the good government of the same; Provided, the same be not inconsistent with the constitution. and laws of the United States or of this territory.

SEC. 3. That the property, real and personal, belonging to and owned by the university for the support of the said university, shall be forever free from taxation.

SEC. 4. That the president and professors of said university shall constitute a faculty with the power of conferring de. grees in the arts and sciences, and performing all such other acts as pertains to universities for the encouragement and reward of learning, and the name and style by which the said degrees shall be conferred, shall be that of "The President and Professors of the Stanton University of Kansas," or by such other name as may be hereafter agreed upon as aforesaid.

SEC. 5. That the president and professors of said university shall constitute a faculty with the power of conferring degrees in theology, law and medicine, and of doing all such other acts as appertain to the faculties of universities for the encouragement of theological, legal and medical learning by such name and style as may be adopted.

SEC. 6. This act shall take effect and be in force from and after the passage of this act.

WAGON ROADS,

CHAPTER CCLXI.

AN ACT to incorporate the Denver, Auraria and Colorado Wagon Road Com-
pany.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That Joseph Casto, Homer Fellows, Clinton Dorsey, Solomon Shope, their associates and successors, are hereby constituted and declared a body politic and corporate, by the name and style of the "Denver, Auraria, and Colorado Wagon Road Company," and by that name shall be capable and powers. of making contracts, of suing and being sued, of pleading and being impleaded, in all matters whatsoever, in all courts of law and equity in this territory and elsewhere. Said company is authorized to have and use a common seal, and alter the same at pleasure, and to make such by-laws and regulations as from time to time may be deemed necessary for the government of said company and the management of its affairs. Said company is hereby invested with full power of acquiring by purchase or otherwise, and of holding and conveying real and personal estate, which may be necessary to carry into effect the purposes and objects of this act.

SEC. 2. Said company is hereby authorized and empow- Location. ered to survey, locate, construct, complete, alter and maintain a wagon road from Denver City, via Auraria, Baden, Mount Vernon, South Park, Tarry-All, Fort Jones, and terminating at Saratoga West, on the Blue Fork of the Colorado River, in the Middle Park, with the privilege of making branches from said road, whenever the interest of said company and the wants of the country may require it.

SEC. 3. Said company is hereby authorized to appropriate one hundred feet in width upon the route of the entire length of the road, to the use of said company, in building and maintaining said road.

SEC. 4. The capital stock of said company shall be ten thousand dollars, with power to increase said capital to twenty thousand dollars, should the interests of the company require

SEC. 6. It shall be the duty of said company, as soon as practicable, to file in the office of the secretary of the territory a map and profile of said road, and all its branches.

SEC. 8. The said company shall complete said road to Tarry-All on or before the fifteenth day of May, A. D., 1860, and to Fort Jones on or before the first day of June, A. D., 1860, and to Saratoga West on or before the first day of July, A. D., 1860.

SEC. 9. The rates of toll on said road shall not exceed one dollar and seventy-five cents from Mount Vernon to TarryAll, and one dollar from Tarry-All to Fort Jones, and one dollar from Fort Jones to Saratoga West; and tolls are not to be collected on any part of the road until the same is in good condition for teams to pass over, and only in proportion to the amount expended in building said road. The above rates of toll collectable from wagons drawn by three yoke of oxen, or like numbers of horses or mules, and fifty cents from each additional team from Mount Vernon to Tarry-All, and twentyfive cents from Tarry-All to Fort Jones, and twenty-five cents from Fort Jones to Saratoga West.

SEC. 10. The grade on said road shall in no place exceed ten feet in rise to one hundred feet, and shall be bridged where needed, and in every way be made a safe road for teams at all seasons of the year, when not obstructed by snow.

SEC. 11. This act shall take effect and be in force from and after its passage, and remain in force for two years from the fourth day of July, A. D., 1860, unless the company sooner make it a free road.

CHAPTER CCLXII.

AN ACT to incorporate the Denver City and Beaver Creek Wagon Road and
Wagon Road and Bridge Company.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

That Jesse Colman, Osaph Allen, John Anthony, Rosenberg Wilson, and their associates and successors, are hereby constituted and declared a body politic and corporate, by the name and style of the Denver City and Beaver Corporate name Creek Wagon Road and Bridge Company, and by that name shall be capable of making contracts, of suing and being sued, of pleading and being impleaded, in all matters whatsoever, in all courts of law and equity, in this territory or elsewhere. Said company is authorized to have and use a common seal, and to alter the same at pleasure; to make such by-laws and regulations as, from time to time, may be deemed necessary for the government of said company and the management of its

affairs.

SEC. 2. Said company is hereby authorized to survey, Location. locate and construct a wagon road, commencing at the fortieth parallel of latitude on the line of Nebraska, about twenty miles south of the Platte River to Denver city.

SEC. 3. The said company shall have the right to appro- Right of way. priate one hundred feet wide on the route of the entire length of said road to the use of said company in building said road. SEC. 4. The said company is hereby authorized to charge Tolls. and collect such rates of toll as may be established by the county board doing business within and for Arrapahoe county; but no tolls shall be collected on any part of said road until the same is in good condition for teams to pass over, and only in proportion to the amount expended in building said road.

SEC. 5. The capital stock of said company shall be twenty- stock. five thousand dollars, and shall be deemed personal property, and the said company may, by by-laws, prescribe rules for the issuing of said stock and the transfer thereof by each individual stockholder.
