In accordance with the provisions of Section 401, we certify that this project, subject to the indicated conditions, is consistent with applicable provisions of Section 303 of the Federal Clean Water Act, as amended. We also hereby certify that there are no applicable effluent limitations under Sections 301(b) and 302, and that there are no applicable standards under Sections 306 and 307. We reserve the right to impose additional conditions on this Certification to respond to specific problems which might arise and take enforcement actions necessary to ensure compliance with the State water quality standards. If there are water quality problems in the Back River, Front River, Middle River, or Savannah River related to this work, the Department will request you identify the causes and take actions to eliminate future problems. The Council agrees with your determination that this activity is consistent with the South Carolina Coastal Management Program provided (1) that the dikes for Area 14 and Jones/Oyster Bed Islands are constructed from materials in the disposal areas such that the outside of the base extends only to the line shown on the plats submitted with the determination; (2) that the dikes are constructed before any additional spoil is deposited in Area 14 Jones/Oyster Bed Islands; and, (3) further, that no dredged materials are deposited in undiked areas of South Carolina and no dredged materials are allowed to flow into South Carolina marshes. The Council appreciates the cooperation and significant effort on the part of the Savannah District Corps of Engineers in meeting the consistency requirements of the South Carolina Coastal Management Program.
